Per Ithaca Town Law Chapter 205 Property Maintenance 205-2 Prohibited Acts. A. (1) (f) Any automobile, truck, or other vehicle originally intended for use on the public highways which is no longer intended or in condition for legal use on the public highways, including such vehicles which are in a state of disrepair or otherwise dilapidated, broken, or abandoned. For the purpose of this subsection, a vehicle shall be presumed to be no longer intended or in condition for legal use on the public highways if any of the following apply: [1] It does not bear and display upon such vehicle, in a location prescribed by the Commissioner of Motor Vehicles, a current registration from the State of New York or other recognized registering jurisdiction; or [2] It does not bear and display upon such vehicle, in a location prescribed by the Commissioner of Motor Vehicles, an inspection certificate issued within the last 12 months in accordance with the laws of the State of New York or the laws of any other recognized inspecting jurisdiction if required for use on public highways; or [3] Such vehicle is not able to be moved by its own power. Parts/old I scrap vehicles. 2 DOT wheelchair vans. 12 miscellaneous old vans,wheelchair vans and sedans used for parts scavenging. Wheelchair vans are difficult to buy,so I try to get them as viable ones become available.For the other cars we could get away with 2-3 spares.We could reduce the car parts to about six. So for non-active cars,we would be looking at 5 wheelchair vans,5 spare cars,7 parts cars.So we need about 17 'inactive'cars to keep the operation going.Then there are the miscellaneous circumstances like now where we have two damaged vehicles that can be repaired and put back on the road.So probably 18 inactive cars is about the minimum viable amount for us. The applicant also requests approval for a total of 50 vehicle parking spaces on the property to accommodate Brotherton, a commercial tenant, and residential tenants in the front house. Due to the complementary schedules of these uses—Brotherton’s operating hours, Collegetown Cab’s deployment patterns, and residential tenants’ work schedules—the actual vehicle count on the property is frequently approximately half this number at any given time. Collegetown Cab operates a non-emergency medical transportation (NEMT) service that provides critical healthcare access to residents of Tompkins County and surrounding areas, including wheelchair-accessible transportation for mobility-impaired patients. The company has operated from this location since 2017 with the same operational model and a fleet that has actually decreased in size over that period. This variance request was triggered solely by a routine building permit application for an unrelated tenant improvement, which led to a Code Enforcement inspection that identified vehicles in the rear parking area. In eight years of operation, no complaints have ever been received regarding the vehicles on this property. This narrative demonstrates that the applicant satisfies all four criteria required for a use variance under New York law. Additionally, the applicant notes that Town Code Section 205- 2(B) may provide an alternative basis for approval, as the vehicles are stored in a manner that renders them substantially not visible to neighboring properties or from the highway. The applicant could potentially install additional screening to achieve full compliance with that exemption, though such fencing would represent a significant expense that the applicant would prefer to avoid if the Board finds the use variance criteria satisfied. 1. THE APPLICANT CANNOT REALIZE A REASONABLE RETURN Business Operations and Revenue Collegetown Cab generates approximately $1.3 million in annual revenue from medical transportation services. Of this, approximately $195,000 (15%) comes from wheelchair- accessible transportation—a service that is operationally difficult and expensive to provide, and which no other private operator in Tompkins County is willing to perform. The business operates a fleet of 19 actively registered and insured vehicles. Medical transportation requires absolute reliability; patients cannot miss dialysis appointments, chemotherapy sessions, or other time-sensitive medical care. To maintain this reliability, the business must keep approximately 5-6 reserve vehicles ready for immediate deployment when an active vehicle experiences mechanical failure, and approximately 6-8 vehicles as parts sources for rapid repairs. Operational Necessity of On-Site Vehicle Storage The nature of medical transportation creates unique operational requirements that make on-site vehicle and parts storage essential: Immediate Vehicle Replacement: When a vehicle fails mid-shift, drivers must be able to swap to a reserve vehicle within minutes to continue serving patients. Medical appointments—particularly dialysis, chemotherapy, and other time- sensitive treatments—cannot be rescheduled on short notice. A patient stranded due to vehicle breakdown faces serious health consequences. Rapid Repair