Magnitude: Medium; approximately 2,000 cars on average per day, according to the 2007 Transportation Plan. Seasonal: Year round. More of Cornell and even Cayuga Lake may be visible in winter. Near View: The near view is composed of an older, period architecture home, behind which a hayfield is bordered by woods that descend to Six Mile Creek. Mid View: The mid view consists of the wooded southern side of East Hill. Little development appears until further north when the Cornell skyline abruptly appears. Development that is visible is of muted color and does not stand out. A communication tower is on the hilltop but is not prominent. Far View: A view of Cornell, including the clock tower, as well as farm fields on West Hill beyond. Aesthetic Significance: This view was a candidate view in the Tompkins County Scenic Resources report, one of the 110 candidates out of 593 views. East Ithaca Recreation Way Location: At the main entrance to the Hannah Pew trail on Joanne Drive in the Eastern Heights neighborhood. Direction: Southwest, approximately between 270° and 300°. Magnitude: Low. Eastern Heights is a small, suburban style neighborhood with no through traffic. The Recreation Way is open to foot and bicycle use only. Seasonal: Year round. It may be enhanced in the winter. Near View: The near view consists of the gazebo and walkway surrounded by shrubs and trees. The topography begins to drop quickly just in front of the gazebo. Mid View: The mid view is comprised of South Hill, which appears predominantly wooded in the summer, with little visible development except for Ithaca College. Ithaca College’s towers serve as a dramatic focal point. Also visible is the Ithaca College Athletic and Events Center as well as a tall telecommunications tower further up on South Hill. Far View: The far view is composed of West Hill, including the Bostwick Road farms. Beyond are the hills of Enfield and Newfield. Aesthetic Significance: This view is remarkable for the vivid view of Ithaca College and South Hill. The composition with the park and gazebo in the foreground and the Bostwick Road area and distant hills in the background creates a refreshing view. Aesthetic Discord: The tower on the Ithaca College Athletic and Events Center is distracting and incongruous. The telecommunications tower is also somewhat distracting but is relatively thin and solitary and thus does not overwhelm the landscape. The project also includes installing two inverter/transformer equipment pads, solar energy battery storage, new overhead utility (NYSEG) interconnects and poles, eight-foot tall fencing, stormwater management facilities, access drive, and other site elements. The project is located in the Low-Density Residential Zone, in the Large-Scale Photovoltaic Solar Energy System Overlay District, which permits large scale systems with Site Plan Approval by the Planning Board. The Planning Board reviewed a sketch plan for the proposal on March 3, 2026. The proposed action is a Type I Action, pursuant to 6 NYCRR Part 617 (State Environmental Quality Review), because the project includes an action that involves the physical alteration of 10 acres (617.4 (c)(6)(i)). The project is also a Type I Action pursuant to the Town of Ithaca Town Code Chapter 148, Environmental Quality Review, because it involves the authorization of industrial or commercial uses within a residential or agricultural district applying to a parcel of land of 10 or more acres (148.5.A (1)). The Planning Board declared their intent to be the Lead Agency in the environmental review of this project on March 3, 2026. The Zoning Board of Appeals is an Involved Agency in the coordinated review and will be responsible for considering variances for the project relative to the amount of clear-cutting proposed for the project (Town Code, §270-5, and §270-219.1.G(2)(c)[5][b]). This is described in #1 and #7 below. 1. Impact on Land a. The proposed action may involve construction on land where the depth to water table is less than 3 feet. b. Briefly describe the impact on land: The 62+/- acre parcel on Troy Road is maintained as a mix of open fields, meadow, brush, and wooded areas. The majority of the property is gently sloping, with streams located in the southeast and northeast corners, respectively. There are two overhead NYSEG 2 power lines that bisect the property and run towards the existing NYSEG substation on East King Road to the south. The parcel is bound on the north by vacant land and residences near the intersection of Troy and Coddington Roads, on the east by vacant land and residences along Coddington Road, on the south by the utility’s substation and residences along East King Road, and on the west by Troy Road. The overall property contains very few areas with slopes that exceed 15%, as more than 75% of the property contains 0-10% slopes. The entirety of the solar array footprint will reside in areas with slopes 10% or less, with the majority of the array footprint located in areas with slopes 5% or less. According to the EAF Part 1, this property contains a somewhat shallow depth to bedrock and depth to water table in some areas. The soils are