Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Chapter 188 (Notification of Defects) of the Town of Ithaca Code, Section
188-2, “Transmission of notices,” is amended by replacing current Section 188-2 in its entirety
and replacing it with a new Section 188-2 as follows:
“For the purposes of this chapter, “written notice” shall mean a written physical hard
copy; a notice submitted via email to the Town Clerk or Highway
Superintendent/Director of Public Works at the address for the applicable official
shown on the Town’s official website ; or a notice submitted via the Town’s official
website or any other website, service, or application the Town uses to allow the public
to submit to the Town reports of defects described in § 188 -1. Any notice submitted
electronically to the Town as described in this section shall be deemed submitted only
upon the Town’s sending a confirmation to the person submitting the notice that the
Town Clerk or the Highway Superintendent/Director of Public Works has received the
notice. The Highway Superintendent/Director of Public Works shall transmit all written
notices received by them pursuant to this chapter to the Town Clerk within 10 days of the
receipt thereof. The Town Clerk shall distribute a copy of all written notices received by
them pursuant this chapter to members of the Town Board within 10 days of the receipt
thereof and maintain an index of such notices, by location, for a period of no less than
five years from the date of receipt of said notice.”
Section 2. Chapter 188 (Notification of Defects) of the Town of Ithaca Code, Section
188-3, “Legislative authority; supersession of statue” is amended by replacing current Section
188-3 in its entirety and replacing it with a new Section 188-3 as follows:
“This chapter is adopted pursuant to §10, Subdivision 1(ii) d (3), of the Municipal Home
Rule Law. This chapter supersedes Town Law Section 65-a (1-4) to the extent this
chapter is inconsistent with it.”
Section 3. In the event that any portion of this law is declared invalid by a court of
competent jurisdiction, the validity of the remaining portions shall not be affected by such
declaration of invalidity.
Section 4. This local law shall take effect immediately upon its filing with the New York
State Secretary of State.

Whereas, on December 29, 2021, the Town Board adopted Local Law 16 of 2021: Adding Short-
Term Rental Provisions to Chapter 270, Zoning, of the Town of Ithaca Code; and
Whereas, the Short-Term Rental Provisions balance the desire of some property owners to rent all
or a portion of their homes to generate income to defray the cost of homeownership, with the
Town’s obligation to protect the public health, safety, and welfare of the full-time residents in the
Town; and
Whereas, the Planning Committee reviewed maps and draft language at their meetings on
November 21, 2024, January 16, 2025, March 20, 2025, April 17, 2025, and May 29, 2025, and
referred the draft to the Town Board; and
Whereas, the proposed revisions were discussed at the June 23, 2025, Town Board meeting; and
Whereas, on July 14, 2025, the Town Board scheduled a public hearing to be held by said Board on
August 11, 2025, at 5:30 p.m., to hear all interested parties on the proposed local law; and
Whereas, said public hearing was duly advertised and held on said date and time and all parties in
attendance were permitted an opportunity to speak regarding said proposed local law, or any part
thereof; and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its

A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED
IN GENERAL MUNICIPAL LAW §3-C
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Legislative Intent: It is the intent of this local law to override the limit
on the amount of real property taxes that may be levied by the Town of Ithaca, County of
Tompkins pursuant to General Municipal Law §3-c, and to allow the Town of Ithaca,
County of Tompkins to adopt a town budget for (a) town purposes, (b) fire protection
districts, and (c) any other special or improvement district, and Town improvements
provided pursuant to Town Law Article 12-C, governed by the Town Board for the fiscal
year beginning January 1, 2026 and ending December 31, 2026 that requires a real property
tax levy in excess of the “tax levy limit” as defined by General Municipal Law §3-c.
Section 2. Authority: This local law is adopted pursuant to subdivision 5 of
General Municipal Law §3-c, which expressly authorizes the Town Board to override the
tax levy limit by the adoption of a local law approved by vote of at least sixty percent (60%)
of the Town Board.
Section 3. Tax Levy Limit Override: The Town Board of the Town of Ithaca,
County of Tompkins is hereby authorized to adopt a budget for the fiscal year 2026 that
requires a real property tax levy in excess of the limit specified in General Municipal Law
§3-c.
Section 4. Severability: If any clause, sentence, paragraph, subdivision, or part
of this Local Law or the application thereof to any person, firm or corporation, or
circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or
unconstitutional, such order or judgment shall not affect, impair, or invalidate the
remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph,
subdivision, or part of this Local Law or in its application to the person, individual, firm or
corporation or circumstance, directly involved in the controversy in which such judgment
or order shall be rendered.
Section 5. Effective date: This local law shall take effect immediately upon filing
with the Secretary of State.