Capability: When a vehicle is taken out of service for repair, the on- site mechanic must be able to diagnose the problem and obtain parts immediately. Having parts vehicles on-site allows the mechanic to quickly source components and return vehicles to service, often within hours rather than days. This rapid turnaround is essential to maintaining fleet capacity. Mechanic Access: The mechanic requires quick and easy access to both the vehicles needing repair and the parts vehicles. Shuttling vehicles or parts from a remote storage location would make same-day repairs impossible and dramatically increase vehicle downtime, directly compromising the company's ability to serve patients. Financial Impossibility of Compliance Commercial vehicle insurance for for-hire passenger vehicles costs approximately $8,000 per vehicle per year. Maintaining registration and insurance on reserve and parts vehicles would add approximately $88,000-$112,000 in annual costs (11-14 additional vehicles × $8,000), which would eliminate the business's operating margin and render continued operation financially impossible. The applicant conducted extensive research for alternative off-site vehicle storage through Facebook Marketplace, Google, and Craigslist. No comparable commercial vehicle storage exists in the Ithaca area—available options are limited to student parking near Cornell, which is entirely unsuitable for fleet operations requiring immediate mechanic access. If unable to maintain reserve and parts vehicles on-site, the applicant would be forced to cease operations entirely. This would result in complete loss of the $1.3 million business and elimination of the only wheelchair transportation provider in the county—a substantial financial hardship by any measure. 2. THE HARDSHIP IS UNIQUE TO THIS PROPERTY The circumstances giving rise to this variance request are unique to Collegetown Cab and do not apply to a substantial portion of the Light Industrial district. Collegetown Cab is the only non-emergency medical transportation provider in Tompkins County that provides wheelchair-accessible transportation. This has been confirmed by Medicaid transportation brokers. When Bangs Ambulance discontinued wheelchair transportation services because it was no longer financially viable for them, they specifically contacted Collegetown Cab to confirm the company could absorb their patient load, as no other operator was willing or able to do so. The only alternative is Gadabout, a public bus service that lacks the hours, flexibility, and capacity for on-demand medical transportation. The operational requirements of a medical transportation fleet—specifically the need for immediate vehicle replacement, on-site repair capability, and ready access to parts—are not shared by typical Light Industrial uses. A manufacturing facility or warehouse does not require a pool of reserve vehicles ready for instant deployment or a parts inventory for rapid mechanical repairs. This unique operational necessity creates a hardship specific to this property and this use. Furthermore, the 1.755-acre property is uniquely situated. It is bounded by woods on three sides and an open field on the fourth, with no residential neighbors. The gravel parking area where vehicles are stored is located behind the main building, screened from Elmira Road and neighboring properties. The specific configuration of this parcel—large lot, natural screening, rear parking area, Light Industrial zoning—makes it uniquely suited for this use while minimizing any potential impact. 3. THE VARIANCE WILL NOT ALTER THE ESSENTIAL CHARACTER OF THE NEIGHBORHOOD The property is located in a Light Industrial (LI) zoning district on Elmira Road, a commercial and industrial corridor. The surrounding area includes commercial buildings, the Veterans Volunteer Fire Association property, and undeveloped land. There are no residential properties in the immediate vicinity. The vehicles in question are stored in a gravel parking area at the rear of the property. The property totals 1.755 acres, providing ample space for vehicle storage without crowding. The parking area is substantially screened from view by the main building and by natural tree cover. If required by the Board, the applicant could install additional fencing to further obscure the vehicles from any potential sight lines, though such fencing would represent a significant expense. The vehicles do not create any environmental hazard. They are not leaking fluids, do not generate noise, and simply sit quietly in the rear lot. Vehicle count fluctuates significantly—on evenings and weekends when vehicles are deployed for medical trips, the on-site count is often 50% lower than during weekday business hours. It should be noted that the 40 vehicles counted during the January 2026 inspection included vehicles on the property that are unrelated to Collegetown Cab’s operations. As described in the Introduction, the applicant is requesting variance approval for 35 Collegetown Cab parking spaces in the rear and a total of 50 spaces property-wide to accommodate Brotherton, a commercial tenant, and residential tenants. Collegetown Cab has operated from this location with this operational model since 2017—eight years—without a single complaint from neighbors or any enforcement action. The current situation arose only because a building permit application for an unrelated tenant triggered an inspection. This eight-year track record demonstrates that the use has not altered, and will not alter, the essential character of the neighborhood. 