TB Resolution 2022 - 023: A Local Law Adding Provisions Regarding Barns on Non-Farm Lots, Agritourism, and Seasonal Farm Lodging Facilities in the Agricultural Zone to Chapter 270, Zoning,
of the Town of Ithaca Code
Whereas, the proposal involves adding two new uses to the Ag Zone, specifically “agritourism” and “seasonal farm lodging facilities”, along with allowing barns to be a principal building
that is not part of a farm; and
Whereas, the Planning Committee reviewed the proposed amendments at several meetings in 2021 and at their December 16, 2021 meeting, recommended the amendments be forwarded to the Town
Board for consideration of approval; and
Whereas, at its meeting on January 24, 2022, the Town Board discussed the proposed local law, and a public hearing was scheduled for February 14, 2022, at 5:30p.m. to hear all interested
parties on the proposed local law,which was legally advertised and held, and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, adoption of said local law is a Type I Action
for which the Town Board of the Town of Ithaca, acting as lead agency in an environmental review with respect to adoption of this local law, has, on February14, 2022, made a negative
determination of environmental significance, after having reviewed and accepted as adequate the Full Environmental Assessment Form Parts 1, 2 and 3, and
Whereas, the Town Board finds that the proposed local law will further the health and welfare of the community; now, therefore, be it
Resolved, that the Town Board hereby adopts Local Law 3 of 2022 entitled “A Local Law Adding Provisions Regarding Barns on Non-Farm Lots, Agritourism, and Seasonal Farm Lodging Facilities
in the Agricultural Zone to Chapter 270, Zoning, of the Town of Ithaca Code.”
