Violations Reported Reference Number: 2020 Fire Code of New York State 607.3.3.2 Grease accumulation. If during the inspection it is found that hoods, grease-removal devices, fans, ducts or other appurtenances have an accumulation of grease, such components shall be cleaned in accordance with ANSI/IKECA C10. Comment: Kitchen hood and filters need cleaning again. Reference Number: 2020 Fire Code of New York State 904.12.5.2 Extinguishing system service. Automatic fire-extinguishing systems shall be serviced not less frequently than every six months and after activation of the system. Inspection shall be by qualified individuals, and a certificate of inspection shall be forwarded to the fire code official upon completion. Comment: Hood suppression system is overdue for its 6 month service and inspection Reference Number: 2020 PROPERTY MAINTENANCE CODE OF NEW YORK STATE 305.1 General. The interior of a structure and equipment therein shall be maintained in good repair, structurally sound and in a sanitary condition. Occupants shall keep that part of the structure that they occupy or control in a clean and sanitary condition. Every owner of a structure containing a rooming house, housekeeping units, a hotel, a dormitory, two or more dwelling units or two or more nonresidential occupancies, shall maintain, in a clean and sanitary condition, the shared or public areas of the structure and exterior property. Comment: The kitchen area and the basement area are not being kept in a clean and sanitary condition. A thorough cleaning out of these areas is in order. Foundation walls shall be maintained plumb and free from open cracks and breaks and shall be kept in such condition so as to prevent the entry of rodents and other pests. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance. Comment: There is plastic set up in the basement near the FDC piping to catch and divert water from the electrical panels. There was no dripping today, so this is likely coming in around the piping when it rains, but is obviously a hazard so close to the electrical panels. Also, approved signage is now required for grease traps. And covers to prevent unauthorized access are required. Please check with the Town of Ithaca to get signage approved. Records of all system inspections, tests and maintenance required by the referenced standards shall be maintained on the premises for a minimum of ten years and shall be copied to the code enforcement official upon request. Comment: The Sprinkler system needs to be inspected, tested and maintained to the standards of NFPA 25 Reference Number: 2020 Fire Code of New York State 607.3.3.2 Grease accumulation. Storage of combustible materials shall be separated from heaters or heating devices by distance or shielding so that ignition cannot occur. Comment: Basement storage should be orderly. Please remove any unnecessary combustible storage such as empty boxes and tires. Reference Number: 2020 Fire Code of New York State 5303.5.3 Securing compressed gas containers, cylinders and tanks. Compressed gas containers, cylinders and tanks shall be secured to prevent falling caused by contact, vibration or seismic activity. Securing of compressed gas containers, cylinders and tanks shall be by one of the following methods: 1. Securing containers, cylinders and tanks to a fixed object with one or more restraints. 2. Securing containers, cylinders and tanks on a cart or other mobile device designed for the movement of compressed gas containers, cylinders or tanks. 3. Nesting of compressed gas containers, cylinders and tanks at container filling or servicing facilities or in sellers’ warehouses not open to the public. Nesting shall be allowed provided that the nested containers, cylinders or tanks, if dislodged, do not obstruct the required means of egress. 4. Securing of compressed gas containers, cylinders and tanks to or within a rack, framework, cabinet or similar assembly designed for such use. Exception: Compressed gas containers, cylinders and tanks in the process of examination, filling, transport or servicing. Comment: Secure CO2 cylinders with a chain. Reference Number: 2020 Fire Code of New York State 906.5 Conspicuous location. Portable fire extinguishers shall be located in conspicuous locations where they will have ready access and be immediately available for use. These locations shall be along normal paths of travel, unless the fire code official determines that the hazard posed indicates the need for placement away from normal paths of travel. Comment: ABC extinguisher for main dining area is hidden from view behind server station. Reference Number: 2020 Fire Code of New York State 6101.1 Scope. Storage, handling and transportation of liquefied petroleum gas (LP-gas) and the installation of LP-gas equipment pertinent to systems for such uses shall comply with this chapter and NFPA 58. Properties of LP-gases shall be determined in accordance with Appendix B of NFPA 58. Comment: Propane tanks stored outside need to be requalified. Any damaged or corroded should be removed from use. Identified hazardous electrical conditions in permanent wiring shall be brought to the attention of the responsible building official. Fire protection systems shall be maintained in accordance with the original installation standards for that system. Required systems shall be extended, altered or augmented as necessary to maintain and continue protection where the building is altered, remodeled or added to. Alterations to fire protection systems shall be done in accordance with applicable standards. Comment: Sprinkler system has coverage issues:- Multiple heads are too close to walls, some areas lack coverage. The basement appears to have been divided up after the sprinkler installation without a building permit. The system will have to be modified to provide appropriate coverage. -The distance from sprinkler heads to the ceiling needs to be confirmed to be appropriate (likely should be no more than 12")- The antifreeze used is not UL listed and will not be permitted after September 2022. Comment: Romex wiring attached to deck has damage from foot traffic/mowing. Should have been installed in conduit? Please have this looked at by a licensed electrician. Reference Number: IFC (2015) 901.6 Inspection, testing and maintenance. Fire detection, alarm, and extinguishing