SUPPLEMENTAL AGREEMENT
THIS AGREEMENT made as of August 18, 1988 between TIMOTHY
CIASCHI of 124 Woolf Lane, Ithaca, New York, party of the firstpart, and RUSDIK REALTY, INC., having an office at 119 West Green
Street, Ithaca, New York, party of the second part.
WITNESSETH:
WHEREAS, the parties hereto previously entered into an
Agreement dated August 18, 1988 and recorded in the Tompkins
County Clerk's Office on August 23, 1988 in Liber 639 of Deeds at
page 424 relating to the maintenance of a certain common drive
servicing three parcels of land owned by either one party or theother; and
WHEREAS, said Agreement incorrectly identified the owner of
two of the three parcels mentioned therein, it being desirable to
correct said error; and
WHEREAS, TIMOTHY CIASCHI is the owner of Lot 5 and RUSDIK
REALTY, INC. is the owner of Lots 4 and 6 as more particularly
shown on a subdivision plat entitled "Westwood Hills Residential
Subdivision Tim Ciaschi Developer- Final Plat - Phase One -
Town of Ithaca, Tompkins County, New York" made by T.G. MillerAssociates, P.C., a copy of which was filed in the Tompkins
County Clerk's Office on November 24, 1987 and appears in Vault
Box XII at Slot 45; and
WHEREAS, the owners of said three lots enjoy a commondriveway twenty feet in width and ninety feet in length,
ownership of which is vested in the party of the first part;and
WHEREAS, the owners of said three lots are desirous of
providing for the maintenance of the common drive service of said
three lots,
NOW, THEREFORE, it is mutually agreed by the parties hereto
that maintenance of said common driveway shall be shared equally
as between the owners of said lots 4, 5, and 6, the owner of each
said lots being liable to the extent of 33 1/3% of the
continuing cost thereof, it further being the intention of the
parties that this obligation shall run with the land and bind the
Buccessors in interest to the parties hereto.

is the President of RUSDIK REALTY, INC., the Corporation
described in and which executed the above instrument, that he
knows the seal of said Corporation; that the seal affixed to said
Instrument is the Corporate Seal of said RUSDIK REALTY, INC., and
was affixed to the said instrument by order of its Board ofDirectors for the uses and purposes therein expressed; and that
he by like order did subscribe his name thereto as President of
said RUSDIK REALTY, INC.
