Appointment of an Engineering Tech- Clapp MEETING OF THE ITHACA TOWN BOARD October 21, 2024 TB Resolution 2024 - Authorization to proceed with contracting for survey services and authorization to proceed with purchase contract for potential purchase of agricultural conservation easement on Tax Parcel No. 24.I-34.2 (Pokornev) Whereas, the owner of Town of Ithaca Tax Parcel No. 24.-1-34.2 (Denise C. Scott-Pokorney/ 282 Hayts Road) has expressed interest in the potential sale of the development rights to her property through the purchase of an agricultural conservation easement by the Town of Ithaca; and Whereas, on March 16, 2023 the Town's Planning Committee reviewed the application and property details and recommended that an appraisal be completed for the property, which was authorized by the Town Board on April 10, 2023; and Whereas, an appraisal was completed in January 2024 with the easement value determined to be $127,000; and Whereas, the Planning Committee (04/18/2024 mtg) and the landowner concur with the appraised easement value, and the landowner has offered to donate '/a of the value ($31,750), reducing the cost of the easement to the Town to $95,250; and Whereas, the Planning Department has received a proposal from T.G. Miller, P.C. to perform a boundary survey and conservation easement mapping, with a total cost of$5,750; and Whereas, a Purchase of Development Rights Agreement and Sales Contract has been prepared to outline the process, costs, and responsibilities for this conservation easement project; now, therefore, be it Resolved, that the Town Board of the Town of Ithaca authorizes the Town Supervisor to execute the "Purchase of Development Rights Agreement and Sales Contract"with C. Denise Scott- Pokorney regarding the potential purchase of an agricultural conservation easement at 282 Hayts Road (Tax Parcel No. 24.-1-34.2), and be it further Resolved, that the Town Board of the Town of Ithaca authorizes the hiring of T.G. Miller, P.C. to perform a boundary survey and conservation easement mapping for Tax Parcel No. 24.-1- 34.2, at a cost not to exceed$5,750. Tioga Street, Ithaca NY1485U 607-273-1747 TO: TOWN BOARD MEMBERS FROM: M|CHAEL SMITH, SENIOR PLANNER DATE: O[TO8ERl5, 7024 RE: AGRICULTURAL CONSERVATION EASEMENT—SURVEY & PURCHASE CONTRACT - C. DEN|SESCOTT-POKOANEY (282HAYTSROAD) As you may recall from 202S, the Town received an application from C. Denise Scott-Pokorney at 282 Hayts Road to participate in the Tovvn'sAgricultural Land Preservation Program. This program was set up by the Town in 1999 to preserve the Tovvn'sfarrn|and resources by purchasing the development rights (PDR) on active agricultural lands. The Town purchases the development rights from willing sellers, and the landowner conveys to the Town of Ithaca an agricultural conservation easement. Through this program, the Town has previously acquired three agricultural conservation easements (Laughing Goat Fiber Farm, Indian Creek Farm, and the Mallon property). Last year the Planning Committee reviewed this application along with materials provided by Planning Staff and made recommendation to the Town Board that aforrna| appraisal be prepared for the property. In April 2023 the Town Board authorized the hiring of North East Appraisal & Management Co. Inc. to prepare the appraisal, which was provided to the Town in January 2024. The cost of the agricultural conservation easement for the Pokorney easement is $127,000. A copy of the appraisal was provided to the landowner, who also offered to donate Y4of the value ($31,750) of the conservation easement purchase price, reducing the cost of the easement to the Town to $95,250. If the Town decides to continue to move forward with this easement, the funds will most likely come from theTovvn's Open Space Reserve Account. The Planning Committee has also discussed the appraisals at their February and April 2024 meetings and are interested in moving forward with this easement. An update was provided to the Town Board in May 2024 on the status of this potential easement and the next steps. Since then, Planning staff obtained 3 prOpOSJ| from T.G. Miller, P.C. regarding the survey work that vvOu|d be required to noOv8 this easement forward and has worked with Attorney for the Town Guy K. Krogh to draft the Purchase of Development Rights Agreement and Sales Contract. The landowner reviewed the draft contract and is prepared to sign and move forward with this project. Once the contract is signed, Planning staff and the Attorney for the Town will move forward with the survey work and draft other documents (easement, site plan, baseline documentation report, etc.) necessary to complete this project. Attached is a copy of the draft Purchase of Development Rights Agreement and Sales Contract, a copy of the T.G. Miller, P.C. proposal, and a 2023 aerial image showing the property. TB Resolution 2024—d: Approve Provisional Appointment of Engineering Technician I - Clapp Whereas there is a vacancy in the Engineering Technician I position in the Engineering Department; and Whereas the Interview Committee interviewed five candidates from an open recruitment for the position; and Whereas the Committee has determined that Madison Clapp possess the necessary knowledge and skills to satisfactorily perform the duties of the position; and Whereas Dave O'Shea, Director of Engineering, appointed Madison Clapp as Engineering Technician I, effective October 28, 2024; now, therefore be it Resolved the Town Board of the Town of Ithaca does hereby approve the provisional appointment of Madison Clapp as Engineering Technician I for the Engineering Department, effective November 4, 2024; and be it further Resolved the position is at 40 hours per week, at the hourly wage of$31.38, which is an estimated annual salary of$65,270 from F8340.101, in Job Classification "IV", with full time benefits; and be it further Resolved, the said appointment is a provisional appointment pending the results from the next civil service exam for this position.
