TB Resolution 2025 - 084: Adoption of Local Law 11 of 2025, Entitled “A Local Law Amending Town of Ithaca Code Chapter 270, Zoning, Article XXVI, Special Regulations, Regarding Short-Term
Rental Use Regulations in the Conservation Zone”
Whereas, on December 29, 2021, the Town Board adopted Local Law 16 of 2021: Adding Short-Term Rental Provisions to Chapter 270, Zoning, of the Town of Ithaca Code; and
Whereas, the Short-Term Rental Provisionsbalance the desire of some property owners to rent all or a portion of their homes to generate income to defray the cost of homeownership, with
the Town’s obligation to protect the public health, safety, and welfare of the full-time residents in the Town; and
Whereas, the Planning Committee reviewed maps and draft languageat their meetings on November 21, 2024, January 16, 2025, March 20, 2025, April 17, 2025, and May 29, 2025, and referred
the draft to the Town Board; and
Whereas, the proposed revisions were discussed at the June 23, 2025, Town Board meeting; and
Whereas, onJuly 14, 2025,the Town Boardscheduled a public hearing to be held by said Board on August 11, 2025,at 5:30 p.m., to hear all interested parties on the proposed local law;and
Whereas, said public hearing was duly advertised and held on said date and time and all parties in attendance were permitted an opportunity to speak regarding said proposed local law,
or any part thereof; and
Whereas, pursuant to the New York State Environmental Quality Review Act (“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, adoption of said local law is an Unlisted Action
for which the Town Board of the Town of Ithaca, acting in an uncoordinated environmental review with respect to adoption of this local law, on August 11, 2025, made a negative determination
of environmental significance, after having reviewed and accepted as adequate the Short Environmental Assessment Form Parts 1, 2 and 3; and
Whereas, the Town Board finds that the proposed amendments to the Town Code will further the health and welfare of the community and are in accordance withthe purpose and legislative
intent of the Short-Term Rental Provisions of Chapter 270, and the Town of Ithaca Comprehensive Plan; now, therefore, be it:
Resolved, that the Town Board of the Town of Ithaca hereby adoptsLocal Law 11 of 2025, “A Local Law Amending Town of Ithaca Code Chapter 270, Zoning, Article XXVI, Special Regulations,
Regarding Short-Term Rental Use Regulations in the Conservation Zone.”Moved: Susie GutenbergerSeconded: Eric Levine Vote: ayes – Gutenberger, Levine, Howe, DePaolo and Johnson