PROJECT OVERVIEW
The Town of Ithaca is seeking statements of qualifications to establish a qualified pool of
consultants interested in providing the Town with services to track and report all short-term rental
(STR) units occurring in the Town of Ithaca
BACKGROUND
The Town of Ithaca (Town) has a short-term rental (STR) operating permit requirement for all
dwelling units that rent for a period of less than 30 days. The Town conducts inspections on three-
year intervals for all properties that are granted short-term rental operating permits.
SCOPE OF SERVICES
The goal and intent of the Town is to ensure all STR dwelling units are compliant with all applicable
Town of Ithaca local laws.
The following is a list of required deliverables and related scope of services:
• Provide a monthly report of all STR activities to the Town, which identifies the total
number of units rented, the total number of units in compliance, and the total of units not
in compliance, or operating without a permit.
• Monitor websites, several times each week, such as but not limited to Airbnb, VRBO,
Booking.com, FlipKey, etc. to identify short-term rental units and status of compliance.
• Provide address identification for all short-term dwelling units that rent for a period of less
than 30 days.
• Provide the following Property characteristics (from Assessment and/or Realtor Data):
o Property address
o Owner name and mailing address
o Residential type (primary residence, secondary/investment property)
o Property type
o Number of bedrooms and bathrooms
o Map of the property’s location
o Maximum occupancy per Town of Ithaca ordinance
• Provide a GIS layered map to identify locations of ALL short-term rental units.
• Provide an interactive dashboard system that allows for:
o searching and filtering of all information related to short-term rentals.
• Integrate and update information related to operating permits the Town issues to show
compliance within the short-term renal compliance monitoring system.
• For each STR, provide the following listing characteristics:
o URL for each listing associated with each specific property
o Listing ad ID for each listing associated with each specific property
o Rental calendar showing current month, prior twelve months and upcoming three
months booking activity (frequently updated calendar)

o Differentiate between regular bookings and host-blocked dates that are not
revenue-generating
o Host name (when available)
o Stay limitations (minimum/maximum)
o Permit/license number if included in the listing
o Daily rental rate at time of booking
o Rental frequency

listing (to track changes), and records archiving in the event a listing is taken down
by the host. Provide each image with a date stamp showing when it was created
that is kept indefinitely.

• Provide an unlimited number of user accounts from the Town.
BUDGET AND TIMELINE
The consultant will need to quote a flat annual fee for the services to be considered by the Town on
an annual basis, and a three-year option for term of the agreement.

3. Qualifications. The response shall include a Statement of Qualifications (“SOQ”), a brief section
that indicates the experience and qualifications of the Company, the manager and any other
critical members of the team. It should describe what talents their team brings to the project, how
their knowledge/experience will benefit the process, how the team has been successful in the past
and how that relates to this scope of services.
4. Account Personnel. Identify the primary point of contact(s) to be assigned to work with the town,
their relevant experience and role/duties/position in the organization.
5. References. Provide names, telephone numbers, and email addresses of three (3) external
references who can speak to past performance on at least (3) similar service contracts.
6. Examples of Reports. Provide a sample of the types of monthly reports described above
in the scope of services that will be required.
EVALUATION
Responses will be evaluated on the following information:
1. Reporting Accuracy, Quality & Usability
a. Sample reports will be evaluated for accuracy, ease of use and alignment with the
scope of work/services requested.
2. Interactive Dashboard
a. The town will request a demonstration of the interactive tools to be made
available to town personnel to be evaluated for accuracy, ease of use and
alignment with the scope of work/services requested.
3. Past Performance Rating
a. The rating will be based on the performance of services provided to other clients
from a list of (3) three external references from clients who received similar
services to those proposed for this solicitation.
4. Strength of Team
a. Based on the proposals, the interview, and service plan, the Town shall evaluate
the expertise and experience of the Consultant and the project lead as it relates to
the similar services provided to other clients.
5. Cost
a. The annual cost proposed and the value for the services will be strongly
considered.
6. Demo of product:
a. The client will provide a demo of the product to be scheduled after the initial
submission of the RFQ
Consultants shall be selected based on their formal submitted proposal for consideration.
Exclusion of any service for the project may serve as cause for rejection. The proposal shall
address all items completely and thoroughly and shall be signed by an officer of the firm
authorized to bind the Consultant to its provisions. The contents and commitments in the Proposal
shall remain firm for ninety (90) calendar days from the submittal due date.
Final recommendations will be made by the Town Director of Code Enforcement and
subsequently the Town of Ithaca Town Board. Final approval to contract with a consultant will be
made by Resolution of the Town of Ithaca Town Board.

