Ordinary High Water Level in Town of Ithaca Code, Chapter 270, Zoning.
Whereas, a public hearing was ðuly called, advertised and held on January 12, 2026, regarding the
proposed local law Amending the definition of Ordinary High Water Level in Town of Ithaca
Code, Chapter 270, Zoning, anð
Whereas, pursuant to the New York State Environmental Quality Review Act (SEQRA) and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval of the Ioca1 law is a Type 11 action because it constitutes routine or continuing agency
aðministration and management, not including new programs or major reorðering ofpriorities that
may affect the environrnent, and therefore this action is not subject to review under SEQRA, now
thefefore be it
Resolved that the Town Board adopts Local Law 1 of 2026 Amending the definition of
Ordinary High Water Level in Town oflthaca Code, Chapter 270, Zoning.

LOCAL LAW NO. 1 OF THE YEAR 2026
A LOCAL LAW AMENÐING THE DEFINITION OF ORDINARY HIGH WATER LEVEL
IN TOWN OF ITHACA COÐE CHAPTER 270, ZONING
Be it enacted by the Town Board ofthe Town oflthaca as follows:
Scction 1. Chapter 270 (Zoning), Article 111 (Terminology) ofthe Town oflthaca Code,
Section 270-5 (Definitions), is amended by replacing the definition of Ordinary High Water
Level with a new definition reading as follows:
The ordinary high water level for Cayuga Lake is the value for Cayuga Lakes
Mean High Water Elevation shown in the table in 6 NYCRR § 608.11(a), as it
may be amended frûm time to time.
Section 2. In the event that any portion ofthis law is declared invalid by a court of
competent jurisdietion, the validity of the remaining portions shall not be affected by such
ðeclaration of invalidity.
Section 3. This local law shall take effect immediately upon its filing with the New York
State Secretary ofState.
