Mr. Howe opened the public hearing; there was no one wishing to speak and the hearing was
closed.
b. Amending the definition of “Ordinary High Water Level” in Town of Ithaca
Code, Chapter 270, “Zoning”
Mr. Moseley explained that this was necessary to clarify and match the Town Code with other
laws and regulations.
TB Resolution 2026 - 001: Adoption of Local Law 1 of 2026, “Amending the definition of
Ordinary High Water Level in Town of Ithaca Code, Chapter 270, “Zoning.”
Whereas, a public hearing was duly called, advertised and held on January 12, 2026, regarding the
proposed local law “Amending the definition of Ordinary High Water Level in Town of Ithaca
Code, Chapter 270, “Zoning”, and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval of the local law is a Type II action because it constitutes “routine or continuing agency
administration and management, not including new programs or major reordering of priorities that

may affect the environment,” and therefore this action is not subject to review under SEQRA, now
therefore be it
Resolved that the Town Board adopts Local Law 1 of 2026 “Amending the definition of
Ordinary High Water Level in Town of Ithaca Code, Chapter 270, “Zoning”

Mr. Howe opened the public hearing; there was no one wishing to speak and the hearing was
closed.
Ms. Anderson explained that the State and County have authorized an increase in the income
tables and this local law is necessary to implement them.
TB Resolution 2026 - 002: Adoption of Local Law 2 of 2026, entitled “A Local Law
amending Town of Ithaca Code Chapter 239, Taxation, regarding exemptions for Senior
Citizens and Certain Disabled Persons with Limited Income
Whereas the Ithaca Town Board reviewed the proposed local law entitled “A Local Law
Amending Town of Ithaca Code Chapter 239, Taxation, regarding Exemptions for Senior
Citizens and Certain Disabled Persons with Limited Income” and held a duly scheduled and
publicized public hearing at its meeting on January 12, 2026, at which time all persons wishing
to address the Board on the proposed local law were heard, and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its

approved in the 2026 Town Budget
Mr. Howe noted that these were approved within the 2026 Town Budget.

Resolved that the Ithaca Town Board hereby approves and authorizes the Town Supervisor to
execute annual contracts, which amounts were included as part of the 2026 Town Budget or are

9. Consider approval of the 2026 Highway Expenditures Agreement
TB Resolution 2026 - 007: Approval of 2026 Agreement for Expenditure of Highway
Monies
Resolved that pursuant to the provisions of Section 284 of the Highway Law, the Ithaca Town
Board approves the 2026 Agreement for the Expenditure of Highway Monies detailing
expenditures for the general repairs and permanent improvements of town highways as submitted.

10. Consider authorization for certain expenditures by the Superintendent of Highways
without prior Town Board approval
Mr. Slater explained that this covers expenditures that are within line items that were approved
within the budget or are routine in nature.
TB Resolution 2026 - 008: Authorizing Certain Expenditures by the Superintendent of
Highways without Prior Town Board Approval
Whereas, Section 142, Subdivision- 1(a) of the New York Highway Law authorizes the Town
Board to adopt a resolution permitting the Town Superintendent of Highways to purchase
equipment, tools and implements without prior approval of the Town Board in an amount or
amounts to be fixed by it from time to time; and
Whereas, the Town Board adopted a 2026 Ithaca Town Budget which included monies for the
purchase of vehicles, tools and equipment; and
Whereas, it is determined by this Board to be reasonable and proper and in the best interests of
the efficient functioning of the Public Works Department that the Town Superintendent of
Highways be granted permission to purchase such items without its prior approval in amounts
not to exceed the approved respective budgeted amounts; now therefore be it
Resolved, that the governing Town Board of the Town of Ithaca does hereby authorize the Town
Superintendent of Highways to spend amounts, not to exceed what is identified within the
adopted 2026 Ithaca Town Budget, without the prior approval of this Board, for the purchase
during fiscal year 2026 of vehicles, tools and equipment to be used for highway maintenance,

construction, reconstruction, and/or snow removal; except when the lowest responsive and
responsible bidder is not selected and be it further
Resolved, the authorization hereinabove granted shall be construed as meaning that the total
amount spent on each item purchased by the Town Highway Superintendent during fiscal year
2026 shall not exceed the respective budgeted amount for that item in the adopted 2026 Town of
Ithaca budget.

11. Consider annual approval of certain policies, manuals and plans
Mr. Howe explained that these require annual approval that was specified during their original
adoption and the Protocol Manual was completely revised/updated this year.
TB Resolution 2026 - 009: Annual Approval of Certain Town Policies, Manuals and Plans
Whereas the Town Board reviews certain policies and procedures at its Organizational Meeting
as required by the Town of Ithaca Code or at direction of the Town Board, and
Whereas the following have been submitted to the Town Board for review:
a. Town Protocol and Procedures Manual
b. Ethics Disclosure Form and Distribution List
c. Procurement
d. Cash Management and Investment
e. Debt Management
f. Electronic Banking
g. Fund Balance, Procurement

Resolved, that the Ithaca Town Board hereby accepts, approves, and affirms the above listed
policies, procedures and forms as required for the year 2026.