also poorly drained. While this would make for less than ideal conditions for construction of structures (e.g. residences, buildings, etc.), it will not create significant environmental impacts for the installation of the proposed solar array. In terms of erosion and physical disturbance, there will be limited ground disturbance and grading associated with the project. The solar array will be constructed on a post and rack system with pile-driven posts, and panels elevated off the ground, so the array itself will cause minimal ground disturbance. This will significantly limit overall site disturbance and will only result in about 1.41+/- acres of impervious surface over the 31+/- acre portion of the property that will be utilized for the solar project. The area underneath and surrounding the panels will be vegetated and will be managed via mowing. Most of the site disturbance will be associated with the installation of the equipment/battery storage pads, gravel access roads, and stormwater management facilities. The project site will be fenced, and special care will be taken to avoid wetlands that are on the site. Additional details relating to wetland and stream mitigations are discussed in #’s 3 and 5 below. Additional information associated with vegetation loss is discussed in #7 below. Based on the above information, impacts identified in this section can be considered small in magnitude. 3. Impacts on Surface Water (description of impact is grouped with #5 below) d. The proposed action may involve construction within or adjoining a freshwater or tidal wetland, or in the bed or banks of any other water body. h. The proposed action may cause soil erosion or otherwise create a source of stormwater discharge that may lead to siltation or other degradation of receiving water bodies. i. The proposed action may affect the water quality of any water bodies within or downstream of the site of the proposed action. 5. Impact on Flooding d. The proposed action may result in, or require, modification of existing drainage patterns. Briefly describe the impact on surface water and flooding: Waterbodies within or downstream of the site: There are wetlands on the property that have been delineated and are included on all of the plans associated with the solar project. The project will avoid wetlands to the greatest extent possible. The access road, equipment pad, and other structures are largely located around the wetlands. There will be no digging or trenching within any wetlands, which will further mitigate impacts. The application materials include correspondence between the applicant and the NYSDEC, indicating that the wetlands are non-jurisdictional and would not require 3 permits from the NYSDEC (letter to Dustin Bradley, LaBella Associates, dated 6/04/2025). The NYSDEC Lead Agency response letter has also noted that the project site is not within a New York State protected Freshwater Wetland. It is unclear if the Army Corps of Engineers (ACOE) will require a Nationwide Permit for work within or near the wetlands. The applicant has submitted an application to the ACOE but has not yet heard back. Given the limited disturbance to the wetlands, it is not anticipated that the ACOE will require mitigations that will change the site layout or project scale. In addition to the wetlands, there are two DEC-regulated Class A streams on the property. One stream is located along the northeast corner of the property, and one is located along the southeast corner of the property. Neither waterbody will be directly impacted by the proposal (the applicant has moved proposed array away from the northeastern stream). Any potential indirect impacts will be mitigated with the proposed stormwater management practices noted below. The NYSDEC has indicated that a Stream Disturbance Permit could be required for the project. The Planning Board should condition final approvals on the applicant obtaining all necessary NYSDEC and/or ACOE permits for the project. Soil Erosion, Water Quality, Water Quantity, & Flooding: According to application materials, there is minimal ground disturbance associated with this project and only approximately 1.41+/- acre of impervious surface will be created. The solar array is on a rack system that is elevated off the ground, and the proposed equipment/battery pads and access roads will require minimal grading. To mitigate soil migration offsite, the applicant proposes installing silt fencing around the site, creating a stabilized construction entrance, and performing temporary soil stabilization. Permanent stormwater management devices will be installed to maintain sheet flow conditions on the site and to maintain pre-condition drainage patterns and peak discharge rates. After construction, the disturbed areas will be seeded with locally appropriate seed mix to prevent soil damage, promote deep root growth, and provide permanent soil stabilization. The applicant proposes to install grass filter strips along the equipment/battery storage pads and access road to provide water quality treatment of stormwater runoff that is generated by the proposed project. These and other practices are described