1. Call to Order and Pledge of Allegiance—Mr. Howe opened the meeting at 5:30 p.m. and
lead the pledge.

Tompkins County, New York, pursuant to Article 12-C of the Town Law, to be known
as the Town of Ithaca 2022 Ridgecrest Road Water Improvements Project and

Mr. Howe opened the public hearing at 5:33 p.m. There was no one wishing to speak, and the
hearing was closed.

TB Resolution 2022 -031: Public Interest Order-Water Improvement in the Town of
Ithaca, Tompkins County,New York,pursuant to Article 12-C of the Town Law to serve the
area to be known as Ridtecrest Road Water Improvement Area
At a regular meeting of the Town Board of the Town of Ithaca, Tompkins County, held at the
Town Hall, 215 North Tioga Street, in Ithaca,New York in said Town, on March 14, 2022, at
5:30 o'clock p.m., Prevailing Time.
Present: Rod Howe, Supervisor; Members Pamela Bleiwas, Bill Goodman, Eric Levine, Rich
DePaolo, Margaret Johnson and Rob Rosen

Whereas, a map,plan and report have been duly prepared in such manner and in such detail as has
heretofore been determined by the Town Board of the Town of Ithaca, Tompkins County, New
York, relating to the construction of certain water improvements, consisting of the construction of
8 and 12-inch water main, booster pump station and original equipment, machinery, apparatus,

appurtenances, as well as other incidental improvements and expenses in connection therewith, at
a maximum estimated cost of$1,096,365; and
Whereas, said map, plan and report have been prepared by competent engineers duly licensed by
the State of New York,and have been filed in the office of the Town Clerk where they are available
for public inspection; and
Whereas, said capital project has been determined to be an Unlisted Action pursuant to the
regulations of the New York State Department of Environmental Conservation promulgated
pursuant to the State Environmental Quality Review Act, the implementation of which as
proposed, it has been determined will not result in any significant adverse environmental effect;
and
Whereas, the area of the Town of Ithaca, Tompkins County, New York, to be benefitted thereby
shall be the entire area of the Town outside any villages to be known as Ridgecrest Road Water
Improvement Area of the Town of Ithaca; and
Whereas, it is proposed that all of the cost of the aforesaid improvements shall be borne by the
lands benefited thereby by assessing, levying upon and collecting from the several lots and parcels
of land within said Ridgecrest Road Water Improvement Area, outside of any villages, which the
Town Board shall determine and specify to be especially benefited by the improvements, an
amount sufficient to pay debt service, including principal and interest, on any obligations issued
pursuant to the provisions of the Local Finance Law to finance the cost of the aforesaid
improvements; and
Whereas, said costs shall be authorized to be financed by the issuance by the Town of its serial
bonds with a maximum maturity not in excess of the forty-year period prescribed by the Local
Finance Law; provided however, grants-in-aid may be received and utilized therefor; and
Whereas, the Town Board of the Town of Ithaca duly adopted an Order on February 28, 2022
calling a public hearing upon said map, plan and report and the question of providing the water
improvement to serve the area to be known as Ridgecrest Road Water Improvement Area, such
public hearing to be held on March 14, 2022, at 5:30 o'clock P.M., Prevailing Time, at the Town
Hall, 215 North Tioga Street, Ithaca,New York, in said Town, at which time and place all persons
interested in the subject thereof could be heard concerning the same; and
Whereas, notice of said public hearing was duly posted and published as required by law; and
Whereas, said public hearing was duly held at the place and at the time aforesaid and all persons
interested in the subject thereof were heard concerning the same; and
Whereas, it is now desired to authorize the improvement to serve the area to be known as
Ridgecrest Road Water Improvement Area of the Town of Ithaca; now, therefore, be it
Resolved, by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows:

