TB Resolution 2023 -173: Approval of and authorization for the Supervisor to sign the contract for the Town Line Rd over Lick Brook Bridge Replacement Project (Locally Administered
2022 NY Bridge Project funded with BFP Off-System)
Authorizing the implementation and funding of the costs of a transportation project, which may beeligible for federal-aid and/or state-aid, or reimbursement from Bridge NY funds.
Whereas, a project for the Town Line Rd over Lick Brook Bridge Replacement, BIN 3210050, Town ofIthaca, Bridge NY 2022, P.I.N. 3757.26 (the Project") is eligible for funding under Title
23 U.S. Code, asamended, 23CFR as amended and PUB. L. 117-58 also known as the “Bipartisan infrastructure Law” (BIL);and
Whereas, the Town of Ithaca will design, let, and construct the Project: and
Whereas, the Town of Ithaca desires to advance the Project by making a commitment of 100% of thecosts for Engineering, ROW and Construction, and
Whereas, pursuant to New York State Environmental Quality Review Act (SEQRA) and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that that
this is a Type II action because it constitutes “replacement in kind of facilities on the same site, and thus, not subject to review under SEQRA,
Now, therefore, the Ithaca Town Board, duly convened does hereby
Resolved, that the Ithaca Town Board hereby approves PIN 3756.97 Replacement ofTown line Rd over Lick Brook Bridge Replacement (BIN 3210050) at a total cost of $2,464,840 with reimbursement
expected at the ratio 95% federal and 5% non-federal; and it is hereby further
Resolved, that the Ithaca Town Board hereby authorizes the Town of Ithaca to pay in the first instance 100% of thecost of Engineering, ROW and Construction work for the Project or portions
thereof, with the understandingthat qualified costs may be eligible for federal-aid, state-aid, or reimbursement from Bridge NY funds; and it is
further
Resolved, that the Ithaca Town Board hereby agrees that the Town of Ithacashall be responsible for all costs of the Project which exceed the amount of federal-aid, state-aid, or NY Bridgefunding
awarded to the Town of Ithaca and it is further
Resolved, that in the event the Project costs not covered by federal-aid, state-aid, or NY Bridgefunding exceed the amount appropriated above, the Ithaca Town Board shall convene as
soon aspossible to appropriate said excess amount immediately upon the notification by the Supervisor of the Townof Ithaca thereof; and it is further
Resolved, that Town of Ithaca hereby agrees that construction of the Project shall begin no later thantwenty-four (24) months after award and the construction phase of the Project shall
be completed within thirty(30) months of commencing construction; and it is further
Resolved, that the Supervisor of the Town of Ithaca be and is hereby authorized to execute onbehalf of the Town of Ithaca all necessary agreements, certifications or reimbursement requests
forfederal-aid and/or state-aid with the New York State Department of Transportation in connection with theadvancement or approval of the Project and providing for the administration
of the Project and the Town ofIthaca's funding of Project costs and permanent funding of the local share of federal-aid and state-aideligible Project costs and all Project costs within
appropriations therefore that are not so eligible; and it isfurther
Resolved, that a certified copy of this resolution be filed with the New York State Commissioner ofTransportation by attaching it to any necessary Agreement in connection with the Project;
and it is further
Resolved, that this Resolution shall take effect immediately.
