!I AMENDMENT & MODIFICATION OF ILFSTRICTIONS
lThe subject matter of this agreement is the modification
:,of certain restrictions with respect to the parcel of land now
1owned by MERLE E. PATTERSON and ELSIF E. PATTERSON, situate on •
;the westerly side of Blackstone Avenue and known as 201 Blackstone
J!
I,Avonue, and w!,ich premises were conveyed to !"erle E. and Elsie E.
Patterson by James 0. Krizek/and Anna F. Krizek, husband and wife,
by deed dated October 1 , 1952, and recorded in the Tompkins
:!County Clerk's Office in Liber 353 of Deeds at page 73.
Said parcel is part of the Catherine Roat Subdivision
;and is subject to the covenants running with the land established
�,,by agreement between Catherine A. Roat•and Frank L. Tyler, et al,
dated August 1, 1927 and recorded in Liber 221 of Deeds at page
',128. One of the said covenants which, for the purposes of this ,
(,present agreement is referred to as Covenant No. 1, provides as
!ifollows: 111. No lot shall be occupied, leased or sold, and no
i�suhdivision shall be made of any lot smaller than 100 feet of
!frontage on a road or street, and 150 feet in depth running back
(from such road or street, except that a corner lot on two streets
!';shall have at least 100 feet frontage on each street and shall be
at least 100 feet deep."
The undersigned are all owners of premises within the
�1Catherine A. Roat Tract, lying within 400 feet of the above two
lots.
In consideration of the mutual covenants herein contained

1, The said Patterson lot may be subdivided into

two lots substantially as shown on the survey made by Carl Crandal';,

iiC.E „ dated November 26, 1965, entitled "Proposed Division of

Merle E. Patterson Lot at No. 201 Blackstone Ave., Ithaca, N.Y.".
The lot on which the dwelling now owned and occupied by Merle-E.

and Elsie E. Patterson is known as 201 Glackstone Avenue and shall
be referred to herein, whenever necessary, as the FRONT LOT. The
remaining lot, which will have a frontage of 15 feet on Blackstone
•
Avenue, will be referred to, whenever necessary in this agreement,)
as the REAR LOT.
2. Both FRONT and REAR LOTS shall be used for resider-
'tial purposes only.
3. With respect to the REAR LOT, the following
provisions shall apply:
(al No structure other than a single family
dwelling, as that term is generally understood, shall be erected

P on said premises, nor shall such dwelling he occupied by more than
i one family. A family is here defined as beinq an individual or
persons related by blood, marriage, adoption and domestic help,

or not more than three unrelated individuals.

! (b) No other buildings except an appurtenant
garage, carport, garden house or small dog house shall be erected.
�i (c) No building shall he permitted or erected on
any portion of the premises which is within 40 feet of the north
line of said REAR LOT or within 40 feet of the west line of said

REAR LOT, or within '/l. feet of the line which is the cast line of
i' said REAR LOT and the west line of said FRONT LOT.