Section 1. It is hereby determined that it is in the public interest to establish said
Ridgecrest Road Water Improvement Area and to make the water improvement hereinafter
described and such Ridgecrest Road Water Improvement Area is hereby established and
authorized at a maximum estimated cost of$1,096,365. The proposed area hereby determined to
be benefitted by said Ridgecrest Road Water Improvement Area is the entire area of the Town
outside the Village of Cayuga Heights. All of the property within said Ridgecrest Road Water
Improvement Area is benefited by the proposed improvement, and all of the property benefited is
included within said Ridgecrest Road Water Improvement Area.
Section 2. The proposed improvement shall consist of the construction of 8 and 12-
inch water main, booster pump station and original equipment, machinery, apparatus,
appurtenances, as well as other incidental improvements and expenses in connection therewith, at
a maximum estimated cost of$1,096,365. The proposed method of apportioning the costs of the
improvement should not be changed. The method of financing of said cost shall be by the issuance of
serial bonds of said Town to mature in annual installments over a period not exceeding forty years
and such bonds shall be payable from assessments levied upon and collected from the several lots and
parcels of land deemed benefited from said improvement and located in said benefited area outside
of any villages,so much upon and from each as shall be in just proportion to the amount of the benefit
which the improvement shall confer upon the same;but if not paid from such sources,all the taxable
real property in said Town shall be subject to the levy of ad valorem taxes without limitation as to
rate or amount sufficient to pay the principal of and interest on said bonds as the same shall become
due and payable.
Section 3. It is hereby determined that the estimated expense of the aforesaid
improvement does not exceed one-tenth of one per cent of the full valuation of the taxable real
property in the area of said Town outside of any villages and, therefore, in accordance with the
provisions of subdivision 13 of Section 209-q of the Town Law, the permission of the State
Comptroller shall not be required for such improvement.
Section 4. Pursuant to subdivision 6(d) of Section 209-q of the Town Law, the Town
Clerk is hereby directed and ordered to cause a certified copy of this resolution to be duly recorded
in the office of the Clerk of the County of Tompkins, New York, within ten days of the date this
resolution becomes effective pursuant to Town Law Section 91, which when so recorded, shall be
presumptive evidence of the regularity of the proceedings and action taken by the Town Board in
relation to the aforesaid improvement.
Section 5. It is hereby further determined that all of the cost of the aforesaid
improvement shall be borne by property within the Ridgecrest Road Water Improvement Area
constituting all of the area of said Town outside of any villages, and therefore this resolution shall
be subject to permissive referendum.
Section 6. This resolution is adopted subject to permissive referendum in the manner
provided in Town Law Article 7 and Town Law Section 209-q.
The question of the adoption of the foregoing resolution was duly put to a vote on roll call,

4. Public hearing regarding a Proposed Sewer Improvement for the Town of Ithaca,
Tompkins County, New York, pursuant to Article 12-C of the Town Law, to be known
as the Town of Ithaca Forest Home #1 Pump Station Improvements Project and
establishing the Town of Ithaca Forest Home Pump Station Sewer Improvement Area
Mr. Howe opened the public hearing at 5:36 p.m.
Bruce Brittain spoke, stating that he is in favor of the project,but it is in a beautiful park and
setting and then this jarring industrial pump station and he would love it if thought was put into
any type of beautification mitigations.
He said there are concerns from Forest Home residents about the odor that emanates from the
pump station, and if there was anything at all that could be done to mitigate that, although he
doubted it.
And lastly, the backup generator and noise and if it could be in some kind of housing to mitigate
noise.
There was no one else wishing to speak and the hearing was closed.
Mr. Thaete noted that the generator will be enclosed and is not large so the anticipated noise will
be mitigated to the extent possible. It will be turned on approximately once a week to maintain
and check functionality.
TB Resolution 2022 -032: Public Interest Order- Sewer Improvement in the Town of Ithaca,
Tompkins County, New York, pursuant to Article 12-C of the Town Law to serve the area to
be known as Forest Home Pump Station Sewer Improvement Area
At a regular meeting of the Town Board of the Town of Ithaca, Tompkins County, held at the
Town Hall, 215 North Tioga Street, in Ithaca, New York in said Town, on March 14, 2022, at
5:30 o'clock P.M., Prevailing Time.

5. Consider amending the Town of Ithaca Fee Schedule—addition of Short-Term Rental
Operating Permit fee
Mr. Howe noted that this went through the P&O Committee and needs to be in place soon for the
application process.
There were no questions or comments from the Board.
TB Resolution 2022 -033: Amend Town of Ithaca Fee Schedule—Code Enforcement Fees—
Add Short-Term Rental Operating Permit Fee
Whereas, TB Resolution 2009-227 adopted the establishment and setting of fees by Town Board
resolution; and
Whereas, the Town of Ithaca has established a Short-Term Rental Operating Permit with
associated inspection(s) to be issued to any Short-Term Rental operating in the Town, and
Whereas, the Director of Code Enforcement has reviewed the process and proposed a fee of$150
per permit to cover the cost of inspections and administrative tasks by Town staff for accepting
and processing Short-Term Rental Operating Permits, and
Whereas, on February 28, 2022, the Personnel and Operations Committee reviewed the proposed
fee and recommended it to the Town Board; now, therefore, be it
Resolved, that the Ithaca Town Board hereby approves the rate of$150 (one hundred and fifty
dollars)per Short-Term Operating Permit to the Town of Ithaca Fee Schedule, effective
immediately.

6. Consider setting a public hearing regarding local laws amending Town of Ithaca Code
Chapter 270, Zoning, regarding definitions of an Accessory Dwelling Unit and the
placement and setback of pools
Mr. DePaolo asked about the "shared"wall and if having a fire wall separation makes it not
"attached."
Mr. Moseley responded that under NYS Code, they are considered separate units, but for zoning
purposes, they are considered attached if they share a wall.

TB Resolution 2022 -034: Setting a public hearing regarding proposed amendments to
Town of Ithaca Code, Chapter 270, Zoning, regarding new definitions for attached and
detached dwelling units and provisions for the placement of swimming pools
Resolved that the Town Board will hold a public hearing at its hybrid meeting on April 11, 2022,
beginning at 5:30 p.m. at 215 N. Tioga St., Ithaca, and via ZOOM to hear all parties interested in
speaking for or against the proposed amendments to Town of Ithaca Code, Chapter 270, Zoning,
regarding new definitions for attached and detached dwelling units and provisions for the
placement of swimming pools.

