BE IT FURTHER RESOLVED that we retain as our attorney in connection with said claim or claims David F. Lee an attorney of Norwich, New York and that we retain said attorney on the basis that in the event of the recovery by said attorney in said,action to be commenced of any sums of money for the benefit of our Town that he is to receive one-third of the amount recovered for our Town for his services, and in the event there is no recovery for the benefit of our Town, he is not to receive anything for his services, &,i-' A. (f11L1Sp- Jus ti ce /if// x Jus tice j�Y, z. ,S/1lJi 7f Justice Clerk A petition signed by a majority of the taxpayers of the district described in the following resolution, said district being wholly outsids of the corporate limits of any incorporated village, was presented to the Board, having been filed with the Town Clerk on the 29th day of December 1926, and more than thirty days prior to this meeting and praying for the establishment of the lighting district described therein and that the Board enter into a contract for the lighting of the streets, avenues, highways, public places and public buildings therein. The following resolution was unani- mously adopted: RESOLVED, that the petition of Frank B. Hoge and others constituting a majority of the taxpayers of the district described in said petition for the establishment of such district as a lighting district be and the same hereby is granted, and RESOLVED, further, that a lighting district under the provisions of sections 2601 2610 262 and 263 of the Town Law of the State of New York be and the same hereby is created and established, said district being described as follows: In that part of said Town of Ithaca, known as Renwick Heights, and extending on the east side of the State Highway, known as Lake Road, passing through the unincorporated village of Renwick Heights in said Town and including the lots or parcels of land abutting thereon from and including the property of 77. C. Ballard shorn as lot 3, thence northwesterly to the junction of said Lake Road and Remington Road and Renwick Place Road, also extending on both sides of the -2— latter and including the lots and parcel abutting thereon throughout the entire length of said Renwick Place Road, also extending on both sides of Renwick Heights Road and including the lots and parcels abutting thereon from the junction of said Renwick Heights Road,;alsa bake Road, northerly to and including the property of E. L. Palmer shown as lot #25, also the property shown as lot #45, also the property shown as lot #44, also extending on both sides of Renwich Drive Roa& and including the lots or parcels abutting thereon from the junction of said Renwick Drive -Road and Renwick Heights Road, southeasterly to and including the property of W. 0. Kerr shown as lot #10 thence continuing on both sides of said Renwick Drive Zoad and including the lots or parcels abutting thereon northeasterly to the eastern boundary line of the unincorporated Village of Renwick Heights or the western boundary line of the Village of Cayuga Heights. TAXPAYERS PETITION TO THE TOWN BOARD OF THE TOUN OF ITHACA, COUNTY OF TOMPKINS, STATE OF NEW YORK The undersigned owners of taxable real property in the Town of Ithaca, County of Tompkins and State of New York, de- siring the formation of a water district in said town outside of any incorporated village or city, pursuant to Article 12 of the Town Law, respectfully petition you to form and establish such water district in the portion of said town hereinafter de- scribed, and in support of said petition allege I. The name of the proposed water district shall be the -"Forest Home Water District." 11. The proposed district is situate entirely within the said Town of Ithaca, in the County of Tompkins and State of New York, outside of any incorporated village or city, and is bounded and described as follows: .COMMENCING at a point in the center of the state high- way now known as Route 392 where it. -intersects the south bou.ndary,of property of B. B. Robb; thence northeasterly along thecenter fine of said 'state highway to a point dire ctly opposite the center of a stone arch bridge over Fall _Creek at the head of Beebe Lake; thence in a straight line through the center line of such bridge to the high water mark dn, the west side of .Fall Creek; thence upstream along the slid high water mark of said creekfollowing the course there- of to a point 2.00 feet north of the center of the stake highway as it crosses said creek on -a bridge now or formerly known as the Bool bridge; thence northeasterly across lands of Cornell University in a straight line to the center of the so-called Sarre n Road �75 feet north from the north side of a concrete culvert, which culvert is approximately l40 feet south, of the center of the G. F. Warren driveway as now located.; 'thence due east through the Warren farm to a point directly north of the easternmost line or point of property of William Mitchell; thence due"south across Fall Creek to the center line of the afore said state highway (Route 392) at the eastern end of said William Kitchell property; thence 'southwesterly along the center line of said highway to the center line of an intersecting road which runs soggtheasterly from the second or upper Forest Home bridge; thence 'southeffeterly along the center line of said road 470 feet; thence westerly in a straight line to the point .of intersection of the south boundary of the Forest Home school lot with the center line of the Judd Falls Road; thence continuing westerly along the south boundary of said school lot to the southwest corner thereof; thence north along the west boundary of said school lot to the northwest corner thereof; thence northwesterly to the place of beginning. III. The assessed valuation of all the taxable real property of the proposed district, as shown upon the latest com- pleted assessment roll of said Town, is the sum of 310,850; and the aggregate assessed valuation of the taxable real property situate in the nroposed district owned by the undersigned, as shown on the latest completed assessment roll of said Town, is the sum of $ 239,150 . IV. The assessed valuation of all the taxable real property of the proposed district owned by resident owners ac- cording to the latest completed assessment roll of said Town