Your letter of July 18 came just in time. Cn the 24th we had a
special meeting where the Trustees discussed many aspects of our
sidewalk program and worked out at least part of a policy for deal
ing with the sidewalks especially in what we call the old Village.
We talked also of new sidewalks and as we did that, Pleasant Grove
Road, Hanshaw Road, part of Triphammer Road and Cayuga Heights Road
came up for discussion. In regards to the replacement and resurfac
ing of existing sidewalks, we carried our action along to the point
vAiere we instructed the Engineer to draw up specifications for bids
and to put the work out to bid. In the sidewalks still to be built
we asked him to consider general questicxis of engineering policy
associated with installing new sidewalks. I read your letter to the
Board. They were much interested in it and they asked Engineer Rogers
to meet with Mrs. Raffensperger for some preliminary discussions. The
Village Board has had in mind building a standard sidewalk on Pleasant
Grove Road. In a preliminary way they even mentioned the fact that
perhaps as the road reaches the Village line to the south, it might be
necessary to move the road scxnewhat to the east. But the Trustees and
the Engineer are, I am sure, open to any suggestions that you might
wish to make in behalf of the Town and we will gladly try to keep our
thinking and acting in harmony with yours.

I presented to the Board last night the two letters you h^ sent
me - one concerning Forest Home Drive and the other the Lansing
aryi other demands in increased sewer service. The Board wished
to take no action regarding the Forest Home Drive.
In regards to the request of the Town of Lansing for permission
from the Village of Cayuga Heights to connect a new Town sewer
district to the Village system, the Board wished me to say that
the proposed new district is well within the originally-approved
service area. This, if you wish it, you may confirm by talking
to the Village Engineer or consulting maps in the Village office.
You may rest assured that we monitor with the greatest care, the
demands made upon us for increased sewer service. As you may
know, we have had before us from the beginning, estimates regard
ing the number of sewer units that might be called for in the
various areas served by the Village sewer system. These estim
ates looked towards a maximum iise about the year 1990. We see
now that in some areas the allotted units may be used up by 1990.
We will take all possible steps to insure that the matter re
mains under control.
I am grateful to you for raising this question with us and will
be glad to keep you informed about any significant changes that
may arise.

Dear Noel:
The Village wishes to keep the Town informed of the
Village's plans for the proposed Pleasant Grove Road
bike/walk path.
In its 1985-86 budget, the Village has allocated money
for the construction of this bike/walk path. The Village
intends to finance the entire cost with the understanding
that, starting in 1985, $12,000 a year for 4 years (a
total of $48,000) will be transferred from the Town to
the Village to repay the Village for the major part of
the bike/walk path cost.
At this time the plans are not complete. They are ex
pected this spring with construction scheduled for this
summer. Susan Beeners will be informed as soon as plans
are available.
The Village thanks the Town for the commitment of funds
to this project and the planning help of Ms. Beeners.

As you perhaps are aware, it is very likely that the Town of Ithaca
will be establishing its cwn fire service for the area of the Town
not served hy the Village of Cayuga Heights. We ejq^ect the Town
systan to be operational by January 1, 1988.
The Renwick Heights, East Shore Drive area of the Town wculd best
be served by the Cayuga Heights Fire Department rather than have
the Town serve it fron South Hill or West Hill or sate other
alternative. We would appreciate your consideration of the
feasibility of extending the area of the Town covered by our
contract to include Renwick Heights and East Shore Drive starting,
if possible, on January 1, 1987.
These discussions are perhaps timely since our contract needs to be
updated anyway. As always, I would be pleased to meet with the
Village to discuss these matters.

Our Fire Chief and the Village Trustees discussed your
suggestion that our Village Fire Department provide fire
service to an area within the Town of Ithaca in the general
neighborhood of Renwick Heights. Our Fire Chief reported
that he had made trial runs with our heavy equipment to see
what would be involved in serving the Boynton Junior High
School. He found that even with the lights working in his
favor and with conditions that were, from the point of view
of road surface ideal, that it would take him approximately
ten minutes to reach the scene of a fire. In time of any
difficulty from ice or snow, fifteen minutes he thought
would be necessary. In these circumstances the Village
Board wished me to report to you that the Village and the
Village Fire Department do not wish to assume the new respon
sibilities that you offered to us.

