TB Resolution 2024-120: Authorizing the implementation, and funding in the first instance 100% of the federal-aid andState "Marchiselli" Program-aid eligible costs, of the East Shore
Drive Bicycle and Pedestrian Safety Corridor transportation federal-aid project, and appropriatingfunds therefore
Whereas, a Project for the TAP 2023 EAST SHORE DRIVE BICYCLE AND PEDESTRIAN SAFETYCORRIDOR, CAYUGA ST TO JAMES L GIBBS DR TOWN OF ITHACA, P.I.N. 395091 (the Project") is eligible forfunding
under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to beborne at the ratio of 80% Federal funds and 20% non-federal funds;and
Whereas, the Town of Ithaca desires to advance the Project by making a commitment of 100% of thenon-federal share of the costs of Preliminary Engineering/Design, Construction, and Construction
Inspection; and
Whereas, pursuant to New York State Environmental Quality Review Act (SEQRA) and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that this
is a Type II action because it constitutes reconstruction of in kind facilities on the same site, and thus, not subject to review under SEQRA.
Now, therefore, the Town Board of the Town of Ithaca, duly convened, does hereby
Resolve, that the Town of Ithaca Board hereby approves the above-subject project; and it is herebyfurther
Resolved, that the Town of Ithaca Board hereby authorizes the Town Supervisor to pay in the firstinstance 100% of the federal and non-federal share of the cost of Engineeringand Construction
work forthe Project or portions thereof; and it is further
Resolved, that the sum of $165,000.00 has been appropriated pursuant to the Ithacatown budget process and made available to cover the cost of participation in the Preliminary Engineering/Design
phases of the Project; and it is further
Resolved, that the additional sum of $1,268,000.00 is hereby appropriated pursuant to the Ithacatown budget process and made available to cover the cost of participation in the Construction/Construction
Inspection phases of the Project; and it is further
Resolved, that in the event the full federal and non-federal share costs of the project exceeds theamount appropriated above, the Town of Ithaca Board shall convene as soon as possible
to appropriate saidexcess amount immediately upon the notification by the Supervisor of the Town of Ithaca thereof, and it is further
Resolved, that the Town Supervisor of the Town of Ithaca be and is hereby authorized to execute allnecessary Agreements, certifications or reimbursement requests for Federal Aid and/or
Marchiselli Aid onbehalf of the Town of Ithaca with the New York State Department of Transportation in connection with theadvancement or approval of the Project and providing for the
administration of the Project and themunicipality's first instance funding of project costs and permanent funding of the local share of federal-aidand state-aid eligible Project costs
and all Project costs within appropriations therefore that are not so eligible,and it is further
Resolved, that a certified copy of this resolution be filed with the New York State Commissioner ofTransportation by attaching it to any necessary Agreement in connection with the Project,
and it is further