is the sum of #281, 450; and the aggregate assessed valuation of the taxable real property situate in the proposed district owned by the undersigned resident owners, as shown on the latest completed assessment roll of said Town is the sum of $232,150. V. The proposed district is at present without a water system and the owners of real property therein are compelled to resort to wells, springs, and cisterns for a water supply; and the lack of an adequate water system deprives the petitioners herein and owners of other real property in the proposed district of a safe and sanitary source of drinkine, water or a sufficient supply of water for protection against .fire and for other pur- poses. VI. It is proposed to obtain a supply of water for said district by connecting either with the water system of the City - 2 - of Ithaca, or with the water system of Cornell. University, and your petitioners are informed and believe that either the said City of Ithaca or said Cornell University is willing for a con- sideration to furnish water for the proposed district in suffic- ient quantities for household and commercial use and for fire protection. VII. This petition is accompanied by a map and plan pre- pared by a competent engineer duly licensed by the State of New York, showing the boundaries of the proposed district and a general plan of the proposed water system, which map and plan also show the possible sources of water supply, the mode of con- structing the proposed water system and the approximate loca- tion thereof, including water mains, distributing pipes and hydrants and booster pump. VIII. The maximum amount proposed to be expended in the construction of said water system shall not exceed $50,000, and it is proposed, out of the said sum, or such part of the same as may be necessary therefor, to construct a water system in the proposed district which shall include the laying of pipes to connect with the water system of the City of Ithaca, or with the water system of Cornell University, the erection of a booster pump, the installation of hydrants and such other materials, equipment and facilities as may be needed; also the acquisition of any necessary real estate. IX. The undersigned agree that all necessary expenses incurred by the Town in the formation of the Forest Home Water District shall be a charge against the said district when and if it becomes established, and if the said water district should not be established the undersigned agree to defray the necessary expenses incurred in connection with this application in propor- tion to their assessed valuation. X. This petition is presented with the understanding that the Town Board will endeavor to obtain maximum financial - 3- assistance for the construction of said water system from any relief funds of the State or Federal Government which may be available for the purpose and unless a substantial proportion of the cost is obtained in this manner, the said water district shall not be established, or if established shall be dissolved, subject to the payment of engineering, legal and other expenses incurred. It is further understood that if the proposed water district be formed and the construction of the proposed water system be approved and completed with the assistance of relief funds, as aforesaid, the same shall be maintained by the water department of the City of Ithaca or of Cornell University upon such terms as can be agreed upon between the said department or University and the Town Board of the Town of Ithaca. Chase: At your last board meeting you requested that the Forest Home water committee submit to the Town Board recommendations for action on the following items with reference to a potable water system for Forest Home. 1. The source of water supply. 2. The source of funds for the purpose of instal- ling the system. 3. The method of financing the districts share of the cost. 4. The rate of retirement of the bonds if any. 5. The rate at which the district would retail the water to the consumer. With reference to these items the committee wishes to make the following recommendations: 1. That the source of eater supply be that of Cornell Universities potable water system., pro- vided satisfactory terms .can be arranged with said University. 2. That relief funds be obtained from the Public Works Administration if possible. See copy of letter attached. -2- 3. That the financing be done by a bond issue as provided under P.W.A. Regulations, such bond issue to be sold to the D.S. or locally, preferably locally if interest rates or other advantages are obtainable. 4. That all bonds be retired at the end of 20 ears. The first bond to be retired at the end of years and the remaining bonds be retired at the rate of 1 each year in equal amounts during the remaining 14 years. During the first 5 years only the interest to be paid. 5. That the initial rate at which the district shall sell water to the consumer shall be one and one half times the published rate of the City of Ithaca, but that this rate shall be lowered as rapidly as is consistent with sound financing of the project. Be sure and tell him where you want yours located. Water services may be installed as soon as your curb box is in. The following bids have been received for installing services: 1. Street Bros. Inc. For digging the trench, furnishing and installing the pipe and fittings up to the meter and backfilling the trench - $1.50 per linear foot. (This is for 3/4" type K copper pipe.) 2. These specifications have been -furnished by an engineer. Service mains shall be of 3/4" copper tubing unless larger size is specified by owner. Service pipe shall be equal in quality to Mueller Company's copper service pipe (Type K) and shall be of best quality and material. Service pipes shall be laid at least 4 feet deep, and shall extend from the curb stop, installed by the Water Main Contractor, through the wall of the house, and shall end with a 3/4" brass compression stop valve. Inspection -- Service pipe shall be laid and filled with water to the valve, and shall not be backfilled until inspected for leaks by a representative of the District. (The City water Department. See steps for installing service.) Each individual property oimer will have to make his own contract for installing these services. The contract may be let to one of the