TB Resolution 2026- : Authorization to Award Construction Contract for the 2025
Miscellaneous Water Main Replacement Proiect Phase 2
Whereas, on August 25, 2025, the Town Board adopted TB Resolution 2025-092 establishing the
Town of Ithaca 2025 Miscellaneous Water Main Replacement Project and Improvement Area
(Improvement), subject to permissive referendum, at a cost not to exceed $1,428,645.00, and
Whereas, on October 27, 2025 the Town Board authorized the award of Phase I of the 2025
Miscellaneous Water Main Replacement Project (Project), not to exceed $384,527.00, leaving
$1,044,118.00 for Phase 2 of the Project, and
Whereas, on July 1, 2026, bids for Phase 2 of the Project were received and the Town Engineer
has determined that the Improvement's budget allows for the award of Scenario 3 (Base bid,
Additive 1 &Additive 2), as detailed in the bid documents, and
Whereas,pursuant to the New York State Environmental Quality Review Act("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval, construction and implementation of the Improvement are a Type II action due to the
Improvement being a "replacement, rehabilitation or reconstruction of a structure or facility, in
kind, on the same site...."; and
Whereas the Town Engineer has determined that the lowest responsive and responsible bid for
Scenario 3 was submitted by Hurd Development LLC,22 N. Brookside Ave,Endwell,NY 13760,
for$859,126.00 and
Resolved, that the Town Board authorizes award the 2025 Miscellaneous Water Main
Replacement Project Phase 2, Scenario 3,to Hurd Development LLC, at a cost not to exceed
$945,038.00 (includes 10% contingency); and be it further
Resolved,that the Town Supervisor is authorized to execute such contract subject to review of the
final contract documents by the Town Engineer and the Attorney for the Town and be it further
Resolved that the Town Engineer is authorized to approve change orders to said contract upon
receipt of appropriate justification provided the maximum amount of such change orders shall not
in the aggregate exceed the maximum authorized cost of $945,038.00, including contract,
engineering, legal, inspection, and other expenses, for the Project, without further authorization
from this Board.

TB Resolution 2026 - Authorization to Apply for Funding through the 2026
Environmental Protection Fund Grant Historic Preservation Program for Town Hall
Whereas, the New York State Office of Parks, Recreation& Historic Preservation (OPRHP)has
announced the availability of funding under the 2026 Environmental Protection Fund Grants
Program for Parks, Recreation and Heritage, which includes a category for historic preservation,
and
Whereas, the maximum assistance allowed toward the cost of the project is $675,000, with a
25% local match required, and
Whereas, the Town of Ithaca is seeking to restore and weatherize the historic Town Hall facility,
excluding the post office, and includes insulating the exterior walls, replacing single pane glass
with insulated glass within the historic windows, replacing exterior doors, air sealing,
replacement of lighting fixtures with LED fixtures, installation of lighting controls, and other
associated items, and
Whereas this is a Type II action, pursuant to 6 NYCRR Part 617.5(c)(2), as it would be a
"replacement, rehabilitation, or reconstruction of a structure or facility, in kind, on the same site,
including upgrading buildings to meet building, energy, or fire codes, unless such action meets
or exceeds any of the thresholds in 617.4 of this Part," and
Whereas, grant applications are due by July 31, 2026; therefore be it
Resolved, that the Supervisor of the Town of Ithaca, or designated representative, is hereby
authorized and directed to file an application for the historic preservation of the historic Town
Hall under the 2026 Environmental Protection Fund Grants Program for Parks, Recreation and
Heritage in an amount not to exceed $675,000, and upon approval of said request to enter into
and execute a project agreement with OPRHP for such financial assistance to the Town of Ithaca.

