Supervisor Whitcomb - 9 (m) Appointment 0 f Planning Board Chair,
will not be acted up,on as no, recommenclatiOrl ot Chair was, made by
the Planning Board.
Councilwoman GrigorOV The appointment should be discussed
personnel matter under an Executive Session.
Motion made by COUrlCiLman Niklas, seconded by COUrlCilffian Klein
approving and/Or adopting the resolutions for the Consent Agenda

Motion made by Councilwoman GrigorOV, seconded by Councilman
Niklas app,Ointing Fred T . Wilcox, III . , 'T -i: 1/1/95, - 12/3,1/95;
and Candace Cornell, Te=-i: 1/1/95 - 12/31/2001 to serve as members
of the Planning Board. The Town Clerk is, authorized and directed
to forward a certified COPY Of this resolution to these new
members and the Chair Of the Planning Board. Carried unariLmously.

Paving-Road Shoulders :

resolution Put bef ore the Town Board.
Mr. Noteboom - Ward HungerfOrd and William MOND S, 0 f the C Ounty
Highway Dep, -[ent stated the County has, no plans 0 f n 0 t paving
shoulders, . The plan is to C Ontinue paving what has, always been
clone in the Past, and to make decisions, on other shoulders as the
need arises . The County paves shoulders where necess,ary when
there is, Peclestrian traffic . Some rural roads do, not have the
shoulders, paved. The County does pave rural roads with erosion
problems .
M r. MO,bbs wrote regarding the shoulders on Warren Road in case the
'Town of Ithaca wanted sidewalks, on that road. If the Town clid not
object to the construction of the siclewalks, maybe the project
could. be shared.
Mr. MObbs, and Mr. ]Hungerfore had no problem with the TOwn Board
passing a resolution endorsing paving shoulders as loric as it was
a "friendly" res,olution.
Councilman Niklas - In looking at the resolution, why should the
'Town Board bother.
Councilwoman Valentino, It would clo no har�m to pass, the
resolution since the COUrity has a tendency to change policies .

shOWing appreciation it is, clone .
Councilwoman Grigoro,v - In a previous meeting it was, reported by
'Tim Jos,eph, C Ounty Representative that the County was considering
not paving shoulders to save money,.,
Councilman Niklas - Could a sentence be added to the res,olution
asking the County riot change the Policy of paving roads?
Motion made by COUrlCilwoman ValentirlO, seconcled by CounciLman
Conley CGmmend i rig Tomp ki n s County for its, policy of paving
shoulders, and supporting the continuance of this Practice . 'The
'Town Clerk is directed to forward. a certified copy of this
resolution to, the Tompkins County Board of Representatives .,
Motion carried. with all Town Board members Voting aye, with the
excep,ti0n Of COUrlCiLman Niklas voting, nay.
Agenda -It&m No. 12 - Bid Acceptance and Awarcl-Of Bid, Jet Rodcler:
Mr. Walker - Four responsible bids, were received for the purchase
ot a trailer mounted s,ewer Jet . The recommendation is, to, accep,t
the 1 Ow bid f rGm Foster' s Equipment, Incorporated for $20, 757 .

Supervisor Whitcomb How does this, bid co�mp,are with the (--Iuotes
received over, the telephone before bidding?
Mr. Walker - The bids, are apProximately $350 . 00 more than the
telephone quotes, .
Motion made ID y Councilwoman Grigorov, seconded by Councilwoman
Valentino accepting the bid from Foster' s Equipment Incorporated.
The Town Engineer is directed t 0 purchase one new trailer mounted
sewer jet as, specified f or the price of $20, 757 . 'The Town Board
authorizes the funds to, be eXfDended from the G8120 .200 account for
e(--juip,ment purchase . Carried unan1mously.
Agenda -It&m No. 13, Extension of Court Clerk Services :
Ms . Pun ger - Justice Larkin has requested an extension 0 f work
hours for his Court Clerk, Judith Bernal on a regular basis from
fifteen hours, per week to thirty hours per week. This, WOUl d e(--ju a 1
the a�mount ot hours, ot Justice Wallenbeck' s, clerks . Justice
Larkin feels the re(--Iuest is, Justified because 0 f the increas,ed
workload.
Councilman Niklas - 'This, was, mentioned. during the meeting with the
'Town Justicels, at budget time .
Councilwoman Valentino, - At that meeting Justice Larkin indicated
his workload was, not up to, s,ame level as Justice Wallenbeck.
Motion made by COUrlCiLman Niklas, seconded by COUrlCilffian Klein
approving the extension 0 f Judy Bernal ' s, work week to thirty
hours . All applicable benefits are pr(D-rated in keeping with the
part-time status, ot this position. Carried unanLmously.
Agenda Item NO. 6 - Public Hearing, "LOCAL LAW ESTABLISHING AND/OR
AMENDING TOWN CLERK, BUILDING, ZONING, ENGINEERING, PERMITS, AND
OTHER FEES AND REPEALING 'THE PROVISIONS, OF' THE ZONING ORDINANCE
AND OTHER LOCAL LAWS RELATED THERETO" :
Supervisor Whitcomb opened the public hearing at 10 : 10 a .m. , the
'Town Clerk had pr00,f of posting and publication. No, persOrl S
wished to be heard regarding the proposed local law. The
Supervisor closed the public hearing at 10 : 11 a.m.
Agenda Item No. 7 - SEQRF "LOCAL LAW ESTABLISHING AND AMENDING
'TOWN CLERK, BUILDING, ZONING, ENGINEERING, PERMITS, AND, OTHER FEES
AND REPEALING THE PROVISIONS OF THE ZONING ORDINANCE AND OTHER
LOCAL LAWS, RELATED, THERETO`-.
Motion made by COUrlCiLman Niklas, seconded by COUrlCilwo�man
Grigorov that the Town Board makes a negative deter�minati(Dn of
environmental significance in accordance with the New York State
Environmental Quality Review Act for the above referenced action