in the Stormwater Pollution Prevention Plan (SWPPP) that was submitted to the Town’s Engineering Department for their review and approval. The Engineering Department has reviewed the SWPPP for the project and deemed the proposed SWPPP to be conceptually acceptable in terms of mitigating environmental impacts related to stormwater. According to the letter from the Town’s engineering consultant, the project will require a specific landscaping plan for the bioretention basin, updated calculations, clarifications of terms, and other items (see application materials, Barton & Loguidice letter dated August 19, 2026, to Justin McNeal, Director of Engineering). Revised materials and calculations should be submitted prior to final site plan approval to ensure that the project is in conformance with applicable local and state stormwater regulations. Based on the above information, impacts identified in this section can be considered small in magnitude. 4 7. Impact on Plants and Animals a. The proposed action may cause reduction in population of loss of individuals and threatened or endangered species, as listed by New York State or the Federal government, that use the site, or are found on, over, or near the site. b. The proposed action may result in the reduction or degradation of any habitat used by any rare, threatened, or endangered species, as listed by New York State or the federal government. Briefly describe the impact on plants and animals: There will be approximately 17+/- acres of tree and vegetation removal associated with this project (evaluated in the SWPPP noted above). The application materials include a “NLEB and Glaucous Sedge Habitat Assessment Memo,” prepared by LaBella, dated July 17, 2026. The report indicates that the property contains red maple, northern red oak, white oak, shagbark hickory, white pine, and white ash trees. The summary of findings from the report indicates that there is suitable habitat and roost trees on the property for the northern long- eared bat (NLEB) and the tri-colored bat. The NLEB is an endangered species listed by both United States Fish & Wildlife Service (USFWS) and the New York State Department of Environmental Conservation (NYS DEC). Both bat species live and roost in dead and live trees with exfoliating bark, tree cavities, crevices, hollows of trees greater than 3 inches DBH, leaf clusters, and Spanish moss. Per the findings “All suitable habitat trees found were dead, dying, or alive with hollows, crevices, or peeling bark. Each tree had a DBH greater than 3 inches with some greater than 50 inches.” The report contains a figure (Figure 1) and photo log that shows the locations on the site where suitable habitat exists. Most of these areas are the same areas proposed for clearcutting to accommodate the solar project. The LaBella study also noted that there is suitable habitat for two threatened plant species listed by the NYS DEC. The glaucous and reflexed sedges are both associated with red maple, white ash, white pine, northern red oak, white oak trees. The report, which was completed in January, did not find the presence of either sedge on the property but mentioned that "the presence of these species may need to be confirmed during the growing season, between May and July.” This has been added as a condition of approval for the Planning Board to consider, should the board approve the solar project. The application materials contain letters issued by the (USFWS), dated 05/29/2026, that determine that the project will “NLAA” (Not Likely To Adversely Affect) the potential NLEB and tri-colored bat habitats. However, both the LaBella study and the USFWS documents recommend taking the following conservative precautions: Minimize clearing- leave as many potential roosts as possible, including snag and cavity trees Either all site disturbance should take place between Nov. 1 and March 31, or an acoustic bat survey should be conducted between May 15 and August 15 to determine presence or possible absence of bats If any roosts are discovered after March 31, then no tree cutting during pup season (July 1- Aug 15) The Planning Board should discuss these mitigations with the applicant at the meeting. The applicant is aware of the potential presence of NLEB habitat and understands that there may be the need for additional precautions. The attached draft resolution contains a condition for the board to consider, should the board approve the solar project. According to the solar provisions in Town Code (§270-219.1.G(2)(c)[5][b][i]), “removal of trees and other existing vegetation shall be limited to what is necessary for the construction, operation and 5 maintenance of the photovoltaic solar energy system” and “clear-cutting shall not occur on more than 20% of 10 acres on the lot, and clear-cutting shall not occur on more than 10% of the balance of the acreage on the lot.” The Director of Code Enforcement issued a letter to the applicant during the sketch plan review stage (dated 5/7/26), requesting clarification on the proposed tree clearing for the project to determine if any variances from Town Code were necessary. In the letter, the clear-cutting