TB Resolution 2023 -068: Authorization to executeNYSEG easement and agreement for electrical service upgrades associated with the Ridgecrest Road Water Improvement Project
Whereas, pursuant to a resolution dated March14, 2022, The Town of Ithaca Town Board has determined it to be in the public interest to establish the Town of Ithaca Ridgecrest Road Water
Improvement Project (Improvement),and
Whereas, pursuant to a resolution dated February 28, 2022, the Town of Ithaca Town Board made a negative determination of environmental significance, in accordance with the New York
State Environmental Quality Review Act for the above-referenced Improvement, and
Whereas, the proposed upgraded electrical service and transformer are associated appurtenances that are required for the Improvement, and
Whereas, NYSEG (New York State Electrical & Gas Corporation) will own and maintain the proposed transformer and requires an easement to install, maintain, and access the transformer,
and
Whereas, NYSEG requires an agreement for the Town to construct, own, operate, repair, and maintain an underground electric distribution line for the Improvement, now therefor be it
Resolved that the Town Board authorizes the Town Supervisor to execute the NYSEG easement and agreement for the Ridgecrest Road Water Improvement Project electrical service upgrades
subject to a permissive referendum pursuant to the provisions of Town Law§64(2) andsubject to final approval of the Director of Engineering and the Attorney for the Town.