7. Consider approval of Sewer Exemption requests
Mr. Thaete gave an overview of the requests and Staff s determinations on costs feasibility of
connecting to municipal services.
There was some discussion on municipal services in the West Hill, Mecklenburg Rd area and
any future plans for development. There are issues with both water and sewer services right now
and no planned development in the area in the Comprehensive Plan. If a large developer were to
submit a plan, the services would have to be discussed at that time.

TB Resolution 2022 -035: Authorization for the Town Engineer to issue a Sewer
Exemption for 121 Hillcrest Drive
Whereas the Town Engineer received a request for a sewer exemption from the owner(s) of 121
Hillcrest Drive in which the owner(s) detailed the difficulties associated with connecting to
municipal sewer due to the nearest sewer main(s)being approximately 570+/- feet away and
connection to the municipal sanitary sewer system may require pumps and/or a long gravity
sewer lateral and a main extension at an estimated cost of$100K, and
Whereas the owners are constructing a single-family home on the property and the Tompkins
County Health Department has designed and approved a septic system for the proposed home,
now therefore be it
Resolved, pursuant to Town Code Section 214-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons
conveyed by town staff and the reasons detailed in the request for a sewer exemption submitted
to the Town Engineer, dated March 2, 2022, and be it further

Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from Town
Code Section 214-5 Connection required, for 121 Hillcrest Drive for the installation of a new,
onsite wastewater treatment system associated with a proposed new single-family residence,
subject to the consent of the Tompkins County Health Department.

TB Resolution 2022 -036: Authorization for the Town Engineer to issue a Sewer
Exemption for 1335 Mecklenburg Road-Parcel B
Whereas the Town Engineer received a request for a Sewer Exemption from the future owner(s)
of 1335 Mecklenburg Road-Parcel B indicating there is no access to town sewer and identifying
the difficulties associated with connecting to municipal sewer due to the nearest sewer main(s)
being approximately 2000+/- feet away, which would require a main extension at an estimated
cost of$350K, and
Whereas the future owners are constructing a single-family home on the property and the
Tompkins County Health Department has designed and approved a septic system for the
proposed home, now therefore be it
Resolved, pursuant to Town Code Section 214-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons

8. Discuss proposed amendments to the Energy Code Supplement
Mr. Howe noted that Mr. Goldsmith sent out a comprehensive memo regarding the changes
being requested.
Mr. DePaolo asked about the adaptive reuse and exclusion for major renovations of buildings
and reuse for the same purpose. He didn't understand why a major renovation for an existing use
did not qualify,yet a major renovation for a new use did.

Mr. Goldsmith responded that this topic generated a lot of discussion, and the tripwire for getting
points is pretty high and meant to not give out points for every renovation coming through.
Mr. Moseley added the concept was to encourage people who purchase older buildings for a
different use to renovate rather than tear down and build new.
Mr. Goodman added that people doing major renovations for the same use will generally be
getting a lot of points through the energy upgrades. Also, we want to encourage people to build
where people can walk to various places, so there is a point for that also, to encourage new uses
for existing buildings.
Different examples of reuses were noted, such as the old railroad station becoming a bank and
South Hill Business campus and the upcoming Chainworks.
TB Resolution 2022 -037: Setting a public hearing regarding proposed changes to Town of
Ithaca Code, Chapter 144, Energy Code Supplement
Resolved that the Town Board will hold a public hearing at its hybrid meeting on April 11, 2022,
beginning at 5:30 p.m. at 215 N. Tioga St., Ithaca, and via ZOOM to hear all parties interested in
speaking for or against the proposed changes to Town of Ithaca Code, Chapter 144, Energy Code
Supplement to align with NYS Law and to clarify and provide addition details for various
provisions.

Vote: ayes—Goodman, Levine, Howe, DePaolo, Johnson, Rosen and Bleiwas

recommended them to the Town Board for approval, and

10. Consider approval of the Final 2021 Budget Transfers
Ms. Johnson asked if this was a usual occurrence and number of transfers.
Ms. Shaw responded that it is normal and the budget is a plan or outline and this is the process
for cleaning up the loose ends.

12. Report of Town Officials and Committees
Mr. Howe reported on the need for a town representative on the Tompkins County Youth
Services Board. Discussion followed and the Board felt a younger person would be the best to
represent their ideas and needs to the Board and Ms. Rosa will put it in the next newsletter and
members can think about anyone they felt might be interested.
Tompkins County Library issued a new flyer with Sunday hours, noting that they are supported
by the Towns contribution.
OpenGov program is tentatively set for March 28th rollout.
13. Review of Correspondence
Mr. DePaolo asked about process in getting correspondence out, noting in the past there had
been a folder available.
Ms. Rosa explained that any correspondence she receives addressed to the Town Board goes out
via email to the full Board as soon as she sees it and letters sent out by Mr. Howe are usually just
listed. The cover sheet is usually followed by the permanent scanned correspondence.
