TBRESOLUTION2024-029:ApprovalofEncroachmentLicense for204GlensideRoad to Permit Encroachment of Portions of Wire Fences and Portion of a ConcreteSidewalk into Glenside Road and Coy Glen
Road
Whereas, Julianna M. Lower (“Owner”) is the owner of real property located at 204 Glenside Road,Ithaca,NewYork14850,TaxMapParcelsNos.30.-1-13and30.-1-14(thePremises”), as more particularly
described in a quitclaim deed to Owner from Jeffrey Lower dated November 2, 2020, and recorded November 5, 2020 in the Tompkins County Clerk’s Officeas Instrument Number 2020-11212,
and
Whereas,GlensideRoad isa50-foot-wideTownroad,andCoyGlenRoadisaTownroad by use, and
Whereas, portions of wire fences and a small concrete sidewalk on the Premises encroach into Glenside Road and a portion of a wire fence encroaches into Coy Glen Road, as shown on a
survey of the Premises entitled “Survey Map Showing Lands of Julianna M. Lower LocatedatNo.204GlensideRoadTownofIthaca,TompkinsCounty,NewYork"preparedby
T.G.MillerP.C.,datedNovember 7,2023,and
Whereas,theSuperintendentofPublicWorks hasdeterminedthatthereisenoughroom on Glenside Road for vehicles to pass safely and for the Town to perform road maintenance without disturbing
the fences or sidewalk and has proposed an Encroachment License between the Town and Owner, and
Whereas,theTownBoardisamenabletoenteringintotheproposedEncroachmentLicense to permit the conditional continued encroachment of the wire fences and concrete sidewalk,
Now,therefore,beit
Resolved, that the Town Board of the Town of Ithaca hereby approves the Encroachment License to permit the conditional continued encroachment of the wire fences and concrete sidewalk,
and authorizes the Town Supervisor to execute the Encroachment License on behalf of the Town, subject to the review of the Attorney for the Town.Moved: Rob Rosen Seconded: Susie GutenbergerVote:
