HomeMy WebLinkAboutTB 2024-077 Revised Approval of Encroachment License Renwick HgtsMEETINGOFTHEITHACATOWNBOARD July 22, 2024 TBResolution2024-77:ApprovalofEncroachmentLicense for23 Renwick Heights Road to Permit Encroachment of Portion ofBrick Staircase and Wooden Railing Whereas, Sarah Schneider Gunther and Amy Rose Krosch (“Owner”) are the owners of real property located at 23 Renwick Heights Road,Ithaca,NewYork14850,TaxMapParcelNo.17.-3.24(the“Premises”), as more particularly described in a WarrantyDeed to Owner from Lynn B.Hoshino dated May 3,2016, and recorded the same day in theTompkins County Clerk’s Office as Instrument Number 2016-04689, and Whereas, Renwick Heights Road isaTown road owned in fee, and Whereas, portions of a brick staircase and wooden railing on the Premises encroach into Renwick Heights Road, as shown on a survey of the Premises entitled “No. 23 Renwick Heights Road, Town of Ithaca, Tompkins County, New York," dated March 16, 2016, andprepared by Lee Dresser, Licensed Land Surveyor No. 050096, T.G. Miller P.C., Engineers and Surveyors (the “Survey Map”),and Whereas, Owner proposes to replace the encroaching portions of the brick staircase and wooden railing with replacements on the same footprint and location within Renwick Heights Road as they currently exist and as shown on the above-referenced Survey Map, and Whereas,theSuperintendentofPublicWorks hasdeterminedthat(1) thereisenoughroom on Renwick Heights Road for vehicles to pass safely and for the Town to perform road maintenance without disturbing the existing and proposed encroachments, and (2) due to the topography in the area of the encroachments, the Town is less likely to need to excavate that area in the future, so replacement of the encroaching portions of the brick staircase and wooden railing would not be detrimental to the Town’s interests,and Whereas, the Superintendent of Public Works has proposed an Encroachment License between the Town and Owner, and Whereas,theTownBoardisamenabletoenteringintotheproposedEncroachmentLicense to permit the conditional continued encroachment of the brick staircase and wooden railing as well as their proposed replacements,now,therefore,beit Resolved, that the Town Board of the Town of Ithaca hereby approves the Encroachment License to permit the conditional continued encroachment of the brick staircase and wooden railing as well as their proposed replacements on the same footprint and location within Renwick Heights Road as they currently exist and as shown on the above-referenced Survey Map, and authorizes the Town Supervisor to execute the Encroachment License on behalf of the Town, subject to the review of the Attorney for the Town.
