HomeMy WebLinkAboutTB 2022-085 Acceptance of the Concept and Locations of Public Utilities 519 Elm St SubdivisionMEETING OF THE ITHACA TOWN BOARD May 9, 2022 TB Resolution 2022 -085: Acceptance of the Concept and Locations of Public Utilities to be dedicated to the Town and associated Easements for the 3-lot subdivision at 519 Elm Street Extension Whereas, the Town of Ithaca Planning Board granted Preliminary/Final Site Plan Approval for the proposed 3-lot subdivision located at 519 Elm Street Extension, TP 29.-7-12.42, Medium Density Residential Zone. The project involves subdividing the 8.2-acre parcel into three lots (Parcel A-1 is 2.51 acres, Parcel A-2 is 3.58 acres, and Parcel A-3 is 2.11 acres) and a private shared access road to serve the new parcels and an existing parcel, stormwater facilities, and connections to public water and sewer facilities, David and Sarah Locke Mountin, Owners/Applicants; and Whereas, the Applicant has proposed dedicating a public utility (sanitary sewer extension) and associated easements to the Town of Ithaca, to serve the parcels, and Whereas, the existing sewer main is located on an adjacent property to the north, owned by Christian J Haller, who has agreed to grant an easement for the installation and maintenance of the proposed sanitary sewer extension to the Town of Ithaca, and Whereas, the sewer line extension and easement are indicated on the drawing “Sanitary Sewer Easement Map, Showing Part of Lands of, David & Sarah Locke Mountin, & Christian J Haller” dated 10/18/2021, last revised 11/11/2021, prepared by TG Miller, P.C. Engineers and Surveyors, which shows the approximate 60 L.F. sewer main extension, manhole, and proposed easements, and Whereas, the Public Works Committee has reviewed the plans for the above improvements and found them generally acceptable, and recommended the action to the Town Board for discussion and consideration, and Whereas, the existing water main located along the southern road shoulder of Elm Street Extension does not have an easement on record, and the Applicant has agreed to grant an easement for the water main, indicated on the drawing “Town of Ithaca, Proposed Water Easement, Lands of David and Sarah Locke Mountin”, dated 11/10/2021, and Whereas, the Attorney for the Town has reviewed and approved the title, access easements and rights-of-way associated with the existing water main and proposed sanitary sewer extension, now, therefore, be it Resolved, that the Town Board approves and accepts the concept and location of the improvements described above, and be it further Resolved, that the Town Board authorizes the Town Supervisor to execute the easements and rights-of-way as described above, and be it further Resolved, that the Town Board will consider acceptance of the infrastructure after satisfactory completion, subject to the approval of the Town Engineer, of the installation of said infrastructure.
