THIS INDENTURE, Made the 23d day of January Nineteen Hundred s to and Thirty- three, BETWEEN Catharine Raub Boat, widow, of Cayuga s James Krizek & wife. Heights, Manor Town of Ithaca, Tompkins County, N.Y., party of - - - - - - - - - -- - -E the first part, and James prizek and Mery Krizek, his wife, both of the Town of Ithaca, Tompkins County, N.Y., as tenants by the entirety, parties of the second part, WITNESSETH, that the party of the first part, in consideration of One Dollar ($1.00) lawful money of the United States, and other good and sufficient consideration paid by the parties of the second part, does hereby grant and release unto the parties of the second part, their heirs and assigns forever, ALL THAT TRACT OR PARCEL OF LAND, situate in Cayuga Heights Manor in the Town of Ithaca, Tompkins County and State of New York, being a part of Military Lot #90 in said town, and and described bounded/as follows Beginning at an iron stake in the east line of lands conveyed to Samuel L. and Alice B. Boothroyd by deed dated October 26, 1927 and recorded in Ldbw 214 of Deeds at page 410 at the northwest corner of the parcel conveyed to Frank L. and Florence M. Tyler by deed dated May 11, 1927 and recorded in Liber 214 of Deeds at page 185; running thence east along the north line of said Tyler parcel 400 feet to an iron stake in the west line of Catherine Street; thence north along the west line of Catherine Street 132 feet; thence west parallel with the north line of said Tyler parcel about 400 feet to the east line of said Boothroyd parcel; thence south along the east line of said Boothroyd parcel 132 feet to the point or place of beginning. ALSO ALL THAT OTHER TRACT OR PARCEL OF LAND, situate in said Cayuga Heights Manor, and situate in said Town of Ithaca, and bounded and described as follows: Beginning at an iron stake in the east line of Military Lot #90 at the northeast corner of premises conveyed by said Catharine A. Boat to Frank L. and Florence M. Tyler by deed dated May 11, 1927 and recorded in Liber 214 of Deeds at Page 185; running thence west along the north line of said Tyler parcel 402 feet to the east line of Catherine Street; thence north along theesst line of Catherine Street about 424 feet to the south line of Rost Street; thence east along the south line of Rost Street ( being parallel to and 500 feet south of the south line of Hanshaw Road) 400 feet to the west line of Orchard Street; thence south along the west line of Orchard Street 367 feet 3 inches, more or less, to the end of Orchard Street; thence east about 3 feet to the east line of said Military Lot #90 at the northwest corner of lands now or formerly of Hattie Cornelius; thence south alongthe east line of Lot #90 66 feet 3 inches, more or less,to the point or place of beginning. TOGETHER with all the right, title and interest of the grantor herein in and to the strip of land lying between each of the above described parcels and the center line of the abutting streets (Catherine Street, Roat 6treet and Orchard Street), subject to rights for passage and public utility and ordinary street uses for the benefit of other lands abutting said streets, and together with a similar right of way over said street to existing public highwa�" ' subject to the right of the grantor herein, her heirs or assigns, to conveylaid streets to the Town of Ithaca and/or the County of Tompkins. This conveyance is made and accepted subject to the covenants running with the land as contalnadin an .agreement between the grantor herein and others dated August 1, 1927 and recorded in Liber 221 of Deeds at page 128 which agreement is hereby made a part hereof as if herein set out in full. THIS INDENTURE to Made this 20th day of January, in the year One thousand Associated Real Properties, !no. Nine Hundred and Thirty -Three between George W. Sharpe _x and Lovina S. Sharpe, his wife, of the City of Ithaca, County of Tompkins and State of New Cork, parties of the first part, and ASSOCIATED REAL PROPERTIES, INC., a corporation duly organized under the laws of the State of Delaware, having its principal office in New York, at 61 Broadway, Borough of Manhattan, City and County of New York, party of the second part, WHEREAS, by indenture dated June 25th 1929 and recorded June 25th, 1929 in the Tompkins County Clerk's Office in Liber 218 of Deeds at Page 261, George W. Sharpe and Lovina S. Sharpe his wife, conveyed to Associated Real Properties, Inc. therein described as a New York Corpor- ation, a certain tract or parcel of land therein, and likewise hereinafter described, and; WHEREAS said grantee, Associated Real eroperties, Inc., was erroneously described as a corporation duly organized under the laws of the State of New York, when it was intended to des- cribe it as a corporation duly organized under the laws of the State of Delaware, and; WHF.SBAS,this indenture is executed for the purpose of correcting the erroneous lescription in the said previous indenture. WITNESSETH, THAT the said parties of the first part, for and in consideration of One Dollar and other good and valueable consideration ($1.0O)lawful money of the United States, paid by the said party of the second part do hereby remise, release and forever Quit -Claim unto the said party of the second part, its successors and assigns forever. ALL TROSE TRACTS OR PARCELS OF LAND shown oncertain maps of Ithaca as "Streets" ( it is believadthat these areas have never been opened or maintained as streets and reference thereto as "Streets" is for the purpose of description only) as follows: Fourth Street from the North , side of Adams Street to property of the Lehigh Valley Railroad Company; adams Street from the West side of Third Street to the Past Side of fourth Street; together with the right of ingress and egress over such further portion of r'ourth 6treet in which the parties of the first part, or their predecessors in title, have or had right, title or interest, as may be necessary for , the purpose of ingress and egress to all the property described in this deed, and to that Part of Block 31 conveyed to the party of the second part by parties of the first part by deed of even date herewith. * Being a portion of the same premises conveyed to George W. Sharpe by Withburn Corporation by j deed dated June 13, 1929... TOGETEER with the appurtenances; and all the estate and rights of the said parties of the first part in and to said premises.
