Department of State Adopted August 7, 2017 TOWN OF ITHACA LOCAL LAW NO. 14 OF THE YEAR 2017 A LOCAL LAW CONFORMING SIGN REQUIREMENTS REFERENCES IN TOWN OF ITHACA CODE CHAPTER 125, TITLED “BUILDING CONSTRUCTION AND FIRE PREVENTION,” AND CHAPTER 173, TITLED “LIGHTING, OUTDOOR” Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 125 of the Town of Ithaca Code (“Building Construction and Fire Prevention”), Section 125-4 (“Building permits”), Subsection A is amended by deleting “Chapter 221, Signs” in the first sentence and replacing the deleted text with “Article XXIX, Signs, of Chapter 270, Zoning” so that the first sentence in Subsection A reads as follows: “No person, firm, corporation, association or other organization shall commence the erection, construction, enlargement, alteration, improvement, repair, removal, or demolition of any building or structure (including signs, except as specified in Article XXIX, Signs, of Chapter 270, Zoning, of the Code of the Town of Ithaca), nor install heating equipment, nor undertake any other work which must conform to the Uniform Code, without having applied for and obtained a building permit from a Code Enforcement Officer.” Section 2. Chapter 173 of the Town of Ithaca Code (“Lighting, Outdoor”), Section 173 -8 (“Outdoor signs”), Subsection D, is amended by deleting “§ 221-8” and replacing the deleted text with “the requirements in Article XXIX, Signs, of Chapter 270, Zoning,” so that Subsection D reads as follows: “In addition to the foregoing requirements, all outdoor signs must conform to the requirements in Article XXIX, Signs, of Chapter 270, Zoning, of the Town of Ithaca Code regarding sign illumination.” Section 3. If any provision of this local law is found invalid by any court of competent jurisdiction, such invalidity shall not affect any other provisions of this local law, which shall remain in full force and effect. Section 4. This local law shall take effect immediately upon filing with the New York Secretary of State.