RE: GRANT APPLICATION FOR TOWN HALL WEATHERIZATION—NYS OPRHP 2026
ENVIRONMENTAL PROTECTION FUND GRANTS PROGRAM
The Town of Ithaca is applying for funding for the second time through New York State's Environmental
Protection Fund to help offset the cost of weatherizing Town Hall.This is the continuation of a multi-
year project to make the Town's government buildings carbon neutral by 2030, as set forth in the
Town's Green New Deal Resolution 2020-049 (adopted unanimously by the Town Board on March 23,
2020).
Preserving, enhancing, and promoting the Town's historical resources is one of the eleven policy areas
of the Town's 2014 Comprehensive Plan.The intent of this project is to weatherize Town Hall,which is
listed on the State and National Registers of Historic Places. Constructed in 1910,the original building
was designed by U.S. Supervising Architect James Knox Taylor. It is one of the finest local examples of
Beaux Arts Classicism.
This project includes insulating the exterior walls, replacing single pane glass with insulated glass within
the historic windows, replacing exterior doors, air sealing, replacement of lighting fixtures with LED
fixtures, installation of lighting controls, and other associated energy improvements.
To support these efforts,the Town is seeking grant funding from New York State's Office of Parks,
Recreation, and Historic Preservation Environmental Protection Fund program during the 2026
Consolidated Funding Application cycle to help offset some of the costs of this work.The Town is
seeking the full grant amount of$675,000; the grant, if awarded, requires a 25%match.
This proposed project exemplifies responsible and thoughtful stewardship of a landmark building.
Instead of demolishing and rebuilding,the Town is investing in the long-term preservation and
functionality of this significant civic building. Further, it aligns with the Town's commitment to the Green
New Deal Resolution and goals of community-wide carbon neutrality by 2030. We believe this project
can serve as a model for other historic preservation projects in New York State.

TB Resolution 2026 - e: Appointment of Planning Board Member
Whereas there is a vacant Planning Board Regular Member position due to a resignation, and the
Selection Committee recommends appointing Jennifer Minner, 200 Roat Street, to the position
for the remainder of an active term ending December 31, 2031; now, therefore,be it
Resolved that the Town Board appoints Jennifer Minner as a Planning Board Member for the
term of July 13, 2026, through December 31, 2031.
TB Resolution 2026 - f: Appointment of Zoning Board of Appeals Member- Friedman
Whereas there is a vacant Zoning Board of Appeals Member position due to a resignation, and
the Director of Code Enforcement recommends appointing current Alternate Stuart Friedman,
219 Rachel Carson Way, to the full position, be it
Resolved that the Town Board of the Town of Ithaca does hereby appoint Stuart Friedman as a
Zoning Board of Appeals Member for the term of July 13, 2026, through December 31, 2030.
TB Resolution 2026— g: Approve Promotional Appointment of Civil Engineer- Crandall
Whereas, there is currently a vacancy in the Senior Civil Engineer position but are backfilling the
position with a Civil Engineer position; and
Whereas the Interview Committee interviewed one internal candidate for the position after an open
recruitment; and
Whereas the Committee has determined that Connor Crandall,Engineering Technician I,possesses
the necessary knowledge and skills to satisfactorily perform the duties of the position; and
Whereas Justin McNeal, Director of Engineering, appointed Connor Crandall as a Civil Engineer,
effective August 9, 2026; now, therefore be it
Resolved the Town Board of the Town of Ithaca does hereby approve the promotional appointment
of Connor Crandall as a Civil Engineer, effective August 9, 2026; and be it further
Resolved the position is at 40 hours per week, at the hourly wage of$42.75, which is an estimated
annual salary of$88,920 from A1440.100,in Job Classification"F" Step 1,with full time benefits;
and be it further
Resolved the said appointment is a non-competitive appointment due to the NYS HELPS
program; and be it further
Resolved, a minimum twelve (12)week probationary period applies with no further action by the
Town Board if there is successful completion of the probationary period as determined by the
Director of Engineering.

