Purpose Toestablishguidelinesandminimumrequirementsfortheuseof videoconferencingtechnology toparticipateinthemeetingsheldbyTownpublicbodies,asdefinedinPublicOfficersLaw §102, andinconjunctionwithTownofIthacaLocalLaw 11 of2022. B. Background NewYorkStatesuspendedcertainrequirementsoftheOpenMeetingsLawtopermit publicbodies tomeetandconducttownbusinessvia videoconferencingplatformsandtoprohibitin-person attendanceduringthe2020-2022COVIDPandemic/StateofEmergency. InAprilof2022,Gov.HochulsignedChapter56oftheLawsof2022,which addedPublicOfficers Law§103-a allowing atown’s publicbodiestohave the optionofcontinuingtouse videoconferencingundercertaincircumstancesandconditions,if,amongotherthings,thetown boardadopts a locallawauthorizingtheuseofvideoconferencinganda written policy establishing said circumstancesand conditions.OnMay9,2022,theIthacaTownBoardadoptedsuchalocal law(LocalLaw 11 of2022).In Mayof2023,Gov.HochulsignedChapter58oftheLawsof2023 whichfurtheramendedPublicOfficersLaw§103-a topermitmemberswithadisability that rendersthemunabletoparticipatein-personatanymeetinglocationwherethepubliccanattend tocounttowardaquorum. C. Definitions 1. PublicBody –Allboards,committees,andsubcommitteesoftheTownthatmeetthe definitionof“publicbody”inPublicOfficersLaw§102. 2. Meeting –The officialconveningofapublicbodyforthepurposeofconductingpublic business,includingtheuseofvideoconferencingforattendanceandparticipationby themembersofthepublicbody. 3. Quorum –onehalfofthefullmembershipofthepublicbody,regardlessofvacancies ordisqualificationstoact,plusone.Example:a board withsevenmembers hasa quorumof four. 4. ExtraordinaryCircumstances –eventsorfactorsthatwouldprecludeamember’s physicalattendanceatthemeeting,e.g.:disability,illnessorsignificanthealthconcerns requiringprecautionaryactions,caregivingresponsibilities, and other significantor unexpectedfactors or events. Adopted2022-05-09-Revised2023-08-28Pg2 5.Disability–AsdefinedinNYSExecutiveLaw§292andasusedinthecontextofthis policy, summarized as: An impairment which prevents in-person attendanceafter reasonableaccommodationshavebeenexplored. D.Policy 1.Members of all public bodiesare permitted to attend and participateusing videoconferencingunderextraordinarycircumstanceswiththefollowingrequirements: a.Aquorumofthepublicbodymustbepresent,inperson,inoneormoreadvertised location(s)wherethepublicmayattend.Exceptformemberswithadisabilityas definedinthispolicy,amemberwhoisparticipatingfromaremotelocationthatis notopentoin-personphysicalattendancebythepublicmaynotbecountedtoward aquorum,but mayparticipateandvoteifthereisaquorumofmembersatthe physicallocation(s)opentothepublic,and b.Thephysicallocationofanylocationwheremembersareattendingvirtuallyand thepublicmayattendshallbepostedontheTownBulletinBoard,MeetingAgenda postedtotheTownwebsiteanddistributedtothemedia,and c.Public notice for any meeting conducted shall includethe physical location(s) where the public canattend and/orparticipate in person,the fact that videoconferencingwillbeused,wherethepubliccanviewand/orparticipateinthe virtualmeeting,andwhereanyrequireddocumentsormaterialsassociatedwiththe meetingarepostedoravailable,and d.Anymemberattendingvirtuallymustusevideocapabilitiespermittingthepublic tosee,hearandidentifythemthroughouttheentireportionsofthemeetingthatthe OpenMeetingsLawrequirestobeheldinopensession,withlimitedallowancefor customarytemporaryabsencesfromameetingforpersonalinterruptionssuchas coughing,sneezing,stretching,orabiobreak. e.Thepublicmust be ableto view via videoall meetings which include virtual memberattendanceand,wherepubliccommentorparticipationisauthorized,the publicmustbeallowedtoparticipatebyvideoconferenceinrealtimeinamanner thataffordsthesamepublicparticipationortestimonyasin-personparticipationor testimony,and f.Theminutesofallmeetingsthatincludevirtualmemberattendancemustindicate whoparticipatedvirtually,andsuchminutesmustbepostedtotheTown’swebsite withintwoweeksofthemeeting(oneweekforexecutivesessionminutesrecording anactiontakenbyformalvote)andbetranscribeduponrequest,and g.Eachmeetingwherevirtualattendanceoccursshallberecordedandsuchrecording must be postedorlinked onthe Town’s website within5businessdays of the Adopted2022-05-09-Revised2023-08-28Pg3 meetingandsuchrecordingmustremainpostedorlinkedfornolessthan5years, and h.Virtualattendanceshouldbeusedsparinglywiththeexpectationthatmemberswill bephysicallypresentatmeetings.Membersrequestingvirtualattendancemust notifytheChairor theappropriate Department Headfortheirdeterminationon whethertheabsencequalifiesunder“extraordinarycircumstances”,and i.Allpublicbodyopenmeetingsthatthatarebroadcastorusevideoconferencing shallbeaccessibletomembersofthepublicwithdisabilities,asprovidedinPublic OfficersLaw§103-a,and j.ThisVideoconferencing Public Body Meeting Participation Policymust be conspicuouslypostedtotheTown’swebsite. E.StateofEmergency As provided for in the New York Statelegislationdescribed in Section B, if alocal state of emergencyisdeclaredoraNYSdisasteremergencydeclarationismade,allpublicbodiesmay meetcompletelyvirtuallywithouttheneedforaquoruminoneormorelocation(s)atwhichthe publicmayattend,iftheTownBoarddeterminesthatthecircumstancesnecessitatingthestateof emergencyordisasteremergencydeclarationwouldaffectorimpairtheabilityof theTown’s publicbodiestoholdanin-personmeeting.IftheTownBoardmakessuchadetermination,all requirementsofthisPolicy,exceptthein-personmemberparticipationrequirement,mustcontinue tobemetwhilethestateofemergencyordisasteremergencydeclarationremainsineffect. F.EffectiveandTerminationDates ThisPolicyshalltakeeffectonAugust29,2023andshallautomaticallyterminateifthe2022New YorkStatelegislationdescribedinSection2expires.