therefore, a Full Environmental Impact Statement will ri Ot be
required. Carried unanimously.
Agenda Item No. 8, - Enactment, "LOCAL LAW ESTABLISHING AND/OR
AMENDING TOWN CLERK, BUILDING, ZONING, ENGINEERING, PERMITS, AND
OTHER FEES AND REPEALING 'THE PROVISIONS, OF' THE ZONING ORDINANCE
AND OTHER LOCAL LAWS RELATED THERETO" :
Motion made ID y Councilman Niklas, seconded by Councilman Conley
enacting the referenced local law. The TOWrl Clerk is directed. t 0
publish and file the said local law as, required by law.
Attorney Barney - The changes, made to the local law adds, the
authority of the Town Board to, waive fees for good cause shown .,
Th i s, is the only change . 'The Supervisor needs, to sign a
Certificate of Necess,ity because this version of the 1 Ocal law was
not received within ten days, of action being taken.
'The SuPerviS or signed. the Certificate of Necessity related to, the
local law. Roll call vote carried. unanimously.
Agenda It&m No. 14 - Vacancies, Boards, and Committees :
Supervisor WhitCO3Mb - Christiann Dean has written she would be
interested in being Chair of the Agricultural Committee if it were
continued.
Mrs ., Noteb(DOM Additional corresp,0ndence was received from Ja�mie
Baker s,tating some m&mber of his family should be on the
Agricultural Co�mmittee due to the s,ize of their agriculture
business in the Town . Mr. Baker recommended Phyllis Baker be
appointed if it WOUld r10 conflict with her being in Florida
during the winter.
Councilwoman Grigoro,v - Is, it necessary to make the app,0intment
at this t1me s,ince Mrs . Baker is in Florida?
Mrs . N0tebo0M - 'The list of vacancies, Presented was, for the Board
to direct whether, adverbs ents, should be placed for these
positions,, or whether reapp,(Dintment of th0s,e individuals
expressing a desire to continue to serve should be made .
Councilman Niklas, - The apPearance should. not be given that an
appointment was inherited. 'The pos,ition should be advertised. A
committee member naming a success,or is, not app,ro,priate,.,
Councilman C Onley Advertisements should be done f or those
positions, where the individuals do, r10t wish to, continue to serve .

Mrs . NOtebOGM - Holly Beermann has, requested the Town Board have a
letter of aPpreciation sent to Robert Yavits, for his, service to
the Town as, a member of the Joint Youth C(Dff[MiSSiOn.
Motion made by COUrlCilwoman ValentirlO, seconded by CounciLman
Niklas authorizing and directing the Town Clerk to, send a letter
to M . Robert Yavits, thanking hLm for his, dedicated service as the
'Town of Ithaca RePresentative on the Joint Youth COMMi S S i on.
Carried unaniff[OUSly.
Additional Business :
Councilwoman Valentirl 0 - A discussion was, held with the Chair of
the County Cable COff[MiSsion about the Charter and Bylaw revisions
this, Town Board re(--juested at the Dec&mber 12, meeting. Mr.
Curtis, was not happy with the changes . The other Towns have
pass,ed the Charter and Bylaws as written.
Mr. Curtis was, told the revisions are important, and they should
not hold back the Commissions, Proceedings . The changes will be
part of the agenda at the first meeting January 20 . Mr. Curtis, is
afraid the changes will cause problems, and (--juestions which are
unnecessary s,ince the other Towns, have already adopted the Charter
and Bylaws .
Agenda -It&m No. 15, Executive Session:
Motion made by COUrlCiLman Niklas, seconded by COUrlCilwo�man
Valentino to, move into executive session to discuss personnel
matters, land acquisition, and potential litigation. Carried
unanimously.

Motion made by COUrlCiLman Niklas, seconded by COUrlCilwo�man
Valentino to move back to regular sessiOrl . Carried unanimously.
'The Town Board moved back into regular session at 11 : 30 a.m. No
action was taken as a result of the executive session .

As there was ri 0 further bus,iness, to come before the Town Board,
Councilman Niklas, made a motion t 0 adj ourn Seconded by
Councilwoman Valentino . Carried unanimously.
