RIGHT OF WAY AGREEMENT
THIS Agreement made the 3 RA day of Tom- , 2012, between
Orlando lacovelli and Helen lacovelli of 347 Coddington Road, Ithaca, New York
14850, hereinafter referred to as "lacovelli", and
Frank J. Raponi, Sr. and Alice Jean Raponi of 34VCoddington Road, Ithaca, New
York 14850, Lindsey R. Raponi and Ashley E. Raponi, hereinafter referred to as
"Raponi"
WHEREAS, lacovelli owns the premises known as 3y6 Coddington Road,
Ithaca, New York by deed recorded in the Tompkins County Clerk's Office as
Instrument No 577106-001, known as Town of Ithaca Tax Map #42 -1-9 142, and
WHEREAS, the premises adjoining to the south and east are owned by Raponi
and are known as 34YCoddington Road, Ithaca, New York by two deeds recorded in
the Tompkins County Clerk's Office (1) a portion of Liber 666 of Deeds at page 167,
and (2) Liber 873 of Deeds at page 252, known as Town of Ithaca Tax Map #42 -1-
9 141, and
WHEREAS, the lacovelli wishes to install sewer utility service and natural gas
service to their property from existing lines on Coddington Road, and
WHEREAS, Raponi has agreed to permit lacovelli to run said sewer and gas
lines over their property from Coddington Road,
NOW, THEREFORE, in consideration of the recitations above and the mutual
promises hereinafter made, it is hereby mutually agreed between the parties as follows
1 That a right of way is granted over and across an area fifteen (15) feet in
width from the easterly boundary of said Raponi premises in a westerly direction to the
easterly line of said lacovelli premises, the southerly line of which is the southerly
boundary line of said Raponi premises
2 lacovelli shall have the right to install and maintain a sewer line and a natural
gas line in this fifteen (15) foot right of way running from Coddington Road for the
benefit of their property as referenced above
3 That lacovelli shall have the right to install, maintain, repair or replace the
buried sewer and gas lines running through the lands of Raponi provided that said
sewer and gas lines must stay within the right of way granted herein
4 That lacovelli will be permitted to enter upon the premises of Raponi to the
extent that it will be necessary to maintain and make repairs to said sewer and gas

lines That lacovelli shall return the land to its "pre -construction" or Its "pre -repair" state
Insofar as possible within five (5) days of the construction or repairs, Including fencing
and shrubbery, if any
5 The terms, rights and obligations of this Agreement shall run with the land
