Minutes
Meeting was held via ZOOM due to Governor Cuomo's Executive order enacted during the
Novel Coronavirus (COVID-19) epidemic to help protect public health and safety.
*There were significant audio issues with this meeting.
Planning Board Members: Liebe Meier Swain, Chair; Members Fred Wilcox, Cindy Kaufman,
Christopher Biehn, Jaime Vanuccni, Gregory Lindquist, Yvonne Fogarty, and Alternate Ariel
Casper
Staff. Chris Balestra, Planner; Susan Brock, Attorney for the Town; Marty Moseley, Director of
Codes; Paulette Rosa, Town Clerk
Ms. Meier Swain opened the meeting at 7:00 p.m.

1. Agenda Item: Consideration of Preliminary and Final Subdivision approval for the
proposed 2 -lot subdivision located on Bostwick Road (west of 307 Bostwick Road), Town
of Ithaca Tax Parcel No. 31.-5-1.2, Low Density Residential Zone. The proposal involves
subdividing an 11.9 +/- acre vacant parcel into two parcels, with Parcel A consisting of 4.8
+/- acres and Parcel B consisting of 7.1 +/- acres. John F. Young, Susan M. Barnett, James
R. Young and Julie R. Young, Owners/Applicants.
Jesse Young, authorized agent, was present to answer any questions.
Ms. Balestra reviewed the survey map that was distributed.
SEQR Determination: Young 2 -Lot Subdivision, Bostwick Road.
Ms. Meier Swain asked about the indication that the property is near Town of Ithaca
conservation lands and she asked if there was any impact on this action.
Ms. Balestra responded that it does not, she just labeled the properties that are owned by the
Town adjacent to this action.
Ms. Meier Swain asked about the question regarding hooking up to public water and sewer.
Ms. Balestra responded that she consulted Ms. Brock on this one, and when we have a
subdivision that is already sold or houses actually planned and shown on the plat, we would
answer that differently, but even though the applicant intends to sell the properties for single -

family development, there are no buyers lined up and we have no idea if anything will be built
there or if it will sell.
Ms. Balestra used the example of this applicant bringing a subdivision application recently and
those haven't sold to our knowledge.
Mr. Young stated that they have been sold.
Ms. Balestra stated that when we do not know about actual plans for buildings, the Town has
always listed vacant land for subdivisions as "TBD" for that question under SEQR.
Mr. Thaete explained that the closest sewer connection is at the intersection of Seven Mile Dr
and they may need an exemption from the Engineering Dept. to get a waiver for an onsite sewer
system. For water connections, although there is a water tank right there, it might not be
available since the elevation of the home and the tank come into play. These are things that
would be seen and discussed at the building permit phase.

WHEREAS:
This action is Consideration of Preliminary and Final Subdivision approval for the proposed
2 -lot subdivision located on Bostwick Road, Town of Ithaca Tax Parcel No. 31.-5-1.2, Low
Density Residential Zone. The proposal involves subdividing an 11.979+/- acre vacant parcel
into two parcels, with Parcel A consisting of 4.836+/- acres and Parcel B consisting of 7.143+/ -
acres. John F. Young, Susan M. Barnett, James R. Young and Julie R. Young,
Owners/Applicants;
2. This is an Unlisted Action for which the Town of Ithaca Planning Board is the lead agency
with respect to Subdivision Approval;
3. The Planning Board on March 17, 2020, has reviewed and accepted as adequate a Short
Environmental Assessment Form Part 1, submitted by the applicant, and Parts 2 and 3
prepared by the Town Planning staff, a survey map entitled "Subdivision Map, Showing
Lands of John F. Young, Susan M. Barnett, James R. Young and Julie R. Young, Located on
Bostwick Road, Town of Ithaca, Tompkins County, New York", prepared by T.G. Miller,
P.C., dated 2/12/2020, and other application materials; and
4. Town planning staff has recommended a negative determination of environmental
significance with respect to the proposed Subdivision Approval;

NOW THEREFORE BE IT RESOLVED:
That the Town of Ithaca Planning Board hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental Conservation Law
and 6 NYCRR Part 617 New York State Environmental Quality Review for the above referenced
action as proposed, based on the information in the EAF Part 1 and for the reasons set forth in
the EAF Parts 2 and 3, and, therefore, an Environmental Impact Statement will not be required.

Public Hearing
Ms. Meier Swain opened the public hearing at 7:18 p.m. There was no one wishing to address
the Board and the hearing was closed.
Subdivision Determination
Ms. Balestra noted that a revised draft resolution was emailed just prior to the meeting and
explained the revision was to clarify the filing instructions for the easements.
The Board did not have any additional questions.

New York", prepared by T.G. Miller, P.C., dated 2/12/2020, and other application materials;
That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the
proposed subdivision located on Bostwick Road, as shown on the survey map noted in Whereas
#3 above, subject to the following conditions:
a. If one of the lots is conveyed, filing in the Tompkins County Clerk's office of a shared
driveway agreement and easement that has been approved by the Attorney for the Town,
at the time of the recording of the deed for the conveyed lot, and submission to the
Planning Department of proof of such filing, within 5 days of the filing; and
b. Such approval shall also be conditioned upon the filing of this Planning Board resolution
in the Tompkins County Clerk's office, indexed to the two lots, and submission to the
Planning Department of proof of such filing, prior to the issuance of a building permit.
