HomeMy WebLinkAboutTB 2024-083 LL Reso EV charging 08062024MEETING OF THE ITHACA TOWN BOARD August12, 2024 TB Resolution 2024-083: A Local Law Amending the Town of Ithaca Code, Chapter 270 Entitled “Zoning,” Regarding Electric Vehicle Charging Stations as uses Whereas, the PlanningCommittee, during meetings on June20, 2024, and July 18, 2024, respectively, along with Town staff, researched and considered legislative options for addressing issues associated with deployment of Electric Vehicle Charging Stations in the Town, and Whereas, staff have also been guided by the Green New Deal (GND) policy as adopted by the Town Board on March 23, 2020, as well as the 2014 Town Comprehensive Plan (specifically, Energy and Climate Protection Goals EC-1 and EC-4), and Whereas, the Town Board, at a meeting held on June 24, 2024, reviewed and discussed a preliminary draft of the legislative language prepared by Town staff, and Whereas, at a meeting on July22, 2024, the Town Board scheduled a public hearing forAugust12, 2024 at 5:30pm to hear all interested parties on the proposed local lawentitled“Amending Chapter 270 (Zoning) of the Town of Ithaca Code adding electric vehicle charging stations as uses,” and Whereas, notice of said public hearing was duly advertised in the Ithaca Journal, and Whereas, said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof, and Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, adoption of said local law is a Type I Action for which the Town Board of the Town of Ithaca, acting as lead agency in an environmental review with respect to adoption of this local law, on August12, 2024, made a negative determination of environmental significance, after having reviewed and accepted as adequate the Full Environmental Assessment Form Parts 1, 2 and 3; and Whereas, the Town Board finds that the proposed amendments to the Town Code will further the health and welfare of the community and are in accordance with the purpose of the Town of Ithaca Comprehensive Plan; now, therefore, be it: Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law 7 of 2024, entitled“Amending Chapter 270 (Zoning) of the Town of Ithaca Code adding electric vehicle charging stations as uses,” and be it further Resolved, that the Town Clerk is hereby authorized and directed to file said local laws with the Secretary of State as required by law.