I understand that the Village of Cayuga Heights will soon be
billing the Town for the first installment on the Pleasant Grove
walkway. The Town has budgeted the funds for our share of the
iitprovement. However, before making the first payment an agreement
is needed concerning the use and maintenance of the walkway.
Perhaps you would have Mr. Sovocool work with Tcwn Attorney John
Barney to prepare such an agreement. Fran the Town's perspective,
the agreement should include:
(1) A statement indicating that the Village will maintain the
portion of the walkway in the Village. I presume Cornell will be
maintaining the portion on their property. Maintenance would
include repairs and snow removal.
(2) A statarent indicating that the walkway will be available
for use by pedestrians and bicycles.
(3) A statanent holding the Town harmless fron liability
claims resulting fron accident or injury stemming fron the use of
the walkway.
We will need an accounting of the total cost of the project
including recognition of force account services provided by the
Town.

Dear Noel:
At our evening meeting on December 15, I read
to the Board your letter regarding the Pleasant Grove
sidewalk. The Board instructed me to tell you that
the Board considers the sidewalk to be Village prop
erty. That the sidewalk will be accessible to
cyclists as well as pedestrians and that questions
concerning liability and maintenance will be
settled by the Village.
The sidewalk to be built by Cornell University
will be within the Town and the Town Board will no
doubt enter into an agreement with the University
regarding questions of maintenance and liability as
they relate to that piece of sidewalk.

raised questions regarding the amount of the tax put upon
Villagers by the Town Board and asked us to explain how this
tax was justified by the contribution of the Town to the
affairs of the Village, An issue of this kind has arisen from
time to time and we have done what we could to explain it.
At the present moment, we think it will be well if you could
arrange to come to our meeting on February 15 to say what is ac
complished for the Villagers from the taxes which Villagers make
to the Town.

Thank you for your e3q)lanaticn in our recent telephone conversatirai about the
Village Board's recent (December) ruling regarding Towi of Ithaca sewer link-up
moratorium. I would like to appeal to the Village Board to apply this ruling
to future development projects rather than to include those idiich were already
underway prior to the establishment of the moratorium.
I believe this new ruling presents a particular hardship for Mr. Carle Brown
wio is con^letlng development of a small tract of land connecting Lexington East
with Lexington West in Williamsburg Park, He purchased this land at a "developed"
price with utility lines assured. There is no option to link-up to Cayuga Heights
sewer district for this land, as you probably realise. He has been assigned only
three sewer permits which are insufficient for the remaining lots. The home my
husband and I hoped to have Mr, Brown build for us on one of the remaining lots
was to have had a one-bedroom apartment in the lower level. The total number of
persons occupying this home would be my husband, myself, and one to two tenants
in the apartment. There would be only one sewer line for the house and probably
no more water usage (and sewer usage) than is true for us in our present home.
Mr. Brown now hesitates to coisider our building project as he believes it will
require two of the three permits available at the moment and, thereby, prevent .
him from development of an additional lot, at least until more permits are avail
able to him. This makes further coisideration of our project an economic liability
for him as these lots represent both his livlihood and that of the crew of men a^o
work for him.
I would appreciate receiving the assurance from the Village Board that otir project
would not be required to have an additional sewer permit so that it can conpete
favorably with any other project Mr, Brown might consider for any of his remaining
lots in this development.
If you could please act cn lay request as quickly as possible, I will be most grate
ful. Delays at this time of year could result in the Jeopardising of the April/
May start toward \diich we have looked for over a year now. We have an architect
waiting to begin the final drawings now, so time is, indeed, of the essence for
us. Please notify us as quickly as possible of the Board's decisicD.

As indicated by our consulting engineers, the Village of Cayuga Heights
Wastewater Treatment Plant is at capacity. However, tests completed this morning
on the Borg-Warner Plant effluent indicate the pretreatment system of the
Borg-Warner Plant is on line and effective. This relieves the treatment load
on the Village of Cayuga Heights Wastewater Treatment Plant to the extent that
75 sewer unit connection permits can be issued to properties In the surrounding
contracting municipalities as follows:
Town of Dryden
Town of Ithaca
Town of Lansing
Village of Lansing
5 unit permits
15 unit permits
15 unit permits
40 unit permits
Each municipality will have complete responsibility and authority for the
allocation of the sewer unit connection permits within its boundaries and shall
hold the Village of Cayuga Heights harmless on any liability or lawsuits arising
from said allocations.
Expansion of total annual flow from connected properties that have their
units determined by water usage, cannot be determined until the end of the
fiscal year.
Any minimum increase for this type of sewer flow will not reduce the
units allocated at this time but it will be the duty of the Contracting
Municipalities to keep this type of flow to a minimum, as it adds to the
critical total flow at the Village of Cayuga Heights plant and will be
reviewed before any future issuance of sewer unit connection permits.
Procedures are to be followed in allocating and issuing permits so the
Village of Cayuga Heights and each contracting municipality can keep exact
count of issued permits.

