TB Resolution 2024-071: A Local Law Amending the Town of Ithaca Code, Chapter 270 Entitled “Zoning,” Regarding Establishment that a Property no longer contains an Accessory Dwelling
Unit
Whereas, the Codes & Ordinances Committee, during a meeting on May 9, 2024,along with Town staff, researched and considered legislative options for addressing issues associated with
second kitchens in the Town, and
Whereas, staff have also been guided by the policy as adopted by the Town Board on March 10, 1997, via Resolution No. 53 of 1997 (Procedure for the Elimination of Second Dwelling Units
in Existing Buildings), and
Whereas, the Town Board, at a meeting held on June 24, 2024, reviewed a preliminary draft of the legislative language prepared by the Codes & Ordinances Committee, and
Whereas, at a meeting on June 24, 2024, the Town Board reviewed, discussed and revised the local laws and scheduled a public hearing forJuly8, 2024, at 5:30pm to hear all interested
parties on the proposed local lawentitledA Local Law Amending the Town of Ithaca Code, Chapter 270 Entitled “Zoning”, Regarding Accessory Dwelling Units,” and
Whereas, said public hearing was duly advertised, posted and held on said date and time and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition
to said proposed local law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, adoption of said local lawis aType II Action
pursuant to 6 NYCRR Part 617.5 (c)(26)“routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment”;and
6 NYCRR Part 617.5 (c)(33) “adoption of regulations, policies, procedures and local legislative decisions in connection with any action on this list,”and not subject to review under
SEQRA, and
Whereas, the Town Board finds it is in the best interest of the Town and its citizens to adopt the local law, now, therefore, be it
Resolved, that the Town Board hereby adopts said Local Law 6 of 2024, entitled “A Local Law Amending the Town of Ithaca Code, Chapter 270, entitled “Zoning,” Regarding Establishment
that a property no longer contains an Accessory Dwelling Units,” and be it further
Resolved, that the Town Board repeals Resolution No. 53 of 1997.
