owners, Jon Levy and Marjorie Steenbarger. A closing on our purchase

of the new Survey Map, it was discovered that the distance
between the house on this property and the west boundary line of the
parcel is a distance of 13.1 feet. We then learned that a prior
variance was granted by the Town of Ithaca Zoning Board of Appeals on
January 14, 1976 permitting the construction of the house on this
property 15 feet easterly from the west lot line.
As best we can determine, a building permit was issued to the
present owner of the property, Jon Levy, following the variance having
been granted in January of 1976. The house on this property was then
constructed. Apparently, only after the new Survey was prepared with
respect to our purchase of this property was it discovered that the
distance between the house and the west lot line was not 15 feet as
originally intended. We have been assured by the present owner of the
property, Jon Levy, that all parties involved had always intended to
construct the house 15 feet from the west lot line as required and
had always assumed that the construction had been completed in that
fashion.
A copy of the Minutes of the Zoning Board of Appeals Meeting of
January 14,. 1976 are attached setting forth the basis upon which the
original variance was granted. All of the information contained
therein with respect to the.topography
district
of the property and the narrow-
ness of the lot are applicable to our present variance application.

Based upon all of the foregoing, it is respectfully_ submitted that
if the variance is allowed, it will simply confirm what has been a
condition on said property for over eight (8) years and will in no way
contravene the intent of the district regulations or the original var-
iance granted in 1976. In addition, no substantial change will be
produced in the character of the neighborhood and no substantial
detriment will.result to adjoining properties. The practical difficulty
which exists as a result of the present situation cannot be otherwise
overcome in any reasonable fashiori other than the obtaining of this
variance. Furthermore, in light of all of the facts and circumstances,
the interest of justice will best be served by allowing the varianc?.

R-30 zone -as shown on --the application --for building permit. The R-30
zone requires a 40' -side.-yard_and.Ilr. Levy wishes to place his house ----

It isa shame to have to cut dorm many healthy trees when it is not
necessary. Also, my building Tihere- I- indicated would provide MAXTI-mm

Mr. Fabbroni indicated the.parcel in question on Town of Ithaca
Tax Hap No. 28, revised as of I1ay 1975.
Mr. Levy stated that most of what he wanted to say had been said
by Mr..Fabbroni. He Pointed out that the lot meets the building require•
iLients of the Toc-m of Ithaca in terms of square footage. He stated that
the only draw -back, as shown on the proposed plot plan is that the lot
ia very long and deep but not very wide. He stated that the topography
of the land fits this particular placement of the proposed.house. He
noted that there is a stream on the lot. He stated that the request
cr variance would be in keeping with the Town Zoning.Ord_inance by being
in keeping with the maximum separation. Mr. Levy stated that he had
u—,^ohased the land as of this date.

Mr. Fabbroni asked if the garage is to be placed under the house.
Mr. Levy said that it is. tire Levy stated also that the set back is
about 50' frim the road.
Dir. Iain j asked if, even with the set back of about

set back meet: the average of the other houses on the street. Air. Levy
stated that it does. There is only one house on that street (Tera
Circle). 11r. Otis Drew, developer, agreed and stated that the Daven
port's house which he constructed is about 35' or 40' back from the
road, 11r. Levy noted that there are woods between the house and the
road.
Mr. !,ring asked if there were anv information from the health
Department. Por. Fabbroni stated that the lots in this subdivision
Drew Subdivgsion) as approved by the Planning Board are the lots that
the Health -Department approved. I -sr. Fabbroni said that those lots are
what the Health Department would approve as far as septic fields. He
stated that the -Levy's lot is weird because of the requirements of the
Health Department. He said that this particular subdivision .was alnosL
totally dependent on the Health Department approval of the lots, There
are -two lots which cannot be -built upon because of poor percolation
tests.= Mrs Fabbroni said that soil must be brought in.bef_ore those
could ever -be approved and built upon:-- - He noted -that if sewers -were -
ever --brought up there, there might be a chance of.subdivis-ion of.
existing lots.
11r.-Levy-said that the Health Department said that the original
size lot was determined by -the sewage needs of that particular type of
soil- condition.- - lir. King stated that he was suggesting that the
Drakes, neighbor. to Levy -'s lot, might change their septic system to
another type that would . allow for__ a lot big enough to subdivide. A.Ir. _
Levy ---stated- that= the -Health' Department told him= that they (Drake).-- -
already have a sand ---filter and: that- the_ rest. of the --lot.: would- not
support any other houses -.-
Firs- Otis Drew- stated -that he has: -just --as much -to say_- aboutthat-
subdivision) as -the. Health Department._- _He stated that he has --res
trictions right: -in the --Deeds. He- stated- that he approves a house or
any= additions- that--they-Might= put, on He said- that they- cannot even -
put in a dog -house without his approval._
Mr. King asked if the Deed for the.Edwin Drake property restricts
the use of the land to build -no -more- than one house on the lot.,. Mr. =
Drew said that it -does so restrict Mr, King suggested that the Board --
require that a copy of the Deed aforementioned be put in the record. _-
hire Drew stated that heicould not see that the granting of this
request for variance would.interfere with anyone. Mr. Drew stated -
that 1.1ro Edwin Drake does know about this request because Mrs Drake--
called him.(Drew) on the telephone. I -r. Drew said that Mr. Drake was _.
upset over Mr. Levy's not getting a building permit in the first place
without having to appeal. Mr. Levy said that the first thing he did
was consult with the Drakes. He said that they agreed wholeheartedly
ith the proposal. Mr. Drew commented also that the Drakes seem to be --
Z:' -.v cooperative.
lir. I:ir_g stated that he would feel much more comfortable having
so;nething from the Drakes in writing for the record as well as the Deed.

like to have something from Edwin Drake in writing. Por. Levy suggested
that in order to avoid delay, if the Board were to act upon his request
could the Board make such a document a condition of the granting of the
variance.
A'IOTION by Mr. Edgard King, seconded by Pers. Laurene Ripley..
RESOLVED, that the request on the appeal of Mr. Jon Levy for a
variance to build a dwelling on the lot identified as Town of Ithaca
Tax Parcel Ito. 6-2.8-1-34.35, which is on the north side of Vera Circle,
With a 15 foot side yard on the rest side of the proposed house and
being set back at least 30 feet, be and hereby is granted subject.to
receipt of a copy of the Edwin Drake Deed for the property adjoining on
the west and the Building Inspector ascertaining that the Deed bears a
restriction to the construction of one dt.-telling only on said Drake lot,
and, further, that this Board be presented with a statement in writing
from Edwin Drake acknowledging his consent and agreement to the granting
of this variance.
There"being no -further discussion, the Vice -Chairman called for a. _.