Since we spoke on the phone a few weeks agQ:regarding the recent sewer
link-up moratorium inposed by Cayuga Heights Village on the Tom of Ithaca
(and Town of Lansing?), my building project, a home in Williamsburg Park,
has had further problems related to the shortage of sewer oermits for new
homes on Lexington Circle, northern leg. The contractijr-builder who owns
the land, Mr, Carle Brown, has sold the lot we were hoping to buy to a pur
chaser who wishes to construct a one-family residence. This siii?)lified his
problems a bit, but, of course, he still owns and hopes to develop the four
remaining lots on the north side of this street. As I understand the situ
ation, Hr, Brown does not have even sufficient sewer permits remaining to
complete development of these lots at the present time.
I have written to Mr, Rogers, who is currently out of town until raid-March.
I discussed this sewer permit shortage with Anne Krahto, one of the staff in the
Village office, but I received no encouragement to hope for help by way of any
special consideration (waiver of requirement for an additional sewer permit oif
repeal of retroactive application of the moratorium for projects underway prior
to December. letter to Mr. Rogers has been referred to Mr, Anderson who is
filling in during the absence of Mr. Rogers, but as yet I have not heard any
further word from him.
Vfe are waiting to receive some reassuring word from either the Village
or Town that the necessary sewer permits will be available to us before we
begin the costly process of obtaining the final architectural drawings. This
delay may slow the project enough to throw our spring/summer/fall move and
resale of our present home into the winter/spring/sumraer cycle with a new
financial market. It may be a genuinely costly delay for us. Additionally,
unless sewer permits are available to Mr, Brown in the quantity he needs to
conplete developn^nt of his lots, in addition to the permits necessary for
our project, he may be reluctant to even consider building a home for us on any
of his lots on Lexington. Since we hope to have a walk-out basement, we require
a lot with sufficient slope. There are few such lots available, Mr. Brown *s lots
are among the few we know about and are the oniy ones close in proximity to ny
husbandfe work place. It will be very disappointing to me, especially, if Mr, Brown
refuses to build the home we have proposed sin^jly because it requires an additional
sewer permit at a time vtien the moratorium restricts sewer link-ip, so severly.
To complete our home in two stages will be very much more costly for us that we
cannot consider this a viable solution, "What help can you offer us?

Thank you for furnishing water consumption data from commercial prop
erties for the portion of the present year to date, T have reviewed the
usage figures quite carefully and also estimated from the type of enter
prise, business, school, etc., what might be expected for the remainder of'
the year. Three major changes are likely. Usage at Howard Johnson will
be down appreciably. The County Jail will be up markedly, Borg-Warner
will approach consumption comparable to 1986, some 2!5% above 198? usage.
Presentation to the Cayuga Heights Board of Trustees of this resume'
led to their approval of the release of sewer units in the numbers as pro
posed in my letters of September 16, 1988, We will expect to hear that
known infiltration will be promptly corrected. Each of you will allocate
these unit permits according to criteria you have established, and our of
fice will issue the appropriate permits as per your Instruction.

