HomeMy WebLinkAboutTB 2025-087 Approval of Cleanup Plan 172 Calkins RdMEETING OF THE ITHACA TOWN BOARD August 11, 2025 TB Resolution 2025 - 087: Approval and authorization for the Director of Code Enforcement to execute a Compliance and Remediation Plan for 172 Calkins Rd., Ithaca New York Whereas: For several years, the Town has received multiple complaints regarding property maintenance violations at 172 Calkins Rd., and Whereas: On January 30, 2024, an inspection of 172 Calkins Rd was conducted by the Director of Code Enforcement (Director) and violations of the Town’s Property Maintenance Law were found, and Whereas: The Director composed and mailed a certified letter to the owner identifying the violations found pursuant to the Town’s Property Maintenance Law (Chapter 205) and the applicable NYS Property Maintenance Code, and Whereas: The owner signed for receipt of the certified letter and called the Director to discuss said letter, stating that he would clean up the property by the end of Summer in 2024, and Whereas: Follow up inspections by the Director were conducted on February 5, 2024, February 28, 2024, April 9, 2024, April 30, 2024, May 22, 2024, July 15, 2024, August 16, 2024, which showed no progress had been made in addressing the violations, and Whereas: On August 16, 2024, the Director personally delivered and sent via certified mail, a “Failure to Maintain Property Notice” (Notice) indicating the deadline date to remove all violations on the property or the option to request a hearing before the Town of Ithaca Zoning Board of Appeals within 15 days of the date of mailing of the Notice, and Whereas: No hearing request was made and follow up inspections were conducted by the Director on September 5, 2024, September 16, 2024, September 23, 2024, October 29, 2024, November 18, 2024, and December 16, 2024, where progress appeared to be being made towards addressing the violations stated in the Notice, and Whereas: Follow up inspections were then conducted by the Director on January 31, 2025, February 24, 2025, April 10, 2025, June 16, 2025, and June 30, 2025, where the owner appeared not to have made any further progress towards addressing the violations stated in the Notice, and Whereas: Town Code Chapter 205 requires that upon the failure of the property owner to remove all violations or request a hearing before the Town’s Zoning Board of Appeals by the prescribed date, the Director shall cause a Compliance and Remediation Plan (Plan) to be presented and approved by the Town Board, now, therefore be it Resolved: that the Town Board approves the Compliance and Remediation Plan reviewed on August 11, 2025, and authorizes the Director to proceed with the Plan.
