THIS INDENTURE, made this day of May, Two Thousand Nine.
BETWEEN
Edward A. Mazza of 307 North Tioga Street, Ithaca, New York 14850 as
the Executor of the Last Will and Testament of Clarence C. Larkin a/k/a
Clarence Cuervo Larkin, late of the Town of Ithaca, Tompkins County,
New York, who died testate on January 28, 2008,
Party of the First Part, and
Jennifer L. Pope and Craig S. Mains, of 507 West Buffalo Street, Ithaca,
New York 14850, as joint tenants with right of survivorship,
Parties of the Second Part, and
WITNESSETH, that the party of the first part, by virtue of the power and authority to him
given in and by the Last Will and Testament of the above named decedent dated January 11,
2008 and in consideration of the sum of One Hundred Nineteen Thousand and 00/100
DOLLARS ($119,000.00) lawful money of the United States, paid by the parties of the second
part, does hereby grant, convey and release unto the parties of the second part, their heirs,
distributees and assigns forever,
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of
Tompkins and State of New York, being a part of Military Lot No. 65 in said Town, being more
particularly bounded and described as follows:
BEGINNING at a point in the center line of Elm Street Extension, said point being 238.1
feet westerly of the intersection of said Elm Street Extension with the center line of Coy Glen
Road;
THENCE running south 5042'30" west a distance of 300.6 feet to a point marked by an iron
pin;
THENCE running north 84°52'15" west a distance of 256.98 feet to a point marked by an iron
pin;
THENCE running north 51100' east a distance of 300 feet to a point in the center line of Elm
Street Extension;
THENCE running south 85000' east, along the center line of Elm Street Extension, a distance
of 260.7 feet to a point, being the point and place of beginning.

THIS conveyance is made subject to the rights to the use of the water from certain wells
on the conveyed premises reserved in the deed to Catherine A. Richardson and husband from
Edith M. Church dated May 28, 1935 and recorded in the Tompkins County Clerk's Office in
Liber 237 of Deeds at page 131 for the benefit of lands then owned by Church and now or
formerly owned by Ralph W. Tait and wife, as more particularly set forth in said deed and as
clarified by Agreement of James A. Salk, Gail Shapiro Salk, Harold Thomas Hickerson and
Anne R. Kenney dated May 18, 1994 and recorded in said Clerk's Office on that date in Liber
724 of Deeds at page 44.
SUBJECT to the following:
1, The rights of the public in, over and across that portion of the above
described premises lying within the bounds of the public highway.
2. An easement granted to New York State Electric & Gas Corporation by
instrument dated July 20, 1951 and recorded in the Tompkins County Clerk's Office on August
16, 1951 in Liber 343 of Deeds at page 462, insofar as it may affect the above described
premises.
3. An easement granted to New York State Electric & Gas Corporation by
instrument dated December 22, 1953 and recorded in the Tompkins County Clerk's Office on
February 6, 1954 in Liber 365 of Deeds at page 299, insofar as it may affect the above
described premises.
THE above described premises are shown on a survey map entitled "SURVEY MAP
SHOWING HOUSE LOCATION AT 615 ELM STREET (EXTENSION) TOWN OF ITHACA,
TOMPKINS COUNTY" prepared by Howard R. Schlieder, N.Y.S.P.E. & L.S., No. 043780,
dated April 5, 1994 and resurveyed May 18, 2009, a copy of which is attached hereto and
recorded in the Tompkins County Clerk's Office concurrently herewith.
BEING the same premises conveyed to Clarence Larkin (a/k/a Clarence C. Larkin) by
deed of Harold Thomas Nickerson and Anne R. Kenney dated May 18, 1994 and recorded in
the Tompkins County Clerk's Office on that date in Liber 724 of Deeds at page 48. The said
Clarence C. Larkin died testate on January 28, 2008, a resident of Tompkins County. His Last
Will and Testament was admitted to probate on April 7, 2008, and Letters Testamentary were
granted to Edward A. Mazza on that date, which Letters remain in full force and effect and
have not been modified or revoked.
TOGETHER WITH the appurtenances and all the estate which the Decedent had
at the time of his decease in said premises, and also the estate therein, which the party of
the first part has or has power to convey or dispose of, whether individually, or by virtue of
said Will or otherwise.
To have and to hold the premises herein granted unto the parties of the second part,
their heirs, distributees and assigns forever.

And said party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
And, that the party of the first part shall receive the consideration subject to Section 13
of the Lien Law of the State of New York.
