Town or village Clerk or tive bodyieiive do DOS-0239-f-l (Rev. 06/12) Page 4 of 4 Adopted 6-9-2014 TOWN OF ITHACA LOCAL LAW NO. 12 OF THE YEAR 2014 A Local Law Amending the Town of Ithaca Code, Chapter 270 Entitled “Zoning”, to Eliminate Site Plan Requirements for Rooftop and Building- Mounted Solar Collectors Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 270 (Zoning) of the Town of Ithaca Code, Section 270- 219.1, entitled “Solar collectors and installations,” is amended by replacing Paragraph C. of such Section in its entirety with the following: “C. Where site plan approval is required elsewhere in this chapter for a development or activity, the site plan review shall include review of the adequacy, location, arrangement, size, design, and general site compatibility of proposed ground-mounted and freestanding solar collectors. Where a site plan exists, an approved modified site plan shall be required if an y of the thresholds specified in § 270-191 of this chapter are met, including but not limited to proposed changes to or additions of ground-mounted or freestanding solar collectors where such changes or additions meet a § 270-191 threshold. Proposed changes to or additions of rooftop or building-mounted solar collectors shall not be considered in the determination of whether a site plan modification is required.” Section 2. If an y provision of this local law is found invalid b y any court of competent jurisdiction, such invalidity shall not affect any other provisions of this local law, which shall remain in full force and effect. Section 3. This local law shall take effect immediatel y upon its filing with the New York Secretary of State.
