TB Resolution 2022 - 098: Approval of a Noise Permit for a wedding at RaNic
Whereas the Town received a noise permit application from Gregory Mezey and Ryan Mitchell, cosigned by RaNic for a band at their wedding ceremony and reception to be held on Saturday,
June 25th from 4:30 p.m. to 11:00 p.m., which includes a buffer on each end of the time frame to cover any unexpected delays or similar with the main music planned to be between 6pm
and 10pm, and
Whereas a duly published public hearing was held on June 13, 2022 to hear all interested parties on the application, now therefore be it
Resolved that the Town Board grants the applicants a noise permit, with the following :
Conditions
The speakers for the band will be faced toward the golf course and away from the homes, and
No later than 11:00 p.m. with the following
Findings
1. The waiver from the requirements of Town Code Chapter 184 for the above music event is necessary for a valid purpose, because music might not be able to conform at all times to the
requirements of Chapter 184, and wedding receptions generally include amplified music, which is normal and not unusual in nature for a wedding venue, and
2. The waiver is the minimal intrusion needed, because the amplification is needed to for weddings and such mitigating factors as the speakers will be facing the open golf course and
the nearest houses will have wedding guest staying in them, and
3. On balance, the need for and benefits of the waiver outweigh the needs and rights of the surrounding neighbors to a peaceable and quiet environment, because the music is for a limited
amount of time on the specified date, with the above-listed conditions and other findings mitigating the intrusion on the neighbors to the extent practicable.
