TB Resolution 2022 - 112: Adopting Local Law 12 of 2022, Revising Site Plan Requirements in Chapter 270, Zoning, of the Town of Ithaca Code
Whereas, at its meeting on June 13, 2022, the Town Board of the Town of Ithaca discussed a proposed local law to revise the site plan requirements in the Town of Ithaca Town Code, Chapter
270, Zoning, and adopted a resolution for a public hearing to be held by said Town on July 11, 2022, at 5:30 p.m. to hear all interested parties on the proposed local law entitled “A
Local Law Revising Site Plan Requirements In Chapter 270, Zoning, Of The Town Of Ithaca Code”; and
Whereas, notice of said public hearing was duly advertised in the Ithaca Journal; and
Whereas, said public hearing was duly held on said date and time and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local
law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of the proposed local law is a Type II action because it constitutes “routine or continuing agency administration and management, not including new programs or major reordering
of priorities that may affect the environment,” and thus this action is not subject to review under SEQRA; and
Whereas, the Town Board finds it is in the best interest of the Town and its citizens to adopt the local law; now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law 12 of 2022 entitled “A Local Law Revising Site Plan Requirements In Chapter 270, Zoning, Of The Town Of Ithaca
Code.”