TB Resolution 2026— h: Approve Appointment of Deputy Finance Officer-Snyder
Whereas, there is a vacant Deputy Finance Officer position due to retirement on June 26, 2026;
and
Whereas the Interview Committee interviewed five candidates from an open recruitment for the
position; and
Whereas the Committee has determined that Lisa Snyder possesses the necessary knowledge and
skills to satisfactorily perform the duties of the position; and
Whereas Kelly Anderson, Finance Officer appointed Lisa Snyder as Deputy Finance Officer,
effective July 20, 2026; now, therefore be it
Resolved the Town Board of the Town of Ithaca does hereby approve the non-competitive
appointment of Lisa Snyder as Deputy Finance Officer position for the Finance Office, effective
July 20, 2026; and be it further
Resolved the position is at 40 hours per week, at the hourly wage of$38.75, which is an estimated
annual salary of$80,600 from A1316.100, in Job Classification "E", with full time benefits; and
be it further
Resolved a minimum twenty-six (26) week probationary period applies with no further action by
the Town Board if there is successful completion of the probationary period as determined by the
Finance Officer.
TB Resolution 2026 - is Approval of Contract—Legal Services—IAWWTF
Resolved that the Town Board approves and authorizes the Town Supervisor to sign the contract
with PMV Legal Group, PLLC for Legal Services to the Ithaca Area Wastewater Treatment
Facility as submitted.
TB Resolution 2026 - j: Authorization for the Town Engineer to issue a Sewer Exemption
for 415 Bostwick Road
Whereas the Town Engineer received a request for a Sewer Exemption from Eric Caster, the
owner of 415 Bostwick Road, Tax Parcel No.32.-2-3.3, due to the excessively large costs and
difficulties connecting into municipal sewer due to the nearest sewer main being approximately
5,100+1- feet away, resulting in an estimated cost of$1,275,000.00, and
Whereas the owners are replacing an existing septic system for a single-family home that has
failed on the property and are working with a contractor and Tompkins County Health
Department to design the replacement system, and
Resolved,pursuant to Town Code Section 214-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons

conveyed by town staff and the reasons detailed in the request for a sewer exemption submitted
to the Town Engineer, dated July 1, 2026, and be it further
Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from the
Town Code Section 214-5 public sewer connection requirement for 415 Bostwick Road, Tax
Parcel 32.-2-3.3 for the installation of a new, onsite wastewater treatment system associated with
the existing single-family residence, subject to the consent of the Tompkins County Health
Department.
TB Resolution 2026 - k: Proclaiming July as Parks and Recreation Month
Whereas, parks and recreation are an integral part of communities throughout this country,
including the Town of Ithaca; and
Whereas, parks and recreation promote health and wellness, improving the physical and mental
health of people who live near parks; and
Whereas, parks and recreation promote time spent in nature and encourages physical activities by
providing space for sports, hiking trails, and activities designed to promote active lifestyles; and
Whereas, park and recreation programming and education activities, such as youth sports and
environmental education, are critical to childhood development; and
Whereas, parks and recreation increase a community's economic prosperity through increased
property values, expansion of the local tax base, increased tourism,and the attraction and retention
of businesses; and
Whereas,the Town of Ithaca Public Works Department plays a vital role in caring for the Town's
parks, trails, recreation and open space areas, which include many neighborhood parks, a
developed community park, six nature preserves, four multiuse trails, and numerous walkways;
and
Whereas, the Town's parks and natural recreation areas ensure the ecological beauty of our
community and provide a place for children and adults to connect with nature and recreate
outdoors; now therefore be it
Resolved, July is recognized as Park and Recreation Month in the Town of Ithaca.