12. Consider approval of revised policies: Records Management, Access to Public
Records, and Rules of Conduct at Public Meetings and Rules for Public Comments
Ms. Rosa explained that the Records Management and Access policies were updated to reflect
current practices and approved deviations from the adopted LGS1 schedule.
She also explained that the policy regarding conduct at public meetings arose from disturbances

at recent meetings during controversial topics and people waving signs, interrupting speakers,
and not understanding the difference between public hearings and persons to be heard and who is
considered “public” vs “applicants” or similar and when they were permitted to speak and to
whom.
Ms. Bleiwas agreed that general decorum is necessary, but she was uncomfortable with
determining in advance that someone would be charged with disorderly conduct. It is not the
province of the Board to determine; it might not be appropriate. That it is up to law enforcement
and the district attorney. There may be a more serious charge in some cases, or no charges at all.
Not stating specific charges does not preclude charging people and she offered an amendment to
strike the references to charges or the NYS Penal Code, and as it stands, it is not who we are, and
we shouldn’t be anticipating that situation in writing.
The Board agreed that removing the references does not preclude any action and it makes the
policy sound less mean.
TB Resolution 2026 - 010: Approval and adoption of revised Records Management Policy
and Procedures and new Rules of Conduct at Public Meetings and Rules for Public
Comments
Whereas the Records Management Advisory Board reviewed and recommended changes to the
Records Management Policy and Procedures to reflect current processes and exemptions from
the adopted retention schedule, and
Whereas the Personnel and Organizational Committee reviewed and recommended a new policy
for Rules of Conduct at Public Meetings and Rules for Public Comments to better inform the
public of expectations during public meetings, now, therefore be it
Resolved that the Town Board approves and adopts the revised Records Management Policy and
Procedure and the new Rules of Conduct at Public Meetings and Rules for Public Comments as
submitted, effective immediately.

13. Consider authorization to award contract for 2026 Townwide Material Testing and
Monitoring Services
Mr. O’Neal noted that this is a service we have contracted for over the past few years to use,
when necessary, generally during capital projects.

Testing and Monitoring Services
Whereas, the Town has contracted with Atlantic Testing Laboratories, 6431 US Highway 11,

Canton NY 13617 for Professional Geotechnical Engineer for the past 4 years, to perform various
testing and monitoring services for certain townwide capital improvement projects to ensure
contractors are adhering to proper construction techniques as outlined in Town specifications; and
Whereas, the Director of Engineering has reviewed the proposal for fiscal year 2026 and
recommends renewing the contract with Atlantic Testing Laboratories under the terms submitted,
now therefore be it
Resolved, that the Town Board authorizes the award of the contract for the 2026 Town of Ithaca
Townwide Material Testing and Monitoring Services to Atlantic Testing Laboratories; and be it
further
Resolved, that the Town Supervisor is authorized to execute such contract subject to review of the
final contract documents by the Town Engineer and Attorney for the Town.

TB Resolution 2026 - 012g: Establishing Petty Cash Funds for the Year 2026
Whereas, Pursuant to Town Law Section 64(1-a), a Town, by resolution, may establish a petty
cash fund for any Town Officer or Department Head, and
Whereas, it is the desire of the Town of Ithaca to establish such funds for the following
Departments for a total amount of Five Hundred Fifty Dollars ($550):

Resolved, that the Town Board authorizes the establishment of such petty cash funds totaling Five

TB Resolution 2026 – 012h: Authorizing email delivery of proposed local laws
Whereas Town Law requires the Town Board approve the delivery of proposed local laws via
email by resolution and email addresses of Town Board members be posted to the Town’s
website and Town Bulletin Board, now therefore be it
Resolved that the Town Board approves the delivery of draft local laws via email to Town Board

TB Resolution 2026 - 012i: Authorization for Tompkins County Animal Control (TCAC)
and/or Tompkins County SPCA to accept applications for dog licenses
Whereas Town of Ithaca Code Chapter 112, “Animals” requires the Town Board to approve a
municipality’s dog warden or shelter to accept dog licenses by resolution, now, therefore be it
Resolved that the Town Board authorizes TCAC and/or SPCA to accept dog licenses for the
Town at the time of adoption/redemption.

for Town Hall and Public Works Facility
Whereas, the Town’s Municipal Facility Cleaning Services contract expires on February 1, 2026,
and a solicitation for Bids was held, and
Whereas, six bids were received and the lowest, responsive and responsible bid was for
$33,204.00 annually, received from Cleantec, LLC, with corporate offices at 5900 North Burdick
Street, East Syracuse, NY, 13057, and
Whereas, the Director of Publics Works has recommended the contract be awarded to Cleantec,
LLC, now, therefore, be it
Resolved, that the Town Board authorizes the Town Supervisor to sign the Municipal Facilities
Cleaning Services contract with Cleantec, LLC effective February 1, 2026, through December
31, 2027.
15. Reports of Town Officials, Committees, and Review of Correspondence
Mr. Howe reported that Ms. Brock has announced her resignation as of July 1, 2026 and the
Budget Committee will begin exploring options and recommending options to move forward.
Gold Town of Excellence Award – The Town is 1 of 12 to receive the award and Ms.
Gutenberger, Mr. Rosen and Ms. Anderson will attend the ceremony during the Annual Meeting
in NYC.
