City, Town or Village Clerk or officer designated by loyal legi^tive body (Seal) Date: nOR-n?39-f-l rPfiv. 06/1P> Pans 4 nf 4 Adopted May 11, 2015 pg. 1 TOWN OF ITHACA LOCAL LAW NO. 3 OF THE YEAR 2015 A LOCAL LAW AMENDING THE TOWN OF ITHACA CODE, CHAPTER 230 ENTITLED “STREETS AND SIDEWALKS,” CHAPTER 234 ENTITLED “SUBDIVISION OF LAND,” AND CHAPTER 270 ENTITLED “ZONING,” TO ADD REFERENCES TO THE TOWN OF ITHACA COMPLETE STREETS POLICY Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 230, entitled “Streets and Sidewalks,” of the Town of Ithaca Code, Article II, entitled “Construction and Repair of Sidewalks,” is amended by deleting the last sentence from Section 230-6, entitled “Construction of sidewalks,” and replacing it with the following: “No construction, reconstruction or repair of sidewalks shall be permitted, in those areas where the Town Board has ordered the construction or maintenance of sidewalks, that does not comply with the attached specifications, unless waived or modified by the Town Board as set forth above, and the Town of Ithaca Complete Streets Policy.” Section 2. Chapter 234, entitled “Subdivision of Land,” of the Town of Ithaca Code, Article I, entitled “Introduction and Administration,” is amended by deleting from Section 234-2, entitled “Policy,” the entire paragraph E, and replacing it with the following: “E. All streets shall be of such width, grade, and location in order to accommodate the prospective traffic, including accommodation of pedestrian and bicycle traffic as may be required by the Town of Ithaca Complete Streets Policy, and to facilitate emergency services, and to provide access for all fire-fighting equipment to all buildings.” Section 3. Chapter 234, entitled “Subdivision of Land,” of the Town of Ithaca Code, Article IV entitled “Reservation Requirements and Subdivision Design Standards,” is amended by deleting the last sentence from paragraph A of Section 234-23, entitled “Highway improvements,” and replacing it with the following: “The subdivider shall improve or agree to improve all highways, alleys, and other ways to provide drainage improvements, all in such manner as is necessary for the general use of lot owners in the subdivision and to meet local traffic and drainage needs, including the needs of pedestrian and bicycle traffic as may be required by the Town of Ithaca Complete Streets Policy.” Adopted May 11, 2015 pg. 2 Section 4. Chapter 270, entitled “Zoning,” of the Town of Ithaca Code, Article XXIII, entitled “Site Plan Review and Approval Procedures,” is amended by deleting from Section 270-188, entitled “Considerations for approval,” the entire paragraph M, and replacing it with the following: “M. Compliance with the Town's Comprehensive Plan, Zoning Ordinance, Subdivision Regulations, Water Resources Ordinances, if applicable, Outdoor Lighting Law, Complete Streets Policy, and any other applicable laws, rules, requirements, or policies.” Section 5. If any provision of this local law is found invalid by any court of competent jurisdiction, such invalidity shall not affect any other provisions of this local law, which shall remain in full force and effect. Section 6. This local law shall take effect immediately upon its filing with the New York Secretary of State.