INTERMUNICIPAL AGREEMENT REGARDING
DISTRIBUTED ENERGY RESOURCES CONSULTING CONTRACT
This Agreement("Agreement")is made as of the day of ,2026 by the City
of Ithaca ("City"), a municipal corporation organized under the laws of the State of New York,
having its offices at 108 East Green Street, Ithaca NY 14850, and the Town of Ithaca("Town"),
a municipal corporation organized under the laws of the State of New York, having its offices
at 215 North Tioga Street, Ithaca,NY 14850.
Whereas, the City and Town (collectively, the "Municipalities") value intermunicipal
collaborations and partnerships that advance their shared goals and equally benefit citizens of
both municipalities;
Whereas, each Municipality has approved its own Distributed Energy Resources ("DER") law
and DER Plan, and the Town has been working with the City and Local Power,LLC to plan and
implement their DER programs;
Whereas, the City of Ithaca has a signed Contract for Services with Local Power, dated June 1,
2022 and amended effective January 6,2026 (the"Contract for Services"),that includes, among
other things, development of DER programs;
Whereas, for the DER program development component under the Contract for Services, the
City has identified a contract shortfall of Eleven Thousand Four Hundred Ninety-Five Dollars
($11,495);
Whereas, the Town has been an active partner in all aspects of DER planning and outreach, and
Local Power's DER services under the Contract for Services have directly benefited the Town;
now, therefore, the Municipalities agree as follows:
1. The Town agrees to reimburse the City for the shortfall for Local Power's DER program
development services under the Contract for Services, with a not-to-exceed limit of
Twelve Thousand Dollars ($12,000). The Town shall reimburse the City within ten(10)
days of the Town's receipt from the City of a notification that the City has paid Local
Power for all DER services required under the Contract for Services, and a statement
showing the amounts earned by Local Power and paid by the City pursuant to the
Contract for Services.
2. This Agreement may be modified only by a written document signed by both
Municipalities.
3. This Agreement shall be governed by and construed in accordance with the laws of
the State of New York without regard to, or the application of,New York State's choice
of law provisions. The Municipalities agree that the Supreme Court of the State of New
York, held in and for the County of Tompkins, shall be the forum to resolve disputes
arising out of this Agreement.

TB Resolution 2026 -XXX: Authorization for the Town Engineer to issue a Sewer
Exemption for 415 Bostwick Road
Whereas the Town Engineer received a request for a Sewer Exemption from Eric Caster, the
owner of 415 Bostwick Road, Tax Parcel No.32.-2-3.3, due to the excessively large costs and
difficulties connecting into municipal sewer due to the nearest sewer main being approximately
5,100+1- feet away, resulting in an estimated cost of$1,275,000.00, and
Whereas the owners are replacing an existing septic system for a single-family home that has
failed on the property and are working with a contractor and Tompkins County Health
Department to design the replacement system, and
Resolved, pursuant to Town Code Section 214-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons
conveyed by town staff and the reasons detailed in the request for a sewer exemption submitted
to the Town Engineer, dated July 1, 2026, and be it further
Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from the
Town Code Section 214-5 public sewer connection requirement for 415 Bostwick Road, Tax
Parcel 32.-2-3.3 for the installation of a new, onsite wastewater treatment system associated with
the existing single-family residence, subject to the consent of the Tompkins County Health
Department.

Dear Mr. McNeal,
We are requesting a sewer exemption for the Property located at 415 Bostwick Rd Ithaca, NY 14850
owned by Eric Caster(shown on the attached Survey Map of Lands Owned by Eric Caster,Tax. Map
Parcel No 32.-2-3.3.The residential home was built in the early 1970s and the current system is failing
with drainage rising to the surface of our lawn. We are working with a private contractor and their
engineer is providing the plan for replacement to the Tompkins County Health department.
Currently the Town of Ithaca sewer system does not service this property.The Municipal sewer system
is approximately 5,100 linear feet from 415 Bostwick Rd and would require an easement through the
neighboring parcel.415 Bostwick Rd would be the only home using the municipal sewer system if it
were to be extended.This is a single-family home on the property constructed in a location that would
make any future subdivision unlikely, nor do we have any interest in subdividing the property any
further.The area around 415 Bostwick Rd is mostly agriculture and a small amount of low density
residential with very limited buildable areas.
In addition to this, the cost of constructing over 5,100 feet of new Municipal sewer line to
service one home with a very low probability of servicing any other future homes would be extreme at
approximately$250/ft. or 1$1,275,0001.
A replacement system is under design and being submitted to the Tompkins County Health
department.There is plenty of room for the replacement system and the contours of the property work
very well for a gravity fed septic system.
