HomeMy WebLinkAboutBurns Rd NYSEGUEfR ld.� t'�%ti�.M THIS INDENTURE, made the I day of ✓un<= , in the year One Thousand Nine Hundred and sixty, B E T W E E N THE DELAWARE, LACKAWANNA AND WESTERN RAILROAD COMPANY, a corporation of the Commonwealth of Pennsylvania, having its office and principal place of business at 140 Cedar Street, in the City, County and State of New York, party of the first part, and New York State Electric & Gas Corpora- tion, a corporation of the State of New York, having its principal office at 108 East Green Street, in the City of Ithaca, County of Tompkins and State of New York, party of the second part, WITNESSETH: That the party of the first part in consideration of the sum of ONE DOLLAR ($1.00), lawful money of the United States, and other good and valuable consideration paid by the party of the second part, does hereby remise, release, and quit -claim unto the party of the second part, its successors and assigns forever, ALL that portion of the right-of-way and lands of the former Ithaca Branch of the railroad of the party of the first part in the Town of Ithaca, County of Tompkins, and State of New York, commencing at the northwesterly line of the parcel of land described in a deed made August 24, 1849 between Cyrus Beers, et ux, and The Cayuga and Susquehanna Rail Road Company recorded in the Tompkins County Clerk's Office on April 11, 1850 in Book 55 of Deeds at page 11 and ending at the north- easterly line of Coddington Road, the same being at survey station 13475+27.4 on the original center line . of said branch. EXCEPTING from the aforesaid premises the part thereof heretofore sold and conveyed bythe party of the first part to Town of Ithaca by deed made April 17, 1958 recorded in the Tompkins County Clerk's Office ' on May 9, 1958 in Book 405 of Deeds at page 537 includ- ing all that portion of said right-of-way which lies within 62-1/2 feet of the center line of Burns Road on both sides of said center line of Burns Road in the -2- Town of Ithaca, County of Tompkins and State of New York. All as shown on certain maps filed in the Tompkins County Clerk's office on June 13 , 1960 as Map Tube No. 100.