systems, mechanical smoke exhaust systems, and smoke and heat vents shall be maintained in an operative condition at all times, and shall be replaced or repaired where defective. Non-required fire protection systems and equipment shall be inspected, tested and maintained or removed. Comment: Your sprinkler system must be maintained/tested per NFPA 25, the standard for water based fire protection systems:When was the last 5 year internal inspection?:When was FDC piping last hydrostatically tested?Antifreeze loop must have UL listed antifreeze in it. It currently does not. We also found several deficiencies which indicate that a closer look at the sprinkler heads is warranted. There were what appeared to be possibly corroded heads. Other heads were obstructed by ductwork and storage. There is no sprinkler head in either of the walk in coolers. One sprinkler head was within 4" of a wall, which is not allowed. Was the wall put in after the sprinkler system? Reference Number: 2020 PROPERTY MAINTENANCE CODE OF NEW YORK STATE [P] 505.4 Water heating facilities. Water heating facilities shall be properly installed, maintained and capable of providing an adequate amount of water to be drawn at every required sink, lavatory, bathtub, shower and laundry facility at a temperature not less than 110°F (43°C). A gas-burning water heater shall not be located in any bathroom, toilet room, bedroom or other occupied room normally kept closed, unless adequate combustion air is provided. An approved combination temperature and pressure-relief valve and relief valve discharge pipe shall be properly installed and maintained on water heaters. Comment: Water heater does not have the correct piping on the relief valve. A long length of garden hose is attached to the hot water heater relief valve and curled up in a pile on the floor adjacent. Reference Number: 2020 Fire Code of New York State 807.3 Acceptance criteria and reports. Where required to exhibit improved fire performance, curtains, draperies, fabric hangings and other similar combustible decorative materials suspended from walls or ceilings shall be tested by an approved agency and meet the flame propagation performance criteria of Test Method 1 or Test Method 2, as appropriate, of NFPA 701 or exhibit a maximum rate of heat release of 100 kW when tested in accordance with NFPA 289, using the 20 kW ignition source. Reports of test results shall be prepared in accordance with the test method used and furnished to the fire code official upon request. Comment: The banner above the kitchen counter must meet the NFPA 701 flame propagation performance criteria or be removed. An approved fire safety and evacuation plan in accordance with Section 404 shall be prepared and maintained for Group A occupancies, other than those occupancies used exclusively for purposes of religious worship with an occupant load less than 2,000, and for buildings containing both a Group A occupancy and an atrium. Group A occupancies shall comply with Sections 403.2.1 through 403.2.5. Comment: A fire safety and evacuation plan is required for Assembly occupancies. Please provide a copy for review. It appears that the sprinkler system will be a combination of a wet system and a dry system. Will the system still have an antifreeze system that will be functional? Will the dry system have a compressor system, or will the “dry heads” be listed and labeled to remain dry while integrated into the wet sprinkler system and not include a compressor system? 2. The sprinkler heads utilized have not been identified, could you please include this detail on the plans that have been submitted? Please provide the make, type, model, and nominal K-factor of sprinklers, including sprinkler identification number and the temperature rating and location of any high-temperature sprinklers. (NFPA 13 [2016] 23.1.3). 3. Rooms and areas need to be identified, per NFPA 13 (2016) section 23.1.3. It is unclear if the walk-in cooler is receiving sprinkler coverage. 4. There are areas that still have 3/4” sprinkler piping installed, that are serving sprinkler heads. Section 23.4.1.2 states that the pipe sizes shall be no less than 1 in. (25 mm) nominal for black or galvanized steel piping and 3⁄4 in. (20 mm) nominal for copper tubing or brass, stainless steel, or nonmetallic piping listed for fire sprinkler service unless permitted by 8.15.20.4 and 8.15.20.5. The existing sprinkler system appears to have been installed in the early 1990’s and in reviewing the NFPA 1980 version, ¾” piping was not allowed (Per 7-1.1.2 of the 1980 edition of NFPA 13). Is the ¾” piping being removed and replaced to correct the deficiency? The inspection done by the Town of Ithaca on March 27,2023 revealed several violations. These violations were described in the report.These violations will be addressed as follows. BASEMENT: The basement was remodeled without permit.Therefore many areas were left unprotected.The sprinkler system was never updated to cover areas unprotected in the remodel.The system Main 2”entry was replaced without permit at some point.The job was done not to code.All exposed 2”Flame resistant PVC must be replaced with Black Iron threaded piping.This includes approx.36 linear feet of piping to include check valve and alarm system detector valves. The piping throughout the system needs to be adjusted to accommodate code.There are 17 pendant sprinkler heads that are out of code in the basement.The heads are to be removed and the piping modified to accommodate upright heads as the existing heads are not 1-12”from the ceiling.There Are 3 heads to be added in areas that have no coverage from the remodel,years ago. 1ST Floor The work to be done on the 1st floor to bring up to code is to add 2 sidewall frost free sprinkler heads in the cooler. There is a head that needs to be added to cover the service closet in the restaurant area.Also in the stairwell to basement is a head that needs to be added as the coverage is lacking in the stairwell. The approach on the job will be in parts.These steps will consist of draining the system every time it's being worked on.At the end of everyday the system must be filled and on line for fire protection.The job will be done as scheduling will be possible for multiple visits.I will connect with the manager for days and times for work to be done.
