HomeMy WebLinkAboutTB 2023-067 Acceptance and Dedication of Westhaven Homes InfrastructureMEETING OF THE ITHACA TOWN BOARD April 10, 2023 TB Resolution 2023 - 067: Acceptance of Dedication of Public Sanitary Sewer and Potable Water Infrastructure associated with the 8-lot Subdivision at Mecklenburg Rd Whereas, the Town of Ithaca Planning Board has granted Preliminary and Final Subdivision Approval for the Westhaven Homes Subdivision, located on the corner of Mecklenburg Road and Westhaven Road, Town of Ithaca Tax Parcel No. 28.-1-26.22, Medium Density Residential Zone and Planned Development Zone No. 8 on April 19, 2022, by PB Resolution 2022-0014. The project involves subdividing eight lots from the EcoVillage at Ithaca, Inc. property for the purposes of single-family residential development. The project applicants, Ken and Graham Ottoson (“Applicants”), have extended the public potable water and sanitary sewer infrastructure, and Whereas, the Town Board accepted the concept and location of the proposed public utilities associated with the Project by TB Resolution 2022-108 and by that same resolution approved water and sewer easements from EcoVillage at Ithaca, Inc. to the Town of Ithaca, which easements were fully executed and recorded in the Tompkins County Clerk’s Office on August 18, 2022, and Whereas, the public potable water and sanitary infrastructure has been completed in a manner satisfactory to the Director of Engineering, and Whereas, the Applicants request that the Town of Ithaca accept dedication of the public sanitary sewer and potable water infrastructure as shown on the “Water and Sewer As-Built” plan titled “Westhaven Homes, Graham and Ken Ottoson”, dated March 13, 2023; prepared by David A. Herrick, P.E. of T.G. Miller, P.C., and Whereas, portions of the infrastructure were installed outside of the filed easements and revisions to the easements are necessary to ensure adequate rights of access and maintenance are granted over all portions of the infrastructure, now therefore be it Resolved, that the Town Board hereby authorizes the Town Supervisor to execute revised easements and accepts the dedication of the above-described sanitary sewer and potable water infrastructure from Ken and Graham Ottoson, subject to the following conditions: Approval of the revised easements by the Director of Engineering and the Attorney for the Town.
