HomeMy WebLinkAboutTB 2024-072 Increase Cost Mezzanine and Court Bathroom ProjectMEETING OF THE ITHACA TOWN BOARD July 8, 2024 TB Resolution 2024 -072: Authorization for the Town Supervisor to sign aContract Amendment with Bell & Spina Architects-Planners, PC for the Detailed Construction Drawings and Specifications Preparation Services associated with the Town Hall 2nd Floor Mezzanine and Court Office Renovation-Weatherization Project Whereas, the Town Board awarded a contract to Bell & Spina, Architects-Planners, PC (Bell & Spina) to create construction drawings, specifications, bid documents, and obtain associated permits to update/rehabilitate an unused portion of the Town Hall 2nd Floor Mezzanine and remove an existing bathroom within the Town Court Offices to allow for more useful space (Project) for a lump sum fee of $25,930 and travel reimbursable costs not to exceed $5,200 by TB Resolution 2023-076; and Whereas, the Town Board authorized the award and execution of a revised contract with Bell & Spina, incorporating weatherization items within the project documents for the areas to only displace workers once due to construction and to prevent damage to newly renovated areas by subsequent projects for a fee not to exceed of $77,811.00 and travel reimbursable costs not to exceed $5,500 by TB Resolution 2023-179; and Whereas, Wicks Law (Section 101of NYS General Municipal Law) was enacted to promote competitive bidding and provide full transparency in construction projects involving taxpayer dollars by mandating separate bids from the General Contractor, Electrical Contractor, Heating/Ventilation/Air Conditioning Contractor, and Plumbing Contractor when construction costs exceed $500,000; and Whereas, the Director of Engineering (Director) requested Bell & Spina complete a cost estimate in lieu of the exterior façade assessment to determine if Wicks Law requirements were applicable to this project; and Whereas,the Director received a cost estimate from Bell & Spina outlining overall construction costs exceeding the value of $500,000 requiring Bell & Spina to update plans and specifications to adhere to Wicks Law; and Whereas, Bell and Spina provided a proposal with a fixed fee of $11,490.00 for the additional services associated with updating the plans and specifications to conform to Wicks Law requirements; and Whereas, the Director has reviewed the proposal and recommends the contract be revised to incorporate the additional services and the fixed fee be increased by $11,490.00now, therefore be it Resolved,that the Town Board authorizes execution by the Supervisor of a contract amendment with Bell & Spina, Architects-Planners, PC, 215 Wyoming Street, Syracuse, NY, increasing the fixed fee to $89,301.00 and travel reimbursable costs not to exceed $5,500 and to modify the project scope to include the cost estimate performed by Bell and Spina, to remove the exterior façade evaluation, and to include the additional services associated with updating the plans and specifications for conformance to Wicks Law requirements, subject to approval of the contract documents by the Director and review by the Attorney for the Town.
