of the existing use,and it is generally preferable to expand an existing substation
instead of building a new substation (in addition to the existing substation)

The fence height and use of barbed wire is based on guidance from the National
Electrical Safety Code (NESC),which suggests a minimum height for safety:
outdoor electrical installations enclosed by a fence or wall at least 7 feet high to
prevent unauthorized access by unqualified persons.The NESC suggestes a
combination of a six-foot fence with a one-foot extension of barbed wire at the
top.NYSEG's standard is eight feet tall with one-foot outrigger.Permitting an
increase in height for a substation use would serve as a deterrent for people who
might otherwise attempt to access the site if it were surrounded by a shorter
fence.Moreover,the national electrical code requires fence height to be a
minimum of 7-feet,and the NYSEG's standard is 8-feet.
The lightning mast must be taller compared to other equipment in order to
protect the equipment from lightning strikes.

Reasons:
The Town code allows six foot height,therefore the fence is 33%higher than the
code allows.The lightning mast is 45 feet tall (where 30 feet is allowed),for a
variance of 50%,but has been reduced from the original lightning mast design of
65 feet tall.

The existing use is an electrical substation.The proposed action is an expansion
of the existing use.The area of expansion would experience limited environmental
impacts (vegetation removal).

Yes
Reasons:
While the alleged difficulty may be self-created,an eight-foot fence and barbed
wire outrigger is intended to protect the health,safety and welfare of the
community by discouraging access to equipment and machinery that is
dangerous to those who don't have safety training or knowledge related to
electrical substations.The lightning masts are necessary to protect the
equipment within the substation.

Mary,
After completing the review of your proposed project, I have determined the following items to
be non-compliant per the Town of Ithaca Code:
1. 270-70 – No structure other than a building shall exceed 30 feet in height. The proposed
lightning mast is 65 feet tall.
2. 270-223 – Fences shall not exceed six (6) feet in height. The proposed fence is eight (8)
feet with an additional one foot, three inches of barbed wire, totaling nine feet, three
inches.
3. 270-223(A)(8) – Barbed wire is prohibited within this zoning district. The proposed
design includes barbed wire.
4. 173-11 – Spotlights and floodlights shall be aimed 45° or more below the horizontal. The
proposed lighting is aimed above the horizontal plane.

Letter of Intent – NYSEG West Hill Substation – 522 Elm Street Extension
Existing Conditions & Proposed Development
New York State Electric & Gas Corporation (NYSEG) proposes to expand the existing substation yard
on a 1.03-acre parcel known as 522 Elm Street Extension, Tax Map 29.-6-11. The parcel is an active
electrical substation which contains a substation yard with fence, equipment, small building, and
driveway surrounded by a grass lawn with some vegetation (trees). The proposed construction would
consist of expanding the electrical substation meeting the standards of NYSEG and the required
industry codes such as the National Electrical Safety Code (NESC).
The substation expansion is proposed to the north (12’-6”) and east (18’-8”). The expansion would
include:
• Clearing, grubbing, and grading. Expansion of existing stone yard.
• New perimeter fencing (replacing existing fence and enclosing expansion area) and
expansion of existing animal fence. The new perimeter fencing will be eight feet tall with a
one-foot outrigger and three-inch barbed wire.
• New equipment (capacitor banks, circuit breakers, cap switchers)
• Electrical vaults and handholes, duct banks, conduit trenches.
• Lighting
• Lightning mast (45’)
The lighting will consist of perimeter security lighting that will be on from dusk to dawn. Additional
work lighting will be installed; however, it will only be in use if night work is required. Fixtures are full
cut-off and are not anticipated to spill light beyond the property boundary.
The work lights are angled 45 degrees with reference to the vertical plane. These are only used when
responding to work at night. The perimeter lights are angled 30 degrees to the vertical plane, which
in our interpretation meets the Town’s code 173-11.

Letter of Intent – NYSEG West Hill Substation – 522 Elm Street Extension
The substation will be unmanned and does not require parking (occasional vehicles will be able to
park within the substation yard), sanitary lateral, water service, or trash storage.
Zoning District & Property Owner
The parcel is currently owned by “N Y S Electric & Gas Corp” (per Tompkins County) and is located
within the Medium Density Residential (MDR) district.
Schedule & Phasing
Construction is anticipated to start in Quarter 4 of 2025 and be complete in Quarter 2 of 2027,
although the schedule is subject to change. The construction sequence and phasing are still in
development and will be shared with the Town when available, closer to construction.
Permits & Approvals
The required approvals are unconfirmed until the Town reviews the project in full, however, we
believe the following area variances will be required
• §270-223 Expansion of a non-conforming fence (Eight foot fence with one foot outrigger and
3 inches barbed wire, where six feet is allowed).
• §270-223(A)(8) Barbed wire in a residential district where it is not allowed.
• §270-70 Lighting mast height (45 feet where 30 feet is allowed)
We do not anticipate a referral to Tompkins County under General Municipal Law §239.
There are no State or Federal approvals anticipated. The proposed disturbance area will not trigger
the need for coverage under the New York State Department of Environmental Conservation SPDES
General Permit for Stormwater Discharges from Construction Activity Permit No. GP-0-25-001. We
understand that the Town of Ithaca may require a simple Erosion and Sedimentation Control plan
which is in development and will be provided as a supplement to the initial drawing package
submitted for review.

9. IN AREAS WHERE SOIL DISTURBANCE ACTIVITY HAS TEMPORARILY OR
PERMANENTLY CEASED, THE APPLICATION OF SOIL STABILIZATION MEASURES
MUST BE INITIATED BY THE END OF THE NEXT BUSINESS DAY AND COMPLETED
WITHIN FOURTEEN (14) DAYS FROM THE DATE THE CURRENT SOIL

10. REMOVE EXCESS SPOILS FROM SITE THAT WILL NOT BE USED FOR THE FINAL
DESIGN AND STABILIZATION. STOCKPILED SOILS THAT REMAIN IN PLACE FOR
48 HOURS OR MORE WILL BE CONTAINED WITH SEDIMENT BARRIERS SUCH AS