above parties or to anyone else capable of doing the job. The connecting of the house plumbing onto the meter is to be done by the property owner also. The water district has no jurisdiction whatever over the plumbing beyond the meter except to see that pumps are entirely disconnected from the new service. It is strongly recommended, however, that a stop —and —drain valve be placed -next to the meter on the house side. This per- mits the draining of the pipes and easier servicing of the meter. In any case the pipe must be laid four feet deep and must not be covered until it has been inspected and passed upon by the Water Department of the City of Ithaca which Department has been employed by the Town Board to do this work for the district. water will not be turned into any service not so inspected,. The water District has purchased the water meters to be used on our system. They will be delivered to the City water Department which will test and install them upon proper applica— tion to that Department. There will be no direct purchase charge for the meters. The District will own them and charge the customers -a quarterly fee of fifty cents to cover servicing and replacement. The following is an outline of the proper procedure in securing water service: 1. Notify the Chairman of the Water Committee, F. B. Wright, that you wish to install a service. He will provide you with the necessary application forms to fill out. One form is for the connection of your service to the curb box and the other for a meter installation. These forms are necessary for the keeping of accurate records. 2. Have your service pipe installed. 3. Notify the Chairman when you are ready for inspection. (Inspection will be made only when requested through him.) The Water Department will be notified at once and have promised prompt inspection so that ditches will not need to be kept open unduly long. If you want water immediately and have made proper applica— tion for a meter installation, the 'Pater Department will install your meter and make the proper records of the same at the time of inspection. (Provided, of course, that your service passes inspection.) After the installation of a meter the water will be -turned on for you at the curb box as soon as the mains have been sterilized and flushed. If you are not going to use water immediately, yet wish to install the service pipe now, all you need to do is to make application for connecting the service and for inspection when the pipe is laid. The water will be turned off at the curb box until you make applica— tion for and have installed a meter. The City Water Department will have charge of the keys to the curb boxes. 4. If you are renting your property and wish to have your tenants pay the water bill, application should be made through the Chairman on a separate form, otherwise the bills will be mailed to the property owner. If at any time you wish the water service dis— continued, the Water Department should be notified through the Chairman and the proper forms filled out. The Water Department of the City of Ithaca will read your meter every three months. From this reading they will compute your bill and mail it to you together with the ad— dress of the person to whom payment is to be made. Our water district will abide by the same rules and regulations now in force in the City of Ithaca in regard to the meters and payment of bills rendered. These rules and regulations are as follows: Water bills will be discounted ten per cent (10%) for payment on or before the fifteenth of the month in which the charge is made. Failure to receive bills shall be no reason for making an extension of the discount period. Discounts will not be allowed on present month bills where any previous account remains unpaid. A charge of one dollar is made for removing and re -setting meters and turning the water ,off and on. Meters will be tested upon application of the con- sumer and the making of a deposit of one dollar. If the meter shall test not more than three per cent fast on full or half flow, the deposit is to be forfeited to the district. If the meter tests more than three per cent fast a proportionate allowance will be made on all bills not more than six months old, and the deposit returned to the consumer. Whenever the Meter Department shall determine that in their opinion a meter is not registering properly, it shall be removed and calibrated or replaced by a new meter. This shall apply to all meters through which grater is furnished, whether owned by the district or the consumer. Meters must be installed in places easily accessible at all reasonable times for readinCD g and inspection. Whenever bills for water are more than sixty days past due, the meter may be removed and the water turned off. After a meter is attached, any damage which the meter may sustain from freezing or from hot water being forced back through the meter or from any external cause, will be repaired by the Meter Department and the cost of same charged to the owner or agent. If meters need attention the Meter Department must be notified at once. Plumbers are not allowed to remove meters for repairs or any other purpose. All persons are forbidden to break meter seals, disconnect or in any way tamper with meters after they have been installed on the premises. Water probably will not be available from our mains until the master meter has been installed and the mains have been sterilized. As soon as the water is officially on you are entitled to a reduction in your fire insurance rates. This can be taken care of by calling your insurance agent and notifying him that you are now within 500 feet of a hydrant and within three miles of a fire station. In case of a fire, call Telephone No. 2525. Give them your name and the place in the village where the fire exists. 