Dear Mr. Desch,
The purpose of this letter is to set out the position of the
Village of Cayuga Heights with regard to sewer connections by the
Town of Ithaca. Although most, if not all, of the contents of this
letter have been stated to the Town of Ithaca repeatedly in the
past, the Village Board feels compelled to summarize and
reemphasize their position to the Town of Ithaca so that there will
be no future misunderstanding should the Village Board have to take
action.
PAST HISTORY;
As you know, on December 22, 1987, the Village of Cayuga Heights
placed a moratorium on the issuance of sewer permits outside
Village limits. This moratorium was necessitated by the receipt
of information from Stearns & Wheler, Engineers and Scientists, and
others that the Village's existing wastewater treatment facilities
were at or near capacity. Your municipality, among others, v/as
notified of the moratorium on or about December 22, 1987. Prior
to the moratorium, the Village of Cayuga Heights had informed the
Town of Ithaca, among others, of their concerns with regard to the
sewer plant's capacity and of preliminary data about capacity.
On January 18, 1988, the Village Board allocated 75 units of sewer
connections as soon as Borg-Warner pre-treatment became effective
to relieve the plant of some of its load. These units became
available in February of 1988. The Town of Ithaca was informed of
the availability of permits for it and the circumstances under
which they would be issued on February 19, 1988. Additionally, the
Village of Cayuga Heights met with officials of the interested
municipalities in February of 1988 to discuss future needs of the
connecting municipalities with regard to flow. Village actions
were explained fully in a letter of March 9, 1988 to the Village
of Lansing which was also received by your office.
Your office responded that in your opinion the contract between the
Village of Cayuga Heights and the Town of Ithaca mandated
connection of Town residences. The Village of Cayuga Heights
verbally has repeatedly disagreed.
In March and April of 1988, the effectiveness of Borg-Warner
Automotive pre-treatment decreased significantly which caused the
plant to exceed its effluent B.O.D. and T.S.S. permit levels for
the first time in the history of the plant. The Town of Ithaca was
notified of this problem. This was and is a continuing area of
great concern to the Village of Cayuga Heights.
The Village Board allocated additional units for sewer connections
in September of .1988.based upon improved plant data and promises
from the Town of Ithaca to reduce major infiltration problems. The
Village Board continues to have great concern about the plant
capacity and the possibility that permit levels will again be
exceeded and has consistently expressed these concerns to the Town
of Ithaca.
VILLAGE CONTRACT WITH THE TOWN OF ITHACA:
The Village and the Town operate under a contract dated
January 1, 1965. This contract states that the Town of Ithaca
agrees to comply with all of the rules and regulations of the
Village relating to sewer service and connections. The Village
Sewer Ordinance requires that a Village of Cayuga Heights permit
be issued before any connection can be made to a sewer line that
is in turn connected to the Village of Cayuga Heights plant.
The contract further states that construction of lines, etc and any
connection thereto shall be subject to approval by the Village
engineer.
This contract is also regulated by New York state law. State law
mandates that the Village of Cayuga Heights first serve its own
users prior to a sale of excess capacity.
PROBLEM:
It has come to the attention of the Village of Cayuga Heights that
the Town of Ithaca has been directing contractors to violate the
Village of Cayuga Heights Sewer Ordinance by instructing them not
to obtain a Village of Cayuga Heights permit prior to connection
to the Village system. The Town has further been attempting to
avoid approval by the Village engineer of the connection. These
actions are a breach of the contract between the Village and the
Town.
Additionally, the Town has apparently been ignoring the limitations
set by the Village of Cayuga Heights on the sewer connections.
We understand that the Town has now used up their allocation of
permits which the Village made in September of 1988.
The Village of Cayuga Heights will not allow unauthorized
connections to its sewer system. Any additional connections by the
Town of Ithaca without a Village permit and inspection will not be
permitted by the Village of Cayuga Heights,
The Village of Cayuga Heights takes its responsibilities to its
constituents very seriously and will take action to protect the
sewer plant for the use of its constituents.

Gentlemen and Ladies;
The Village of Cayuga Heights Board of Trustees has convened in special
meeting to review recent correspondence, proposals, and engineering sketches
pertaining to the proposed construction of facilities to expand sewage treat
ment capacity in the Northeast area of our community. The Village Board was .
concerned that the plans as now proposed by the Town of Ithaca change the
location of the 15 inch gravity lines, the force main, and the pumping station
on the Town of Ithaca Lake Shore Drive Sewer line. The plan as now proposed
creates no immediate advantage to the Village of Cayuga Heights to tie in
its Sewage Treatment Plant to the Ithaca area plant for emergency by-pass,
the long term gain to the Village of Cayuga Heights would be minimal.
Therefore, the Village of Cayuga Heights hereby abandons its request
to the Ithaca Area Waste Water Treatment Plant for a connection for emergency
service.
The plan for a Short Term Solution further proposes connecting the Village
of Cayuga Heights sewer main on Cayuga Heights Road to the City, Kline Road
sewer line. This plan is of no advantage to the Village of Cayuga Heights.
The sewage diverted would be Village of Cayuga Heights sewage for which the
Village of Cayuga Heights Plant has capacity. The Village Board rejects the
idea that such a cjiversion would allow the release of 250,000 g.p.d. worth
of sewer units to the contracting municipalities. The Village of Cayuga
Heights is unwilling to put itself in a position of exceeding its capacity
and being unable to serve its own municipal users in five years when the Ithaca
area plant could discontinue its agreement to accept the 250,000 g.p.d. and
the Village and Town of Lansing may not have their proposed new plant ready
and would not have .any plan to handle their own sewage. This probability
seems likely since the Village of Cayuga Heights has not had any official
answer to its two year old question to the Town and Village of Lansing as
to their plans for their own sewage in 1992. The Village of Cayuga Heights
to Ithaca area plant connection at Kline Road does not help serve the
Village of Cayuga Heights nor is it an adequate answer for the growth potential
and demand for service for the time period being considered. It is thus not
an appropriate short term solution.
Therefore, the Villcige of Cayuga Heights will not contribute to the
cost of a connection to the Ithaca area plant at Kline Road or to the cost
of alteration of City sewers to get the flow from the bottom of Kline Road
to the Ithaca area plant.

