A PORTION OF BURTT ROAD IN THE TOWN OF ITHACA
WHEREAS, it appears to the undersigned Harry Baker, Town Superinten
of the 'Town of Ithaca, and to the Town Board of said town that a portion of the
town highway known as Burtt Road in the Town of Ithaca, extending from Floral
now
'Avenue Extension (F J2 known as the Five -Mile Drive) southeasterly for a
!I distance of approximately 715 feet to the Lehigh Valley Railroad right of
way, has not become wholly disused, but that it has not for the last two years
;been usually traveled along the greater part thereof by more than two vehicles
:idaily, in addition to pedestrians and persons on horseback; and whereas, it
appears to the undersigned County Superintendent of Highways that a qualified
I! abandonment of such highway is proper and will not cause injustice or hardship
to the owner or occupant of any land adjoining such highway; and whereas the
undersigned held a public hearing at his office in the Court House on the 28th
�Il day of November, 1952 at ten o'clock A.M. on the question of whether there
shall be a qualified abandonment of the described portion of said highway,
'. pursuant to Section 205 of the Highway Law; and whereas at least twenty days
li wriiten notice of such hearing was duly given to
John S. Sergi and Catherine J. Sergi
the owners and occupants of such lands adjoining such highway, copy of which
notice is hereto annexed.
NOW THEREFORE, I, John E. Miller, County Superintendent of Highways
of the County of Tompkins, New York, do hereby decide and certify that the
" above described portion of said highway has not for two years next preceding
hereto been usually traveled along the greater part thereof by more than two
vehicles daily in addition to pedestrians and persons on horseback, and that
a qualified abandonment of such highway is proper and will not cause injustice
or hardship to the owner or occupant of any lands adjoining the same; and I
do further certify that the following is a description of the said town highway:
A portion of Butt Road in the Town of Ithaca, extending
from Floral Avenue &tension (.now known as the Five
Mile Drive) southeasterly for a distance of approximately
715 feet to the Lehigh Valley Railroad right of way.
lTHEREFORE, the town highway above described is henceforth
qualifiedly abandoned in accordance with the provisions of Section 205 of the
Highway Law.