By submitting a RFQ, the Consultant certifies that it is not currently debarred from submitting
bids for contracts issued by any political subdivision or agency of the State of New York and that
it is not an agent of a person or entity that is currently debarred from submitting bids or contracts
issued by any political subdivision or agency of the State of New York.
Non-Collusion
Consultants shall submit a fully executed Non-Collusion Statement with their responses and
subsequent proposals. The statement can be found in Appendix A.
Conflict of Interest
Consultants shall prepare and submit a statement that no conflict-of-interest issues exist at the
submission of their responses to this RFQ. In addition, non-conflict of interest statements must
also be provided for any sub-consultant.

TB Resolution 2025- : Approval and authorization for the Director of Code Enforcement to
execute a Compliance and Remediation Plan for 172 Calkins Rd., Ithaca New York
Whereas: For several years, the Town has received multiple complaints regarding property
maintenance violations at 172 Calkins Rd., and
Whereas: On January 30, 2024, an inspection of 172 Calkins Rd was conducted by the Director of
Code Enforcement (Director) and violations of the Town’s Property Maintenance Law were found,
and
Whereas: The Director composed and mailed a certified letter to the owner identifying the
violations found pursuant to the Town’s Property Maintenance Law (Chapter 205) and the
applicable NYS Property Maintenance Code, and
Whereas: The owner signed for receipt of the certified letter and called the Director to discuss said
letter, stating that he would clean up the property by the end of Summer in 2024, and
Whereas: Follow up inspections by the Director were conducted on February 5, 2024, February 28,
2024, April 9, 2024, April 30, 2024, May 22, 2024, July 15, 2024, August 16, 2024, which showed
no progress had been made in addressing the violations, and
Whereas: On August 16, 2024, the Director personally delivered and sent via certified mail, a
“Failure to Maintain Property Notice” (Notice) indicating the deadline date to remove all violations
on the property or the option to request a hearing before the Town of Ithaca Zoning Board of
Appeals within 15 days of the date of mailing of the Notice, and
Whereas: No hearing request was made and follow up inspections were conducted by the Director
on September 5, 2024, September 16, 2024, September 23, 2024, October 29, 2024, November 18,
2024, and December 16, 2024, where progress appeared to be being made towards addressing the
violations stated in the Notice, and
Whereas: Follow up inspections were then conducted by the Director on January 31, 2025, February
24, 2025, April 10, 2025, June 16, 2025, and June 30, 2025, where the owner appeared not to have
made any further progress towards addressing the violations stated in the Notice, and
Whereas: Town Code Chapter 205 requires that upon the failure of the property owner to remove all
violations or request a hearing before the Town’s Zoning Board of Appeals by the prescribed date,
the Director shall cause a Compliance and Remediation Plan (Plan) to be presented and approved by
the Town Board, now, therefore be it
Resolved: that the Town Board approves the Compliance and Remediation Plan reviewed on
August 11, 2025, and authorizes the Director to proceed with the Plan.