2� The Toirm Board has asked a committee consisting of three residents of the water district to serve as a local "Water Board'. Gibson It shall be the duty of this committee to look after the interests of the water district in such matters as (1) seeing that the mains, hydrants, services and meters are properly installed and serviced; (2) seeing that meters are read and the bills rendered promptly; (3) notifying the Town. Board of needed or desirable changes or repairs on the water system; (4) advising with the Town Boaxd on matters of policy, ex— penditures, rules, regulations, etc. In other words this committee will function as an intermediary agent between the district and the Town Board. Dear Professor Wrig1t : June 8, 1935 I am honored by the invitation of your water committee to be- come your engineer for the construction of the Forest Home hater Dis- tribution system,. I have begun work on this project, having given assistance to Attorney ?Newman in preparing the P.W.A. loan and grant application and the Water Power and Control Commission application. We have started some field work and have assistants engaged in preparing proper plans for the construction drawings. T have visited the office of the In- aurance Underwriters at Syracuse for information as to necessary pres- sures, insurance rates, etc. I bwe consulted with the town, county, and state highway authorities who hav a jurisdiction over the roads and bridges through Forest Home. I feel at this time that it woil d be best both for the hater Committee and myself if proper authorization for my employment is given and a contract of sorts agreed upon between us. In attempting to decide upon a proper fee for my engineering ser- vices, I have consulted friends of mine who are proacticing consulting engineers, and have been referred to a "schedule of fees recommended for professional engineering services on Federal Aid projects", printed on page 316 of the May, 1935, A.S.C.E. magazine, Civil Engineering. For a construction cost of 025,000, the recommended engineering fee is 9V plus the cost of all field surveys and inspector' salary 4nd other extras. Because of several items, including my familiarity with the pro- ject, friendship with the members of the water committee and many Forest Home citizens, the fact that I am regularily employed by the city and have no office overhead to maintain, because you have probably paid con- siderable money as well as expended a great deal of effort on yourown part on studies up to this point, and because of my whole -hearted inter- est in seeing the residents of Forest Home get their long desired Eater supply as economically as possible in every respect, I propose not to hold to these fees, but quote you a fee of 8%, which will cover field surveying and inspection, and eliminate all extras except as distinct- ly specified below. Prof. F. B. Wright, Forest Home, New York. Dear Sirs Enclosed please find a rather detailed report on our system of operating our Meter Department. This report' shows what our records are, and why we feel they should be kept. In submitting a bid for reading and billing the water meters at Forest Home, we will read the service meters quarterly, or four times a year, and the main line meter monthly, or twelve times a year, for $1.00 per meter per year. This will cover labor cost, stationary, billing and necessary postage. We will, also, send you, at the end of each year, a detailed report on water consumed by service meters, and the difference between these and the main line meter; which is leakage and should be kept to a minimum. I f this bid is acceptable, we should have a complete list of property owners and the house address where meters are to be installed, and where to be billed. If bills are to be mailed to tenants, property owner should authorize same. Vie should have this information so we can make out our meter sheets and billing cards. This covers• the reading and billing. A billing form letter_ head would probably be just as good as our rather complicated card, and we could' then enclose it in an envelope and it would be private. This form could be worked out with us. If you wish us to service these meters we should be notified when each service is installed so that before service is covered we could, get the necessary information for our curb box card records-. It would be almost impossible to close off a service in the winter time with snow on the ground without these records. We would also have to test every meter before installing so we could have our meter record cards corresponding with our meter book. Theoret- ically, we should install the meters when ready for instal- lation, for unless an accurate record is kept at the time, you may have meters in some houses without our having a record of same, or again, you might have a service installed Prof. Wright -2- with no meter on it. Again, in this way we get a personal con- tact with each individual service and this helps a lot in ser- vicing the same in years to come. This would cost you just our labor charge and a small amount for file cards. The file cards and record sheets not to exceed $10.00) as we can use our own by changing the headings., and the first cost would be the only cost, as these records will run for years on the same card. The labor cost can not be estimated very accurately as it will depend on how many services can be measured up and filed at one time, and again, how, many meters will be ready for installation at one time, Mould say roughly this would not exeeed $20.00. If you wish us to repair the meters and you. install Trident meters, which are standard with us, the cost will be labor, plus parts used. If some other make is used the -repair cost would run somewhat higher, for we would have to stock the parts to repair them. Unless meters are damaged by frost or hot water your cost of repairing should be practically nothing for the first ten years. We find that the average length of time a meter will give service without needing repairs from wear only is about fourteen years. 0f course, your water may be more corrosive than ours, and then again, with a new system there is a chance of sand or small particles of dirt getting into the mains, which eventually work their way into the meters and damage them. If your new mains and service pipes are properly flushed before installing meters, the chances are you will not have over three or four, and maybe not that many, damaged. In regards to installing new services, we are equipped and have competent men to do this work.- The only set charge connected with this is the tapping of water mains, and is as per enclosed list. Any other part of the work can be done at cost, and as stated before, we carry at all times a stock - sufficient to install complete, any size service you may wish. Tie do not advise any under 3/411.