evaluations for this project were established as follows (considering the whole 62+/- acre parcel): For the first 10 acres: 20% allowable clear-cutting = 2.0 acres Remaining acreage (52.01 acres): 10% allowable clear-cutting = 4.201 acres Total clearcutting permitted = 6.201 acres Application materials show “tree clearing and grubbing area” totaling approximately 23.16 acres (Sheet C100). The letter from the Code Enforcement Office required the submittal of “a detailed tree survey, identifying all trees measuring 6 inches or greater DBH and the extent of canopy removal.” The applicant has instead applied for a variance from the Zoning Board of Appeals to clear-cut 23+/- acres, which is around 17+/- acres more than what is permitted by Town Code. As the Zoning Board of Appeals is required to grant the minimum variance necessary for the project, this could be considered a significant variance request. The lack of a tree survey, combined with the presence of potential NLEB habitat and the proposal to clear-cut three times the acreage permitted by zoning might result in potential negative environmental impacts to an endangered species whose habitat could exist on the property. The Planning Board should discuss this with the applicant at the meeting. The project includes a wildlife-friendly, wire mesh fence that will surround the acreage associated with the solar array. The fence is required to be designed to allow the passage of small animals and reptiles. The fence will impact large animals (coyote, deer) by forcing them to go around the fenced area. However, the fence is not expected to impact animal migration patterns or break up any known ecological/wildlife corridors. The project also includes seeding the site with a grazing and pollinator-friendly seed mix that will promote foraging and pollinator habitat in the project area. The project will apply EPA and DEC- compliant herbicide use that is specific to targeting invasive species that may encroach on the property. The pollinator seed mix should contain plants preferred by the monarch butterfly, which is currently a proposed threatened species by USFWS; and the proposed herbicide should not be harmful to pollinators. Based on the above information, impacts identified in this section can be considered moderate in magnitude. The Board should consider requiring the mitigation measures mentioned above to reduce environmental impacts on potential NLEB and tri-colored bat habitats and sedge species. 9. Impact on Aesthetic Resources c. The proposed action may be visible from publicly accessible vantage points (seasonally or year-round) Briefly describe the impact on aesthetic resources: The solar array will be installed at least 300 feet into the property off of Troy Road. The frontage will be screened with a row of conifer trees, planted 6 and maintained by the applicant. Aesthetic and/or visual impacts are limited to those traveling along the road, or from looking in the direction of the array from across the road. Although the project will be viewable from Troy road, the project will be hidden behind trees and vegetation along the Coddington and King Road East road frontages. The Town of Ithaca and Tompkins County have established Scenic Resources Inventories that identify significant views in the South Hill area. Troy Road is not a designated federal or state scenic byway. There are no scenic views in the project area listed in the county inventory, but there are scenic views listed in the town inventory. Views “21” and “22” (attached to the EAF Part 1) are listed in the Town Scenic Resource Inventory but are not considered “gateway” or “significant” views. View 21 is located along Coddington Road. View 22 is located within the Eastern Heights Park on east hill and is the view from the park pavilion. The project will not impact these views, as it will not be visible from these viewpoints. The viewshed analysis provided by the applicant illustrates this, particularly in figures C- 2k, C-2l, C-2q, and C-2r. Therefore, there are no identified scenic resources around the project site that would be impacted by the proposed development. The project will mitigate impacts to immediate views along Troy Road with proposed conifer trees, which will provide year-round screening. Based on the above information, impacts identified in this section would be considered small in magnitude. 14. Impact on Energy a. The proposed action will require a new, or an upgrade to an existing substation. Briefly describe the impact on energy: The proposed project is located along an existing electric distribution line and is in one of the few locations in the Town of Ithaca that have been identified in the Solar Law (Town Code §270-219.1) as being appropriate for large-scale solar facilities. The applicant has obtained approval from NYSEG to connect the new solar facility to the distribution grid to NYSEG’s South Hill Substation. The plans do not show installation of any new utility poles along Troy Road to accommodate the project. The proposed solar project will reduce the amount of fossil- fuel generated electricity that is produced and needs to be moved across transmission and distribution lines, which will result in a reduction in greenhouse gas emissions. Based on the above information, impacts identified in this section would be considered small in magnitude. 