In accordance with section 205-4C of the Town of Ithaca Property Maintenance Code, a
compliance and remediation plan is to be presented to the town Board for approval when
an induvial fails to comply with a “Failure to Maintain Property Notice” issued by the
Town’s Code Enforcement Department.
Following the failure of the property owner at 172 Calkins Rd to address violations outlined
in the “Failure to Maintain Property Notice”, I, Marty Moseley, Director of Code
Enforcement, initiated contact with contractors specializing in property clean-up and debris
removal to obtain cost estimates.
Two written quotes and two verbal estimates were received. The written quotes—subject
to change due to the inability to conduct a site visit—were approximately $3,000 and
$11,000.
Based on this information, I respectfully request approval to proceed with remediation by
engaging the contractor who provided the $3,000 estimate to bring the property into
compliance.

such manner and in such detail as has heretofore been determined by the Town Board of the Town
of Ithaca, Tompkins County, New York, relating to the establishment and construction, pursuant
to Article 12-C of the Town Law, of sewer system improvements to be known and identified as
the Town of Ithaca 2025 Cecil Malone Sanitary Sewer Improvement (the “Improvement”), to
provide such Improvement to the present Town sewer system, such Improvement to be jointly
owned by the Town of Ithaca and the City of Ithaca, to serve a benefitted area in said Town to be
known as the Town of Ithaca 2025 Cecil Malone Sanitary Sewer Improvement Area (the “Sewer
Improvement Area”); and
Whereas, the area of said Town determined to be benefited by said Sewer Improvement
Area consists of the entire area of said Town excepting therefrom the area contained within the
Village of Cayuga Heights, and the Sewer Improvement Area boundaries shall consist of the entire
area of said Town outside of the Village of Cayuga Heights as more fully shown upon a map on
file in the office of the Town Clerk, which map is available for inspection by any person or persons
interested in same during regular office hours at said office; and
Whereas, said map, plan and report, including estimate of cost, were prepared by a
competent engineer, duly licensed by the State of New York and have been filed in the office of
the Town Clerk of said Town, where the same are available during regular office hours for
examination by any person or persons interested in the subject matter thereof; and
Whereas, the Improvement proposed in connection with the establishment of the Sewer
Improvement Area consists of replacing approximately 250 LF of 8” Cast Iron forcemain with
new 8” HDPE and installing 190 LF of 12” Steel Sleeves, as well as other ancillary and incidental
improvements and expenses in connection therewith, at a maximum estimated cost to the Sewer
Improvement Area of 41.57% of $208,579.50, which is $86,706.50; and
Whereas, said maximum estimated cost shall be authorized to be financed by the
expenditure of current revenues and surplus funds from sewer rents and charges from said Sewer
Improvement Area or by the issuance by the Town of Ithaca of its serial bonds with a maximum
maturity not in excess of the forty-year period prescribed by the Local Finance Law; and

Whereas, it is proposed that the cost of the Improvement shall be borne by the real property
in said Sewer Improvement Area by assessing, levying upon and collecting from the several lots
and parcels of land within such Sewer Improvement Area, outside of any villages, which the Town
Board shall determine and specify to be especially benefitted by the Improvement, an amount
sufficient to pay the cost or the principal and interest on serial bonds and any bond anticipation
notes issued in anticipation of the issuance of serial bonds, as the same become due and payable;
and
Whereas, said maximum estimated cost is not greater than one-tenth of one per centum of
the full valuation of the taxable real property in the area of the Town of Ithaca outside of any
villages and, therefore, in accordance with the provisions of subdivision 13(a) of Section 209-q of
the Town Law, the permission of the State Comptroller is not required for such Improvement and
the establishment of said Sewer Improvement Area; and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”)
and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board
that approval, construction and implementation of the Improvement are a Type II action due to the
Improvement being a “replacement, rehabilitation or reconstruction of a structure or facility, in
kind, on the same site….”; and
Whereas, it is now desired to call a public hearing for the purpose of considering said map,
plan and report, including estimate of cost, and the providing of the Improvement, and to hear all
persons interested in the subject thereof concerning the same, all in accordance with the provisions
of Section 209-q of the Town Law; now, therefore, be it
Ordered, by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows:
Section 1. A public hearing shall be held by the Town Board of the Town of Ithaca, Tompkins
County, New York, at the Town Hall, 215 North Tioga Street, in Ithaca, New York, in said Town,
on August 25, at 4:30 o’clock P.M., Prevailing Time, to consider the aforesaid map, plan and