4. THE HARDSHIP HAS NOT BEEN SELF-CREATED The alleged hardship is not self-created. Documentary evidence demonstrates that Collegetown Cab's fleet size has actually decreased since moving to this location. Insurance records from January 2018 (attached as Exhibit A) show that Collegetown Cab had 23 registered vehicles in its commercial fleet at that time. The company currently operates 19 registered vehicles—a reduction of approximately 17%. Far from expanding operations or creating a new hardship, the company has reduced its registered fleet since establishing operations at this location. This reduction occurred because Uber began operating in Ithaca in 2016, which significantly impacted the traditional taxi business. The company pulled vehicles off the road and would have reduced further if not for the growth in medical transportation services. The current fleet composition—active vehicles plus reserves and parts vehicles—represents the minimum necessary for continued operation, not any expansion or self-created condition. The need to maintain reserve and parts vehicles is inherent to operating a medical transportation fleet, not a choice made by the applicant. Patients depend on reliable transportation to life-sustaining medical appointments. The operational structure that requires on-site vehicle availability was established before the company moved to this location and has remained consistent. No action by the applicant created or exacerbated this condition. 5. GRANTING THE VARIANCE SERVES THE COMMUNITY INTEREST While not a formal criterion, the Board should consider that granting this variance serves important community interests. Collegetown Cab serves over 30 wheelchair-dependent individuals each month who rely on the company for transportation to medical appointments. These patients include dialysis patients who require transportation three times per week, cancer patients receiving chemotherapy, elderly residents accessing routine medical care, and individuals with mobility impairments who have no other transportation options. Medicaid brokers have confirmed that Collegetown Cab is the only operator in Tompkins County and surrounding areas willing to provide wheelchair transportation. When Bangs Ambulance exited this service, they specifically coordinated the transition with Collegetown Cab because no alternative existed. If Collegetown Cab were forced to cease operations, these vulnerable community members would lose access to essential medical care. The applicant is prepared to provide letters of support from patients, families, and medical facilities to demonstrate the critical nature of this service to the community. 6. ALTERNATIVE BASIS FOR RELIEF: SECTION 205-2(B) EXEMPTION Town Code Section 205-2(B) provides that storage of vehicles "shall not be a violation of this chapter" if "they are stored in such manner that they are not visible to neighboring properties or from a highway." The applicant's vehicles are currently stored in a rear gravel parking area that is substantially screened from view by the main building and natural tree cover. The property is bounded by woods on three sides and an open field on the fourth, with no direct sight lines from Elmira Road or neighboring properties to the vehicle storage area. If the Board determines that additional screening is required to satisfy the Section 205-2(B) exemption, the applicant could potentially install fencing to ensure the vehicles are fully not visible. However, such fencing would represent a significant expense, and the applicant respectfully requests that the Board grant the use variance as the primary relief, reserving the fencing requirement only if the Board determines the variance criteria are not satisfied. The applicant welcomes guidance from the Board on which approach—use variance or Section 205-2(B) compliance through screening—the Board considers most appropriate under the circumstances. Parts/old I scrap vehicles. 2 DOT wheelchair vans. 12 miscellaneous old vans,wheelchair vans and sedans used for parts scavenging. Wheelchair vans are difficult to buy,so I try to get them as viable ones become available.For the other cars we could get away with 2-3 spares.We could reduce the car parts to about six. So for non-active cars,we would be looking at 5 wheelchair vans,5 spare cars,7 parts cars.So we need about 17 'inactive'cars to keep the operation going.Then there are the miscellaneous circumstances like now where we have two damaged vehicles that can be repaired and put back on the road.So probably 18 inactive cars is about the minimum viable amount for us.