15. Impact on Noise and Light a. The proposed action may produce sound above noise levels established by local regulation. f. Other impacts: The project includes lighting that must comply with the Town of Ithaca Code, Chapter 173, Outdoor Lighting. Briefly describe the impact on noise and light: The project will create noise impacts during construction of the solar array and related infrastructure. These impacts will be temporary and will cease once the project is completed. The project materials include a glint and glare study with more than 40 observation points. The study indicated that some travel routes might experience some “green” glare from the proposed facility. According to the study, green glare is defined as “glare with a low potential to cause flash blindness” 7 (as opposed to yellow or red glare, which has potential to cause temporary or permanent flash blindness, respectively). Planning staff conducted a site visit along these travel routes on a sunny day in late July and discovered that the model in the glint and glare study did not consider existing topography, structures, or vegetation (page 6 of the study does state that “vegetation was not fully modeled in the analysis, and existing or future vegetative conditions may further reduce visibility of the array.”) Staff noticed particular discrepancy after traveling along Route 4- King Road East and Ridgecrest Road, which is listed in the study as the route with the “greatest modeled exposure.” Route 4 contains rolling hills, residences/other buildings, and thick vegetative screening. Staff concluded that the proposed solar array would be completely blocked by buildings, trees, and other structures along this routes, and that there are, in fact, no publicly travelled routes that will experience glare from the solar project. The project may include safety lighting associated with the equipment/battery storage units. The plans do not show installation of any new NYSEG utility poles along Troy Road to accommodate the project. However, any proposed outdoor lighting will be required to comply with the provisions of Town of Ithaca Code Chapter 173, Outdoor Lighting. The Code contains provisions related to glare and dark-sky compliancy. Based on the above information, impacts identified in this section would be considered small in magnitude. 18. Consistency with Community Character f. Proposed action is inconsistent with the character of the existing natural landscape. Briefly describe the impact on community character: The project site is a mix of open fields, meadow, brush, and wooded areas, with two overhead NYSEG power lines that bisect the property. The proposed solar array – or any other type of development on the site - would be in contrast with the character of the existing natural landscape. However, the proposed solar array will be located at least 300 feet from Troy Road and will contain a line of conifer trees along the frontage that will screen its view along the road. The property is surrounded by thick vegetation outside of the project area that will be preserved and will screen the array from the rear yards of residences that abut the property on Coddington Road and King Road East. The project also includes a decommissioning plan that will restore the land back to its prior use if there is (1) a lack of solar production for six continuous months, (2) a lack of a current local permit, (3) failure to maintain any required decommissioning bond or other security, and (4) a violation of any site plan conditions or permit conditions that continues more than 90 days after the town provides written notice of such violation. The decommissioning plan will ensure that the character of the property will be re-established if and when the solar use terminates. The array and components will be dismantled and recycled, roads and stormwater facilities will be removed, screening will remain unless the town requires removal, topsoil will be replaced, and any disturbed areas will be re- seeded with native species. The solar law that created the Large-Scale Photovoltaic Solar Energy System Overlay District on this parcel is consistent with the Town’s Comprehensive Plan, which included Goal EC-5-B to “revise Town regulations to facilitate local renewable energy production and use.” The solar law is also consistent with Ithaca Town Board Resolution No. 2020-049 (Resolution in Support of a Green New Deal (GND)), 8 and Ithaca Town Code Chapters 135 (Community Choice Aggregation (Energy) Program) and 144 (Energy Code Supplement). Based on the above information, impacts identified in this section would be considered small in magnitude. Staff Recommendation, Determination of Significance A negative determination of environmental significance is recommended for the action as proposed, based on review of the materials submitted for the proposed action, the information above, and analysis of the magnitude and importance of the project impacts.