Although the Village of Cayuga Heights has not heard officially that
the Village of Lansing and Town of Lansing are proceeding with plans to build
their own treatment plant, the first paragraph of the Stearns and Wheler Kline
Road Trunk sewer Investigation, dated February 1989, states that "The
construction of a proposed 2 million gallon per day (m.g.d.) wastewater treat.-
ment plant in the Village of Lansing is projected to be completed within the
five year period."
Therefore, the Board of the Village of Cayuga Heights has resolved to
withdraw its offer to expand its plant to provide additional capacity for
the contracting municipalities. It is the intention of the Village of Cayuga .
Heights to., proceed with its plans to up-date its plant at present capacity.
If the contracting municipalities wish to negotiate with the Ithaca
area plant for treatment of sewage, they should do so directly. The Village
of Cayuga Heights will not participate in any costs of sewer lines to. get
sewage^'for contracting municipalities'to the Ithaca area plant.
The Village of Cayuga Heights remains willing to-discuss an easement
for the benefit of the contracting municipalities along the eastern edge of
the Village property at its plant to the point nearest the new 15 inch gravity
main along East Shore Drive so that the contracting municipalities could connect
their sewer lines to the Ithaca Area P.lant.
The moratorium on sewer connections for the contracting municipalities
will remain in effect under current conditions. No further units will be"
issued. The Village of Cayuga Heights is committed to its Waste Water Treat
ment Plant continuing to meet present DEC permit levels.
The issuance of the last connecting sewer units was based partially
upon promises of reduction of infiltration from the Village of Lansing and
the Town of Ithaca in their sewer lines. Although survey work has been
accomplished, there have been no repairs or rebuilding of sewer lines in
either.municipalities to reduce sewage flow into the Village of Cayuga Heights
Plant. Infiltration is a major concern to the Board of the Village of Cayuga
Heights, particularly as recent rains have raised flow levels very markedly.
The issuance of the last connecting sewer units was also based upon Borg-Warner
pretreatment being effective. Progress has been made with Borg-Warner, but
the Borg-Warner flow still demands a large part of the Village of Cayuga Heights
Plant capacity.
To summarize, the iB'oard of the Village of Cayuga Heights has resolved
as follows:
1. To abandon its request to tie-in with the City of Ithaca area plant
for emergency service;
2. To not participate in any connection to the City of Ithaca plant,
either with cost sharing or sharing of sewer lines belonging to the Village
of Cayuga Heights;
3. To withdraw its offer to expand the Village's treatment-plant;
4. To remain willing to .consider granting an easement for other
municipalities to cross Village property with their sewer lines for their
connection to the City of Ithaca plant;

5. To remind the contracting municipalities that the sewer connection
moratorium is in effect and that additional units will not be issued for sewer
connections into the Village plant.

The Board of Trustees of the Village of Cayuga Heights has
requested that I write to you to confirm the understanding of the
Village of Cayuga Heights with regard to the sidewalk on Pleasant
Grove Road. I am enclosing a certified copy of the resolution of
the Board from December 15, 1986 for your use and information.
As this resolution states, the Village of Cayuga Heights considers
the sidewalk located along Pleasant Grove Road between Hanshaw Road
and Jessup Road to be the property of the Village of Cayuga
Heights. As such, the Village of Cayuga Heights accepts
responsibility for its maintenance. The Village of Cayuga Heights
further agrees that this walkway will be accessible to cyclists as
well as pedestrians.
I hope that this letter resolves any questions that you might have
with regard to this matter.

VOTED to instruct the Mayor to write Supervisor Desch telling him that the Board
considers the sidewalk to be Village property and as such accepts full responsibility
for its maintenance as well as liability, and further that the walkway will be acces
sible to cyclists. Unanimously passed.
